A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
RANCHO PALOS VERDES VACATING A PORTION OF
THE PASEO DEL MAR STREET RIGHT -OF -WAY
THE CITY COUNCIL OF THE CITY OF RANCHO PALOS VERDES,
CALIFORNIA, HEREBY RESOLVES, FINDS AND DETERMINES AS FOLLOWS:
Section 1: In 1995, the developer of the Ocean Trails project ( "the
Applicant ") filed a written request with the City of Rancho Palos Verdes ( "City ") seeking
vacation of a portion of the Paseo Del Mar street right -of -way to enable construction of
the Ocean Trails project.
Section 2: The legal description of the property which is the subject of
the Applicant's request is set forth in Exhibit "A" and depicted on Exhibit "B" which are
attached hereto and incorporated herein by this reference.
Section 3: Pursuant to the provisions of Division 9, Part 3 of the Streets
and Highways Code of the State of California and the City's procedures for vacation of
City rights -of -way and easements, as established in City Council Resolution No. 90 -93,
the City Council adopted a Resolution of Intention to order the vacation of the subject
right -of -way, as described in Exhibits "A" and "B" hereto, on September 17, 1996.
Section 4: On July 25, 1996, the Planning Commission considered the
proposed vacation and found the proposed vacation of the subject right -of -way, as
described in Exhibits "A" and "B ", to be consistent with the City's General Plan.
Likewise, on June 28, 1996, the City's Traffic Committee considered and recommended
approval of the proposed request.
Section 5: The City Council held a duly noticed public hearing on the
matter on October 15, 1996.
Section 6: Pursuant to Section 892 of the Streets and Highways Code
of the State of California, the City Council hereby finds and determines that the excess
right -of -way proposed to be vacated, as described in Exhibits "A" and "B" hereto, is not
useful as a non - motorized transportation facility.
Section 7: The City Council further hereby determines that the street
right -of -way, as described in Exhibits "A" and "B" hereto, which is proposed to be
vacated constitutes an excess right -of -way that is not required for public street or
highway purposes and is not necessary for present or prospective public use.
Section 8: The excess street right -of -way described in Exhibits "A" and
"B" hereto is hereby vacated under the authority of the provisions of Division 9, Part 3
of the Streets and Highways Code of the State of California.
Section 9: Said vacation shall not become effective for any purpose,
and this Resolution shall not be recorded, unless and until the Applicant satisfies the
following conditions:
1. The Applicant shall convey an easement to the Palos Verdes Peninsula Unified
School District to guarantee access to La Rotunda Drive, a public street, from a
parcel of property which is owned by the School District and is near to the
portion of Paseo Del Mar which is proposed to be vacated. Said parcel is being
leased by the School District to the Applicant and is to be incorporated into the
golf course which is to be developed as part of the Ocean Trails project. Prior to
the recordation of this Resolution, said easement shall be recorded, and a copy
of the recorded document shall be delivered to City to be attached as Exhibit "C"
to this Resolution.
2. All of the utility facilities which will be affected by the vacation of the street right -
of -way must be relocated by the Applicant to a location which is acceptable to
the affected utility and the City's Director of Public Works.
If these conditions are not satisfied within one year from the date of adoption of this
Resolution, this Resolution shall be null and void unless, prior to October 15, 1997, the
City Council extends the deadline for compliance.
Section 10: Subject to the Applicant's compliance with the conditions set
forth in Section 9 of this Resolution, and upon the authorization of the Director of Public
Works, the City Clerk is directed to cause a certified copy of this Resolution, attested
by the City Clerk under seal, to be recorded in the Office of the Recorder of the County
of Los Angeles. From and after the date that this Resolution is recorded with the Los
Angeles County Recorder, the excess right -of -way described in Section 2 above, and
subject to the exceptions set forth therein, shall not constitute a public street, highway
or public service easement of the City of Rancho Palos Verdes.

That portion of Parcels 99 to 102 inclusive, in the City of Rancho Palos Verdes, County of Los
Angeles, State of California, as shown on County Assessor's Map No. 51, filed in Book 1, Page 1,
of Assessor's Maps, in the Office of the County Recorder of said county which lies within the
following described boundary:
Beginning at the southerly terminus of that certain 560.00 foot radius curve in the northeasterly
boundary of Pawn del Mar as shown on map of Tract No, 30583 on file in Book 813, pages 32, 33
and 34, of Maps. Records of said county; Thence northerly along said certain curve though a central
angle of 10° 30' 15" a distance of 102.67 feet, Thence tangent to said certain curve and along said
northeasterly boundary N 18° 41' 26" W 302.75 feet to the southerly boundary of Tract No. 31530
as per map filed in Book 852 Pages 73 an '74, of said maps; Thence along the westerly prolongation
of said southerly boundary S 71' 18' 34" W 40.00 feet to a point in the centerline of Paseo del Mar
as said centerline is shown on said map of said Tract 30583; Thence along said centerline N 18° 41'
26" W 46.07 feet to the southerly terminus of that certain 2000.00 foot radius curve in said
centerline; Thence northwesterly along said curve through a central angle of 15° 54' 00" a distance
of 555.02 feet to a point in a non - tangent curve concave northeasterly and having a radius of 40.00
feet, a radial of said 40.00 foot radius curve to said point bears S 20° 36' 47" E; Thence westerly,
northwesterly, and northerly along said curve through a central angle of 190° 45' 53" a distance of
133.18 feet; Thence tangent to said curve N 80° 09' 06" E 13.97 feet to a point in that certain 13.00
