CC RES 1993-016RECORDING REQUESTED BY AND MAIL TO 54111 Goo RESOLUTION NO. 93 -16 �U ?A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF RANCHO PALOS VERDES ORDERING THE VACATION OF THE BRIDLE TRAIL EASEMENT ALONG THE SOUTHERLY BOUNDARY OF TRACT 46422, ALSO KNO .A AS ALID PLACE FREE Z WHEREAS, on April 21, .1992, Resolution of Intention 92- 109 was adopted in the matter of the vacation of the Bridle trail easement in Tract 46422 in the City of Rancho Palos Verdes, which resolution established the time and place for the public hearing on said bridle trail easement vacation; and WHEREAS, due notice of said hearing has been published and posted as required by law; and WHEREAS, at the hearing the City Council heard all evidence offered by persons interested in said vacation; NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF RANCHO PALOS VERDES FINDS, DETERMINES AND RESOLVES: Section 1. (a) That said bridle trail easement along lots 5, 6 and 7 of Tract 46422 described in the Resolution of Intention, namely Resolution No. 92 -109, was originally intended to be utilized for bridle trail purposes. (b) The aforesaid bridle trail easement is unnecessary for present or prospective public use because it does not connect or provide access to any other trails or trail easements, and the City does not expect such trails or trail easements to be created in the. future. Section 2, The City Council has considered the General Plan of the City of Rancho Palos Verdes and finds the vacation to be in conformity with said Plan. Section 3. Pursuant to Section 238.1 of the Streets and Highways Code of the State of California the City Council finds and determines the bridle trail easement proposed for abandonment is not useful_ as a non - motorized transportation facility. Section , 4, The City Council of the City of Rancho Palos Verdes hereby orders the vacation of the bridle trail easement more particularly described as that certain ten foot strip of land running along lots 5, 6 and 7 of Tract 46422, also known as Alida Place, within the City of Rancho Palos Verdes, County of Los Angeles, State of California, as shown on the Map of Tract 46422, recorded on November. 23, 1990, in Map Book 1169, 930225 R6876 -00001 pjr 0691209 (1) pages 95 -97 in the Office of the County Registrar Recorder of the County of Los Angeles. .Section 5. That the City Council reserves and exempts from the vacation of the bridle trail easement the existing utility easement and the right at any time, or from time to t ime to ccn strl l ct , maintain, operate, replace. remove and renew sanitary sewers and storm drains and appurtenant structures in, upon, over and across the bridle trail easement proposed to be vacated and, pursuant to any existing franchise or renewals thereof, or otherwise, to construct, maintain, operate, replace, renew and enlarge lines of pipe, conduits, cables, wires and other convenient structures, equipment and fixtures for the operation of gas, telephone, electrical, water and telegraphic lines, in, upon, and over the bridle trail proposed to be vacated. Further, any easement and right necessary to maintain, operate, replace, remove, or renew public utility facilities is excepted from this vacation. Section 6, The City Clerk is hereby ordered to cause a certified copy of this Resolution, attested by the City Clerk under the Seal of the City, to be recorded in the Office of CJ1 the County Registrar- Recorder of Los Angeles County.'
