CC RES 1999-049 RESOLUTION NO. 99-49 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF RANCHO PALOS VERDES ORDERING THE ESTABLISHMENT OF SPECIAL ASSESSMENTS ON THE REAL PROPERTY TAX BILL FOR THE COLLECTION OF UNPAID FALSE ALARM CHARGES AND THE PLACEMENT OF LIENS ON REAL PROPERTY WHEREAS, Rancho Palos Verdes Municipal Code Section 9.04.050 defines false burglar alarm incidents as a public nuisance and establishes fees associated with such incidents; and WHEREAS, Rancho Palos Verdes Municipal Code Section 9.04.050 provides for the collection of delinquent fees through the use of a Special Assessment against the parcel on which the alarm system was located and the establishment of a lien on the property for the amount of the delinquent fees; and WHEREAS, the City has duly notified the affected property owners in accordance with said Municipal Code Section; NOW, THEREFORE BE IT RESOLVED THAT THE CITY COUNCIL OF THE CITY OF RANCHO PALOS VERDES DOES HEREBY FIND, DETERMINE AND ORDER AS FOLLOWS: Section 1. On June 15, 1999 the City Council conducted a duly noticed public hearing at which time the City Council considered the following: the report of the Director of Finance, any objections or protests which were raised at the hearing by any of the property owners who are to be assessed, and any objections or protests raised at the hearing by any other interested persons. Section 2. The Director's Report and the unpaid assessments described therein are hereby confirmed by the City Council as submitted, and shall constitute special assessments against the respective parcels of land and shall be liens on the respective properties for said amounts if payment is not made by the property owners within five business days, or by 5:30 p.m. on June 22, 1999. Section 3. The City Clerk upon direction from the City Manager, shall record in the Office of Los Angeles County Recorder certified Notices of Lien, for the total amounts due, as set forth on Exhibit "A", together with the legal descriptions of the affected properties. Section 4. The notice of lien shall be filed with the Office of Los Angeles County Auditor/Controller and said amounts shall be collected at the same time, and in the same manner as are the county property taxes and shall be subject to the same penalties and to the same procedure under foreclosure and sale in case of delinquency as provided for County property taxes.
