CC RES 1995-003RESOLUTION NO. 95 -03 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF RANCHO PALOS VERDES, CALIFORNIA PROCLAIMING THE EXISTENCE OF A LOCAL EMERGENCY AND CONFIRMING CERTAIN ORDERS AND ACTIONS OF THE DIRECTOR OF EMERGENCY SERVICES THE CITY COUNCIL OF THE CITY OF RANCHO PALOS VERDES DOES HEREBY RESOLVE AS FOLLOWS: Section 1: Findings. A. In early January of 1995, a series of severe rain storms struck the City of Rancho Palos Verdes, causing extreme damage and dangerous conditions throughout the City. B. In response to the emergency situation created by the storms, the Director of Emergency Services proclaimed a local emergency pursuant to Chapter 2.24 of the Rancho Palos Verdes Municipal Code, as the City Council was not in session at the time. C. To assist residents and owners of over 40 identified properties to repair and remediate the dangerous conditions and damage which resulted from the storms and to protect life and property, the Director of Emergency Services issued certain rules and regulations in conjunction with his proclamation of a local emergency pursuant to the authority granted to him by Rancho Palos Verdes Municipal Code Section 2.24.060 (A) (6) (a) . Specifically, the Director of Emergency Services issued the following orders: 1. The Director of Planning, Building and Code Enforcement and his designees are hereby directed to expedite processing of applications for grading permits necessary to repair or remediate damage or dangerous conditions resulting from the storms of January, 1995, involving legal pre- existing slopes or retaining walls. 2. The provisions of Section 17.50.060 requiring submission to the planning commission of specified grading permit applications are hereby suspended for those applications for grading permits necessary to repair or remediate damage or dangerous conditions resulting from the storms of January, 1995, involving legal pre - existing slopes or retaining walls. The Director of Planning, Building and Code Enforcement shall review all such grading permit applications in accordance with the criteria and purposes established in Chapter 17.50 of the Rancho Palos Verdes Municipal Code, and may impose reasonable conditions on said permits. 3. Notwithstanding Rancho Palos Verdes Municipal Code Section 17.50.100, any decision of the Director of Planning, Building and Code-Enforcement taken pursuant to this order shall be appealable directly to the City Council, 4. The provisions of Rancho Palos Verdes Municipal Code Sections 17.50.080 and 17.50.100, relating to application and appeal fees, are hereby waived for any application for a grading permit necessary to repair or remediate damage or dangerous conditions resulting from the storms of January, 1995, involving legal pre- existing slopes or retaining walls . 5. This order shall apply only to those applications for grading permits necessary to repair or remediate damage or dangerous conditions resulting from the storms of January, 1995, involving legal pre- existing slopes or retaining walls O Such applications must be completed and submitted to the Department Planning, Building and Code Enforcement not later than March 10, 1995. The applicant shall complete any work approved by the Department within one hundred eighty (180) days of approval of the application. 6. This order shall not apply to applications for expansion or intensification of any slope or retaining wall, which shall be subject to the normal review process. D, To further protect life and property, in conjunction with his proclamation of a local emergency, the Director of Emergency Services ordered actions by City staff in exercise of the powers and duties conferred upon him by Section 2.2 4.0 6 0 ( A) ( 6) ( a ) through (e). Such actions included, without limitation: 1. The placement of sand bags and the diversion of water; 2. Emergency road repairs; 3. Removal of dirt, debris and water with equipment and by hand; 4. Removal of trees fallen from private property onto the public -ni ght -of -way; 6. Emergency property inspections; 7. Stockpiling of dirt; E. The Director of Emergency Services now requests that the City Council ratify the proclamation of local emergency and confirm the rules, regulations, actions and orders described above. F. Conditions of extreme peril to the safety of persons and property within this City now exist, which were caused by the storms of January, 1995. These conditions of extreme peril warrant and necessitate the proclamation of the existence of a local emergency. Section 2: CEQA Findings. The provisions of the California Environmental Quality Act ( do not apply to this Resolution, or to any of the actions and orders ratified herein, pursuant to Public Resources Code Section 21172 and CEQA Guidelines Section 15269. Section 3. Proclamation of Local Emergency. A. The City Council hereby ratifies the Director of Emergency Service's proclamation that a local emergency now exists throughout the City. 8, The City Council declares that the emergency rules, regulations, actions, and orders described above were taken in accordance with Chapter 2.24 of the Rancho Palos Verdes Municipal Code and hereby confirms and ratifies the same. Section 4, Duration. This local emergency shall be deemed to continue to exist until January 31, 1995 unless extended by the City Council.
