CC RES 2000-040 RESOLUTION NO. 2000-40 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF RANCHO PALOS VERDES APPROVING REVISIONS TO GRADING PERMIT NO. 1541 IN CONNECTION WITH REVISION "L" TO THE OCEAN TRAILS PROJECT(VESTING TENTATIVE TRACT MAP NOS.50666 AND 50667, TENTATIVE PARCEL MAP NOS.20970 AND 23004 AND CONDITIONAL USE PERMIT NOS. 162 AND 163), LOCATED IN COASTAL SUBREGIONS 7 AND 8. WHEREAS,an application package was filed by the Zuckerman Building Company and Palos Verdes Land Holdings Company requesting approval of tentative parcel maps, vesting tentative tract maps, conditional use permits, a coastal permit and a grading permit to allow the construction of a Residential Planned Development of 120 single family dwelling units and for development of an 18-hole golf course, a clubhouse and parking facilities on a 258 acre site bounded by Palos Verdes Drive South on the north, Portuguese Bend Club and Community Association on the west, the Pacific Ocean on the south and Los Angeles County Shoreline Park on the east; and, WHEREAS, a Draft Environmental Impact Report(DEIR)was prepared and circulated for 45 days from June 7, 1991 through July 22, 1991 in order to receive written comments on the adequacy of the document from responsible agencies and the public; and, WHEREAS,subsequent to the circulation of the Draft Environmental Impact Report and preparation of written responses, the applicant revised the scope of the project and reduced the number of proposed single family residences to 40 units in Vesting Tentative Tract Map No. 50666 and 43 in Vesting Tentative Tract Map No. 50667,and an 18 hole golf course with related facilities within the boundaries of both Vesting Tentative Tract Maps,and,due to the changes in the project,an Addendum to the Draft Environmental Impact Report(ADEIR)was prepared;and, WHEREAS, based on review of the Addendum to the Draft Environmental Impact Report,the City determined that the information submitted in the AEIR cited potential additional significant environmental impacts that would be caused by the revised project, and directed preparation of a Supplemental Environmental Impact Report(SEIR). The SEIR,which incorporates information and findings set forth in the Addendum to the Draft Environmental Impact Report,was prepared and circulated for 45 days from March 19, 1992 through May 4, 1992,during which time all interested parties were notified of the circulation period and invited to present written comments to the information contained in the SEIR, in conformance with the requirements of the California Environmental Quality Act; and, WHEREAS,on June 1, 1992,the City Council of the City of Rancho Palos Verdes adopted Resolution No. 92-53, certifying Environmental Impact Report No. 36 and adopted Resolution Nos.92-54,92-55, 92-56 and 92-57, respectively approving Vesting Tentative Tract Map Nos.50666 and 50667,Tentative Parcel Map Nos.20970 and 23004,Conditional Use Permit Nos. 162 and 163,Coastal Permit No. 103 and Grading Permit No. 1541 for a Residential Planned Development consisting of a total of eighty-three(83)single family dwelling units, an 18 hole public golf course and public open space on 261.4 acres in Coastal Subregion Nos. 7 and 8; and, WHEREAS, on August 12, 1992, after finding that an appeal of the City's approval of the project raised substantial issue, the California Coastal Commission denied Coastal Permit No. 103, directed the landowners to redesign the project to address the concerns raised by the Coastal Commission Staff and remanded the project back to the City of Rancho Palos Verdes for reconsideration; and, WHEREAS, on December 7, 1992, the City Council of the City of Rancho Palos Verdes adopted Resolution No. 92-115 approving the Addendum to Environmental Impact Report No. 36 and adopted Resolution Nos.92-116,92-117,92-118 and 92-119 approving Revisions to Vesting Tentative Tract Map Nos. 50666 and 50667,Tentative Parcel Map Nos.20970 and 23004, Conditional Use Permit Nos. 162 and 163, Coastal Permit No. 103, and Grading Permit No. 1541 in order to address concerns raised by the Coastal Commission with regard to adequate provisions for public open space, public access and habitat preservation; and, WHEREAS, on April 15, 1993, the California Coastal Commission approved Coastal Development Permit No.A-5-RPV-93-5(i.e. Coastal Permit No. 103), subject to additional conditions of approval; and, WHEREAS, on October 5, 1993, the City Council of the City of Rancho Palos Verdes adopted Resolution No. 93-89 approving a second Addendum to Environmental Impact Report No. 36 and adopted Resolution Nos. 93-90, 93-91, 93-92 and 93-93 respectively re-approving Vesting Tentative Tract Map Nos. 50666 and 50667, Tentative Parcel Map Nos.20970 and 23004, Conditional Use Permit Nos. 162 and 163, and Grading Permit No. 1541 in order to comply with a Court mandate to provide affordable housing in conjunction with the project, pursuant to Government Code Section 65590; and, WHEREAS,on November 5, 1993,the California Coastal Commission adopted revised and expanded findings in conjunction with the project; and, WHEREAS, on September 6, 1994, the City Council of the City of Rancho Palos Verdes adopted Resolution No. 94-71 approving a third Addendum to Environmental Impact Report No. 36 and Adopted Resolution Nos. 94-72, 94-73, 94-74, 94-75, 94-76 and 94-77, respectively, approving Revision "A" to the approved Ocean Trails project, including, but not limited to, relocation of the golf course clubhouse from the area southwest of the School District property to an area north of Half Way Point, locating the golf course maintenance facility and four(4)affordable housing units southeast of the corner of Palos Verdes Drive South and Paseo Del Mar, reducing the number of single family residential lots from eighty-three(83)to seventy-five (75)and increasing the height of the golf course clubhouse from thirty(30)feet to forty-eight(48)feet; and, WHEREAS,on January 12, 1995,the California Coastal Commission approved Coastal Development Permit No. A-5-RPV-93-005A (i.e. Coastal Permit No. 103), thereby approving its first amendment to the permit, subject to revised conditions of approval; and, WHEREAS, on September 27, 1995, the California Coastal Commission approved Coastal Development Permit No. A-5-RPV-93-005A (i.e. Coastal Permit No. 103), thereby approving its second amendment to the permit; and, WHEREAS,on February 1, 1996,the California Coastal Commission approved Coastal Development Permit No. A-5-RPV-93-005A (i.e. Coastal Permit No. 103), thereby approving its third amendment to the permit; and, WHEREAS, on March 11, 1996, the City Council of the City of Rancho Palos Verdes adopted Resolution No. 96-15 approving a fourth Addendum to Environmental Impact Report No. 36 and Adopted Resolution Nos.96-16, and 96-17, respectively,approving Revision "B"to the approved Ocean Trails project, including, but not limited to, modifying the approved alignment of Paseo Del Mar("A"Street/"J" Bluff Road), revising the Conditions of Approval regarding several public trails, and relocating the golf course clubhouse approximately 80 feet to the west of its previously approved location; and, WHEREAS, on September 3, 1996, the City Council of the City of Rancho Palos Verdes adopted Resolution No. 96-72 approving a fifth Addendum to Environmental Impact Report No. 36 and Adopted Resolution Nos. 96-73, 96-74, 96-75, 96-76 and 96-77, respectively,approving Revision "C"to the approved Ocean Trails project, including, but not limited to, relocation of two single family residential lots in Vesting Tentative Tract Map No. 50667 from the end of Street"A"to the end of Street"C", revisions to the boundaries of open space Lots B, C, G and H, conversion the split-level lots in Vesting Tentative Tract Map No. 50667 to single-level lots, revisions to the golf course layout, revisions the public trail system, combination of parallel trails easements, construction of a paved fire access road west of the Ocean Terraces Condominiums and Resolution No. 2000-40 Page 2 of 6 amendments to several Conditions of Approval and Mitigation Measures to modify the required timing for compliance; and, WHEREAS, on September 9, 1997, the Planning Commission of the City of Rancho Palos Verdes adopted P.C. Resolution No. 97-44 approving Revision "D" to the Ocean Trails project, which involved an amendment to Conditional Use Permit No. 162(Residential Planned Development)to modify the minimum rear yard setbacks on Lot Nos. 6 through 9 to provide an adequate buffer between the proposed residences and the potential brush fires that may occur on the adjacent habitat area; and, WHEREAS, on April 21, 1998, the City Council of the City of Rancho Palos Verdes adopted Resolution No. 98-32 approving Revision "E"to the Ocean Trails project,which involved an amendment to Conditional Use Permit No. 163 (Golf Course) to modify the bonding requirements for the golf course improvements;and, WHEREAS, on June 16, 1998, the City Council of the City of Rancho Palos Verdes adopted Resolution No. 98-59, approving Revision "F" to the Ocean Trails project, which involved, modifying the configuration of Streets"C"and "D"and Lot Nos. 1 through 13 of Vesting Tentative Tract Map No.50667 to accommodate the final location of the Foundation Setback Line,and a revision to Conditional Use Permit No. 162 (Residential Planned Development)to address maximum building height; and, WHEREAS,on July 14, 1998,the Planning Commission adopted P.C. Resolution Nos.98-26 and 98- 27,thereby recommending approval of Addendum No. 6 to EIR No. 36 and Revision "G"to Conditional Use Permit No. 163 to the City Council; and, WHEREAS, on August 18, 1998, the City Council of the City of Rancho Palos Verdes adopted Resolution No. 98-76 approving Addendum No. 6 to Environmental Impact Report No. 36 and the proposed Revision"G"to the Ocean Trails project,which included: 1)an 18%increase in the size of the clubhouse from 27,000 square feet to 32,927 square feet; 2)an increase in the size of the maintenance facility from 6,000 . square feet to 9,504 square feet; 3) a two foot increase in the upslope height of the maintenance facility building;and,4)relocation of the maintenance building and reconfiguration of the maintenance facility parking lot. WHEREAS, on February 2, 1999, the City Council of the City of Rancho Palos Verdes adopted Resolution No. 99-10 approving Addendum No. 7 to Environmental Impact Report No. 36 and the proposed Revision"H"to the Ocean Trails project,which included:changing 6 of the residential lots within VTTM 50667 from flat pad lots to split level lots, lowering the overall pad elevation for each lot,and lowering Street'B'within the subdivision, and lowering the pad elevation for 6 other lots within the subdivision. Additionally, the approval included the modification of the project's mitigation measures and conditions of approval to allow the permitted construction hours for the entire Ocean Trails project to be expanded to include Sundays through March 21, 1999 WHEREAS,on May 4, 1999,the City Council of the City of Rancho Palos Verdes adopted Resolution No. 99-29 approving Addendum No. 8 to Environmental Impact Report No. 35 and the proposed Revision"I" to the Ocean Trails project, which included a change to the design of the storm drain facilities of the Ocean Trails project from a tunneled pipe system to the existing on-site canyons. Revision "I" only amended the drainage for the east side of the Ocean Trails project, involving La Rotonda canyon; and, WHEREAS, on June 2, 1999, Landslide C at the Ocean Trails site was re-activated; and, WHEREAS,on July 20, 1999,the City Council of the City of Rancho Palos Verdes adopted Resolution No.99-55 approving Addendum No.9 to Environmental Impact Report No. 36 and the proposed Revision"J" to the Ocean Trails project, which included 1),the conditions requiring the establishment of a maintenance district be revised by eliminating the maintenance district and having the golf course owner be the sole Resolution No.2000-40 Page 3 of 6 responsible entity for maintenance thereby excluding the future residential homeowners; 2) withdrawn by applicant; 3),the timing of the installation of ornamental fencing on each residential lot be delayed until prior to issuance of certificate of occupancy;4), delay the construction of two trails within VTTM 50666 from the Second Stage to the Third Stage of phasing within the Public Amenities Plan; 5), lower the approved residential building pad elevations and create split-level pads in VTTM No. 50666; 6), delay the payment of traffic impact fees to prior to Final Map No. 50666;7), allow an increase in total building area of the clubhouse by permitting a basement space;8),withdrawn by applicant;and 9), revise the hours permitted for golf course landscape gardening; and, WHEREAS, on May 16, 2000, the City Council of the City of Rancho Palos Verdes adopted Resolution No. 2000-27 approving Addendum No. 10 to Environmental Impact Report No. 36 and the proposed Revision"K"to the Ocean Trails project,which allowed a portion of the golf course to open for play before all of the required public amenities have been completed due to delays caused by the failure of Landslide C on June 2, 1999; and, WHEREAS, on March 17,2000, Ocean Trails, L.P.,formally submitted their request for approval of Revision "L"to the Ocean Trails project, to allow the repair of Landslide C; and, WHEREAS, on March 2, 2000, the City of Rancho Palos Verdes distributed a Notice of Preparation (NOP)of a Draft Supplemental EIR(DSEIR)for the proposed repair of Landslide C at Ocean Trails. The NOP included a supporting Initial Study. The NOP was released for a mandatory 30-day review period (March 2, 2000 to April 3, 2000). The City received twelve written responses to the NOP. The comments were incorporated into the preparation of the DSEIR. The DSEIR was circulated for a 45-day review period from April 21, 2000 to June 5, 2000. During the circulation period,the City received 16 comments on the DSEIR. As required by the California Environmental Quality Act(CEQA),the City prepared and distributed responses to those comments at least 10 days prior to the public hearing scheduled for June 21, 2000. The"Response to Comments Report"has been incorporated into the Final Supplemental EIR(FSEIR); and, WHEREAS, on June 15, 2000, copies of the FSEIR were distributed to the City Council and prior to taking action on the proposed Revision "L" to the Ocean Trails project, the City Council independently reviewed and considered the information and findings contained in the FSEIR to EIR No. 36; and, WHEREAS, on June 21, 2000, after notice issued pursuant to the provisions of the Development Code,the City Council held a public hearing to consider the FSEIR to EIR No. 36 and the proposed Revision "L"to the Ocean Trails project, at which time all interested parties were given an opportunity to be heard and present evidence. NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF RANCHO PALOS VERDES DOES HEREBY FIND, DETERMINE,AND RESOLVE AS FOLLOWS: Section 1: This application would permit a revision (Revision "L") to Grading Permit No. 1541, allowing the repair of Landslide C,which was reactivated on June 2, 1999. Section 2: In considering the proposed revision to the project, the City Council has determined that the Final EIR("FEIR")for the proposed project is now comprised of certified FEIR No. 36,the Final Supplemental EIR(FSEIR), including any revisions thereto and appendices;the list of persons, organizations and public agencies which commented on certified FEIR No. 36 and the FSEIR; the comments which were received by the City regarding FEIR No. 36 and the FSEIR. Further, the City Council finds, pursuant to CEQA Guidelines Section 15084(e), that certified FSEIR No. 27 has been independently reviewed and analyzed by the City and its Staff, and that said document represents the independent judgment of the City as lead agency with respect to the Project. Resolution No. 2000-40 Page 4 of 6 Additionally,with respect to the potential significant environmental effects identified in the FSEIR to FEIR No. 36,the City Council finds as follows: 1. The FSEIR identifies potential significant environmental impacts related to geology, air quality, biological resources, hazards and aesthetics. However, as noted in the FSEIR, these can be mitigated to below a level of significance. The specific mitigation measures are found within the attached Mitigation Monitoring Program for the FSEIR(Exhibit A). 2. The FSEIR indicates that short-term noise impacts related to construction outside of the permissible construction hours are significant and adverse. As such, a Statement of Overriding Considerations has been adopted. FSEIR indicates that the proposed project is anticipated to contribute to a significant adverse cumulative impact related to short term air quality. As such, a Statement of Overriding Considerations has been adopted. Section 3: Pursuant to Section 17.50.070 of the Development Code,the City Council, in approving the revisions to Grading Permit No. 1541,finds as follows: A. That the grading associated with the project is not excessive beyond that necessary for the permitted primary use of the property, since the grading is associated with repairing Landslide C, which was reactivated on June 2, 1999, and such grading will restore the approved permitted uses for the site. B. That the grading and/or construction does not significantly adversely effect the visual relationships with, nor the views from neighboring sites,since the finished grading will be approximately the same as the finished grading previously approved for the proposed Ocean Trails site,which was determined not to have an adverse effect on the visual relationships, nor the views from neighboring sites. C. That the nature of the grading minimizes disturbance to the natural contours, and finished contours are reasonably natural, since the proposed topography will be similar to the approved finished topography for the site. D. That a revision to Grading Permit No. 1541,Condition C-4,to extend the allowable construction hours for the Landslide Repair project, is warranted because the proposed repair project is temporary (approximate 6 month construction period), and the expanded hours are requested in order to speed up the construction process to prepare for the upcoming winter rains and protect the site from further damage. E. That a revision to Grading Permit No. 1541, Condition C-6,to permit the use of a rock crusher on site, is warranted because it is anticipated that a large percentage of the material that will be excavated will be composed of rock in excess of 6" in diameter. During the construction process, the material that is excavated and stockpiled will eventually be needed as fill. The specifications for the needed fill dictate that it be from material that is less than 6"in diameter. Subsequently, if a rock crusher was not utilized,there would be significant amount of truck traffic/trips related to the exporting of rocks and the importing of new soil. Additionally, since the rock crusher will be utilized on an average of only four hours a day with a maximum of six, and the distance to the nearest residential area is significant there would be no significant adverse noise or vibration impacts from the rock crusher. Section 4: The mitigation measures contained in the Mitigation Monitoring Program attached as Exhibit"A"to Resolution No. 2000-38 are hereby incorporated by reference into the Conditions of Approval for the revisions to Grading Permit No. 1541. Resolution No.2000-40 Page 5 of 6 Section 5 For the forgoing reasons, and based on information and findings contained in the public record, including Staff Reports, Minutes, records of proceedings, and evidence presented at the public hearings,the City Council of the City of Rancho Palos Verdes hereby approves revisions to Grading Permit No. 1541, amending Conditions C-4 and C-6, as shown in the attached Exhibit"A", which is necessary to protect the health, safety and general welfare. All other conditions of approval that have been imposed on this project shall remain in effect and incorporated herein. PASSED,APPROVED, and ADOPTED this 21st day of June 2000. INTRODUCTION PURPOSE This Mitigation Monitoring Program (MMP), which is for the Repair of Landslide C at the Ocean Trails Golf Course, in the City of Rancho Palos Verdes, responds to Section 21081.6 of the Public Resources Code. Section 21081.6, which requires a lead or responsible agency that approves or carries out a project where a Supplemental Environmental Impact Report has identified significant environmental effects, to adopt a "reporting or monitoring program for adopted or required changes to mitigate or avoid significant environmental effects." The City of Rancho Palos Verdes is acting as lead agency for the project. An Initial Study and Supplemental Environmental Impact Report was prepared to address the potential environmental impacts of the project. Where appropriate, this environmental document recommended mitigation measures to mitigate or avoid impacts identified. Consistent with Section 21080 (2)(c) of the Public Resources Code, a mitigation reporting or monitoring program is required to ensure that the adopted mitigation measures under the jurisdiction of the City are implemented. The City will adopt this MMP when adopting the Supplemental Environmental Impact Report. ENVIRONMENTAL PROCEDURES This MMP has been prepared in accordance with the California Environmental Quality Act of 1970 (CEQA), as amended (Public Resources Code Section 21000 et seq.) and the State Guidelines for Implementation of CEQA (CEQA Guidelines), as amended (California Administrative Code Section 15000 et seq.). This MMP complies with the rules, regulations, and procedures adopted by the City of Rancho Palos Verdes for implementation of CEQA. MITIGATION MONITORING PROGRAM REQUIREMENTS Section 21081.6 of the Public Resources Code states: "When making the findings required by subdivision (a) of Section 21081 or when adopting a negative declaration pursuant to paragraph (2) of subdivision (c) of Section 21081, the public agency shall adopt a reporting or monitoring program for the changes to the project which it has adopted or made a condition of project approval in order to mitigate or avoid significant effects on the environment. The reporting or monitoring program shall be designed to ensure compliance during project implementation. For those changes which have been required or incorporated into the project at the request of an agency having jurisdiction by law over natural resources affected by the project, that agency shall, if so requested by the lead or responsible agency, prepare and submit a proposed reporting or monitoring program." Exhibit A - Page 2 I1. MANAGEMENT OF THE MITIGATION MONITORING PROGRAM ROLES AND RESPONSIBILITIES The MMP for the project will be in place through all phases of the project including final design, pre - grading, construction, and operation. The City will have the primary enforcement role for the mitigation measures. MITIGATION MONITORING PROGRAM PROCEDURES The mitigation monitoring procedures for this MMP consists of, filing requirements, and compliance verification. The Mitigation Monitoring Checklist and procedures for its use are outlined below. Mitigation Monitoring Program Checklist The MMP Checklist provides a comprehensive list of the required mitigation measures. In addition, the Mitigation Monitoring Checklist includes: the implementing action when the mitigation measure will occur; the method of verification of compliance; the timing of verification; the department or agency responsible for implementing the mitigation measures; and compliance verification. Section III provides the MMP Checklist. Mitigation Monitoring Program Files Files shall be established to document and retain the records of this MMP. The files shall be established, organized, and retained by the City of Rancho Palos Verdes department of Planning, Building, and Code Enforcement. Compliance Verification The MMP Checklist shall be signed when compliance of the mitigation measure is met according to the City of Rancho Palos Verdes Director of Planning, Building, and Code Enforcement. The compliance verification section of the MMP Checklist shall be signed, for mitigation measures requiring ongoing monitoring, and when the monitoring of a mitigation measure is completed. MITIGATION MONITORING OPERATIONS The following steps shall be followed for implementation, monitoring, and verification of each mitigation measure: 1. The City of Rancho Palos Verdes, Director of Planning, Building, and Code Enforcement shall designate a party responsible for monitoring of the mitigation measures. 2. The City of Rancho Palos Verdes, Director of Planning, Building, and Code Enforcement shall provide to the party responsible for the monitoring of a given mitigation measure, a copy of the MMP Checklist indicating the mitigation measures for which the person is responsible and other pertinent information. 3. The party responsible for monitoring shall then verify compliance and sign the Monitoring Milestone column of the MMP Checklist for the appropriate mitigation measures. Mitigation measures shall be implemented as specified by the MMP Checklist. During any project phase; Exhibit A - Page 3 unanticipated circumstances may arise requiring the refinement or addition of mitigation measures. The City of Rancho Palos Verdes, Director of Planning, Building, and Code Enforcement with advice from Staff or another City department, is responsible for recommending changes to the mitigation measures, if needed. If mitigation measures are refined, the Director of Planning, Building, and Code Enforcement would document the change and shall notify the appropriate design, construction, or operations personnel about refined requirements. MITIGATION MONITORING PROGRAM CHECKLIST INTRODUCTION This section provides the MMP Checklist for the project as approved by the City Council of the City of Rancho Palos Verdes on June 21, 2000. Mitigation measures are listed in the order in which they appear in the Initial Study. * Monitoring and Reporting Action indicates when the measure should be monitored and reported. Party. Responsible for Mitigation indicates who is responsible for implementation. Enforcement Agency /Monitoring Agency /Monitoring Milestone indicates what agency is responsible for enforcing the measure, and provides space for future reference and notation that compliance has been monitored, verified, and is consistent with these mitigation measures. C-6 With the exception of using a rock crusher for the Landslide C repair during normal construction hours of 7am to 7pm Monday through Friday and 7am to 5pm on Saturday,the use of a rock crusher on the site is prohibited. If it is determined by the Director of Planning, Building and Code Enforcement that the use of a rock crusher related to the Landslide Repair is causing an adverse impact to the public,then the Director of Planning, Building and Code Enforcement can require the developer to provide methods to reduce these impacts or can restrict the hours in which the rock crusher may be used to be more restrictive than the normal construction hours noted in the first sentence.
