CC RES 1995-093RESOLUTION NO. 95 -93 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF RANCHO PALOS VERDES AMENDING RESOLUTION N0. 95 -04, DECLARING SILVER SPUR UNDERGROUNDING DISTRICT AN UNDERGROUND UTILITY DISTRICT AND ORDERING THE REMOVAL OF OVERHEAD FACILITIES AND INSTALLATION OF UNDERGROUND FACILITIES PURSUANT TO CHAPTER 12.12 OF THE RANCHO PALOS VERDES MUNICIPAL CODE THE CITY COUNCIL OF THE CITY OF RANCHO PALOS VERDES HEREBY FINDS, DETERMINES, RESOLVES AND ORDERS AS FOLLOWS: Section 1. The City Council, by its Resolution No. 95- 4, as amended by Resolution Nos. 95 -28, 95 -57, and 95 -77, declared the Silver Spur Undergrounding District (the "District ") , consisting of an area generally located along Silver Spur Road from Hawthorne Boulevard to approximately 800 feet north of Basswood Avenue, to be an underground utility district pursuant to Chapter 12.12 of the Rancho Palos Verdes Municipal Code. The resolution was to take effect upon receipt of a commitment from outside funding sources to finance a portion of the improvements for the District. Such commitments were to be received by November 15, 1995. Section 2. The County of Los Angeles has approved the use of $300,000 of the County of Los Angeles' Rule 20A utility funds for the improvements for the District. Section 3. On August 15, 1995, the City Council of the City of Rolling Hills Estates approved the use of $60,000 of the City of Rolling Hills' Rule 20A utility funds for the improvements for the District. Section 4. On August 22, 1995, the City Council of the City of Palos Verdes Estates approved the use of $80,000 of the City of Palos Verdes Estates' Rule 20A utility funds for the improvements for the District. Section 5. Section 8 of Resolution No. 95 -4 is hereby amended to read as follows: "The City Council hereby orders the removal of all poles, overhead wires and associated overhead structures, and the underground installation of wires and facilities for supplying electric, communication, or similar or associated service, within District. Such removal and underground installation shall be accomplished, and affected property owners shall be ready to receive underground service, on or before December 1, 1997.11 Section 6. Section 9 of Resolution No. 95 -4 is hereby amended to read as follows: "The City Council hereby determines that the City and public utilities have agreed to pay the costs of conversion excluding costs of users' connections to the underground electric or communication facilities." Section 7: Section 12 of Resolution No. 95 -4 is hereby amended to read as follows: "This Resolution shall become effective on October 17, 1995."
