CC RES 1993-085RESOLUTION NO. 93 - 85 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF RANCHO PALOS VERDES MEMORIALIZING THE CITY COUNCIL'S INTENT TO CONDUCT A PERIODIC LEGISLATIVE REVIEW OF THE CITYWIDE LANDSCAPING AND LIGHTING DISTRICT WHEREAS, changes in the economy, the limited portion of property tax received by the City and continuing cuts in funding from the State government have made it necessary for the City Council to raise fees, establish the 1972 Act Landscaping and Lighting Assessment District and impose additional taxes such as a golf tax and a utility users tax; and WHEREAS, the continuation of the Citywide Landscaping and Lighting District would reduce the City's General Fund projected shortfall by approximately $800,000; and WHEREAS, the City Council recognizes the concern of the citizens of the City of Rancho Palos Verdes, expressed in numerous public meetings, that all revenues measures be periodically reviewed to determine if it is necessary to revise or repeal them; NOW, THEREFORE, BE IT RESOLVED THAT: Section 1. Beginning in January, 1996 and every four years thereafter, the City Manager shall submit for consideration by the City Council an analysis of the revenues derived from the Citywide Landscaping and Lighting Assessment District. This process shall be in addition to any procedures required by the Landscaping & Lighting Act of 1972. Based on the needs of the City, the City Council shall determine if any modifications to the District are necessary or if the assessments imposed by the District should be discontinued. Said review shall be completed by the City Council prior to the adoption of the budget being prepared for the next fiscal year. The assessments imposed by the District shall not be levied if the City Council does not conduct the review required by this Section. Section 2. The City Council hereby reaffirms the procedures adopted by the City Council on December 15, 1992 whereby individuals who are financially unable to pay the assessment levied against lots and parcels within the Citywide Landscaping and Lighting Assessment District may enter into an agreement with the City so that the payment by the individual of the assessment and penalty or interest may be deferred is hereby affirmed. Section 3. Resolution No. 92 -84 is hereby repealed.
