CC RES 1994-041RECORDING REQUESTED BY • City of Rancho Palos Verdes AND WHEN RECORDED MAIL Tp City Clerk 30940 Hawthorne Blvd. Rancho Palos Verdes, CA 90274 94Z:1599541 RECQRDEQ /FILED iN OFFICIAL RECORDS RECORDER'S OFFICE LOS ANGELES COUNTY CALIFORNIA MIN. 8 ILMe AUG 30 199 PAST RESOLUTION NO. 94-41 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF RANCHO PALOS VERDES ABANDONING PROCEEDINGS TO FORM RANCHO PALOS VERDES IMPROVEMENT DISTRICT NO. 7 (SEACOVE DRIVE) R E..� WHEREAS, a petition for the conversion of existing overhead electric and communication facilities to underground facilities in Seacove Drive and other rights of way in the City of Rancho Palos Verdes, and a waiver of rights under the Special Assessment Investigation, Limitation and Majority Protest Act of 1931, Division 4 of the California Streets and Highways Code were presented to the City Council of the City of Rancho Palos Verdes; and WHEREAS, the City Clerk of the City of Rancho Palos Verdes, subsequent to reviewing said petition and waiver, executed a certificate of sufficiency and presented said petition and waiver and certificate to the City Council; and WHEREAS, the City Council adopted Resolution Nos, 85- 14, 86 -62 and 86 -71, instituting proceedings for, declaring its intention to order, and ordering the formation of, an assessment district designated as the "Rancho Palos Verdes Improvement District No. 7," and ordering the conversion of existing electric and communication facilities to underground facilities within such district pursuant to the Improvement Act of 1911, Division 7 of the California Streets and Highways Code; and WHEREAS, the conversion of existing electric and communication facilities to underground facilities has not commenced, and no assessment has been made to cover the cost of such conversion; and WHEREAS, the City Council has determined that, because of an increase of over one hundred percent (100 %) in the initial cost estimates, further proceedings in connection with such assessment district under and in accordance with the provisions of the Improvement Act of 1911, Division 7 of the California Streets and Highways Code, would no longer serve the public interest or convenience; NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF RANCHO PALOS VERDES HEREBY FINDS, DETERMINES, RESOLVES AND ORDERS AS FOLLOWS: Section 1, Rancho Palos Verdes Improvement District No. . 7 is hereby abandoned. r E2 1 Section 2.
