A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF RANCHO PALOS VERDES ADOPTING A NEGATIVE
DECLARATION PURSUANT TO THE CALIFORNIA
ENVIRONMENTAL QUALITY ACT, FOR CODE AMENDMENT
NO. 40 AND ENVIRONMENTAL ASSESSMENT NO. 666,
REGARDING AN AMENDMENT TO CHAPTER 15.2 0 OF THE
RANCHO PALOS VERDES MUNICIPAL CODE REGARDING
THE MORATORIUM ON LAND USE PERMITS.
WHEREAS, on May 17, 1994, the City Council of the City of
Rancho Palos Verdes held a hearing regarding the initiation of a
Code Amendment to clarify existing language in Chapter 15,20 of the
Rancho Palos Verdes Municipal Code entitled "Moratorium on Land Use
Permits" in order to both correct internal inconsistencies, and to
strengthen the Chapter's provisions regarding the requirements, as
well as the review process, for projects excepted from the
provisions of that Chapter; and,
WHEREAS, on July 18, 1994, the City initiated this project on
in the form of Code Amendment No. 40, and Environmental Assessment
No. 666; and,
WHEREAS, pursuant to the provisions of the California
Environmental Quality Act, Public Resources Code Sections 21000 et
seq. ("CEQA"), the State CEQA Guidelines, California Code of
Regulation, Title 14, Sections 15000 et seq. , the City's Local CEQA
Guidelines, and Government Code Section 65952,5 (e ) (Hazardous Waste
and Substances Statement) , the City prepared an Initial Study and
determined that there was no substantial evidence that the adoption
of Code Amendment No. 40 would have a significant effect on the
environment. Accordingly, a draft Negative Declaration was
prepared and notice of that fact was given in the manner required
by law; and,
WHEREAS, a duly noticed public hearing before the City Council
of the City of Rancho Palos Verdes was held to consider the
proposed Negative Declaration was held on September 6, 1994, at
which time it was decided that the Initial Study would be amended
and re- circulated; and,
WHEREAS, an Amended Initial Study was prepared and re-
circulated in the manner required by law, and a duly noticed public
hearing before the City Council of the City of Rancho Palos Verdes
was held to consider the proposed Negative Declaration on May 2,
1995, and May 16, 1995, at which time public comments on the Draft
Negative Declaration, Environmental Assessment No. 666, and Code
Amendment No. 40 were received by the City Council.
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF RANCHO PALOS
VERDES DOES HEREBY FIND, DETERMINE AND RESOLVE AS FOLLOWS:
Section 1: The City Council has reviewed and considered both
the originally proposed, and the re- circulated Negative
Declaration, the public and written co upon , comments u it and the other
evidence presented, and finds that the Negative Declaration was
prepared in the manner required by law, and that there is no
substantial evidence that the adoption of the Code Amendment would
have a significant effect on the environment, and that no
mitigation measures are necessary to eliminate significant
environmental effects of the proposed project*
Section 2: That although the Code Amendment serves only to
effectuate wording changes in the existing Municipal Code, the
Council recognizes that separate environmental review will be
performed ormed for any projects to which Chapter 15.2 0 applies prior to
receiving any approvals by the Director of Planning, Building, and
Code Enforcement, or by the City Council.
Section 3: Based on the foregoing, the City Council finds
that the adoption of the draft Negative Declaration is in the
public interest.
Section 4: Based upon the facts contained in this Resolution,
in the Staff Reports, minutes, and other components of the
legislative record, in the draft Negative Declaration, and in the
public comments received by the City Council, the City Council of
the City of Rancho Palos Verdes hereby adopts the Negative
Declaration associated with Environmental Assessment No. 656 with
regard to Code Amendment No, 40.
