RESOLUTION NO. 98 -18
A RESOLUTION OF THE CITY OF RANCHO PALOS VERDES
AMENDING RESOLUTION NO. 96-97 AND REPEALING RESOLUTION
NO. 97 -83 REGARDING THE VACATION OF PORTION OF PASEO
DEL MAR TO ALLOW AN ADDITIONAL SIX MONTHS FOR THE
APPLICANT TO COMPLETE THAT NECESSARY ITEMS OF WORK
WHEREAS, on October 15, 1996, the City Council adopted Resolution No. 96 -97
vacating a portion of the Paseo del Mar street right -of -way at the request of the developer
of the Ocean Trails project in order to accommodate the golf course that was proposed as
part of the project; and
WHEREAS, Resolution No. 96 -97 states that the developer must comply with two
conditions of approval by October 15, 1997. These conditions required the developer to:
1) convey an easement to the Palos Verdes Peninsula Unified School District to guarantee
access to La Rotonda Drive from a parcel of property owned by the School District; and,
2) relocate all of the utility facilities affected by the vacation to a new location that is
acceptable to the affected utility and the City's Director of Public Works; and,
WHEREAS, on October 7,1997, the City Council adopted Resolution No. 97 -83,
thereby granting the developer's request to extend the date for compliance with the
conditions of approval until April 15, 1998; and
WHEREAS, on December 5, 1997, the necessary easements to guarantee access
from La Rotunda Drive to the parcel of land owned by the Palos Verdes Peninsula Unified
School District were recorded with the Los Angeles County Recorders Office, thereby
satisfying the first conditions stipulated in Section 9 of Resolution No. 96 -97; and
WHEREAS, on March 3, 1998, the developer submitted a letter requesting that the
City Council grant a second extension to the deadline for compliance for the remaining
condition of approval for an additional six months, until October 15, 1998.

NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF RANCHO PALOS
VERDES DOES HEREBY FIND, DETERMINE AND RESOLVE, AS FOLLOWS:
Section 1: The grading permit for the Ocean Trails project was issued by the
City on January 9, 1998. Due to the heavy rains that occurred in February 1998, the
relocation of the existing utilities within the Paseo del Mar street - right -of -way, has been
delayed and will not be completed by April 15, 1998. However, the developer has
satisfied one of the two conditions of approval of Resolution No. 96 -97 and has made
significant progress towards relocating the utilities, although this effort has been
delayed by inclement weather.
Section 2: Section 9 of Resolution No. 86 -97 is hereby amended to read as
follows:
Said vacation not become effective for any purpose, and this Resolution shall not
be recorded, unless and until the Applicant satisfies the following condition:
1. All of the utility facilities which will be affected by the vacation of the street right-
of -way must be relocated by the Applicant to a location which is acceptable to
the affected utility and the City's Director of Public Works.
If this condition is not satisfied by October 15, 1998, this Resolution shall be null and
void, unless the City Council receives a request to extend the deadline for compliance
prior to October 15, 1998.
Section 3: Resolution No. 97 -83 is hereby repealed in its entirely.
