CC RES 1994-026RESOLUTION NO. 94 -26 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF RANCHO PALOS VERDES APPROVING THE SUBMITTAL OF AN APPLICATION FOR GRANT FUNDS FROM THE LOS ANGELES COUNTY REGIONAL PARK AND OPEN SPACE DISTRICT TRAIL ACQUISITION AND DEVELOPMENT COMPETITIVE GRANT PROGRAM TO IMPROVE EXISTING DEDICATED CATEGORY 1 TRAILS, AS DESCRIBED IN THE CITY'S CONCEPTUAL TRAILS PLAN, WHICH HAVE DETERIORATED; AND, WHERE APPROPRIATE, PROVIDE FEATURES TO FACILITATE THE ACCESS AND USE OF TRAILS AND TRAIL SEGMENTS BY PERSONS WITH DISABILITIES. WHEREAS, on November 3, 1992, the people of the County of Los Angeles enacted Los Angeles County Proposition A, Safe Neighborhood Parks, Gang Prevention, Tree - Planting, Senior and Youth Recreation, Beaches and Wildlife Protection (the "Proposition ") which, among other uses, provides funds to public agencies and non - profit organizations in the County for the purpose of acquiring and developing land and rights -of -way for walking, hiking, horse, bicycle, and handicapped access trails; and WHEREAS, the Proposition also created the Los Angeles County Regional Park and Open Space District (the "District ") to administer said funds; and WHEREAS, the District has set forth the necessary procedures governing applications for grant funds under the Proposition; and WHEREAS, Section 8.a.3.A has allocated funds for the acquisition and development of land and rights -of -way for walking, hiking, horse, bicycle, and handicapped access trails; and WHEREAS, the District's procedures require the Applicant to certify, by resolution, the approval of the application before submission of said application to the District; and WHEREAS, any Applicant selected for a grant award will be required to enter into an Agreement with the District for the performance of the project as described in the application; and WHEREAS, said Agreement will contain assurances with which the Applicant must comply, including an assurance to provide any additional funds that may be required to complete the project if the grant funds required are insufficient and an assurance to maintain the property in perpetuity; NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF RANCHO PALOS VERDES DOES HEREBY FIND, DETERMINE, AND RESOLVE AS FOLLOWS: Section l: The filing of an application with the Los Angeles County Regional Park and Open Space District for funds allocated under Section 8.a.3.A of the Proposition to improve existing dedicated Category 1 trails, as described in the City's Conceptual Trails Plan, and which have deteriorated, and, where appropriate, to provide features to facilitate the access and use of trails and trail segments by persons with disabilities, has been approved by the City Council. Section 2: The City of Rancho Palos Verdes understands that it will be required to provide additional funding for the project described in Section 11 if the requested grant funds are insufficient to complete said project. Section 3: The City of Rancho Palos Verdes has, or will have, sufficient funds to operate and maintain the property(s) in perpetuity. Section 4: The Director of Planning, Building, and Code Enforcement, in association with the Director of Public Works, as agents of the City of Rancho Palos Verdes has been appointed to execute and submit all documents including, but not limited to, applications, agreements, amendments, payment requests and so forth, which may be necessary for the completion of the aforementioned project, PASSED, APPROVED, and ADOPTED this 19th day of April 1994, ATTEST: CITY STATE WF CALIFORNIA COUNTY OF LOS ANGELES ) ss CITY OF RANCHO PALOS VERDES I, Jo Purcell, City Clerk of the City of Rancho Palos Verdes, hereby certify that the above Resolution No. 94 -26 was duly and regularly passed and adopted by the said City Council at a regular meeting held on April 19, 1994. /?
