A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
RANCHO PALOS VERDES CONFIRMING THE
AUTHORITY OF THE CITY MANAGER TO FILE A CLAIM
FOR DAMAGE, INJURY OR DEATH WITH THE UNITED
STATES OF AMERICA ON BEHALF OF THE CITY OF
RANCHO PALOS VERDES
WHEREAS, the City of Rancho Palos Verdes (hereinafter the "City")
operates the Point Vicente Interpretive Center generally located at 31501 Palos Verdes
Drive West in the City (hereinafter the "Site"); and
WHEREAS, the City discovered contaminants in the soil at the Site during
construction activities conducted in August of 1999; and
WHEREAS, the Department of Defense, through the Department of the
Army, previously operated a coastal battery and, later, Nike Battery 55 at the Site;
WHEREAS, as part of such operations, the Department of Defense
operated a small arms range at the Site which was later abandoned without
remediation; and
WHEREAS, the contaminants discovered at the Site consist of lead and
other potentially hazardous substances attributable to bullets and other weaponry
associated with the operation of the small arms range; and
WHEREAS, the City Council previously authorized and directed the City
Manager to file a Claim for Damage, Injury and Death with the U.S. Army Claims
Service on behalf of the City; and
WHEREAS, the City Manager did file such a Claim for Damage, Injury, or
Death with the U.S. Army Claims Service on or about January 31, 2000; and
WHEREAS, the U.S. Army Claims Service requires written evidence of
the authority of the City Manager to file a Claim for Damage, Injury or Death on behalf of
the City;
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF RANCHO
PALOS VERDES DOES HEREBY FIND, ORDER AND RESOLVE AS FOLLOWS:
Section 1. The City Manager, Les Evans, is, was, and continues to be
authorized to file a Claim for Damage, Injury or Death on behalf of the City of Rancho
Palos Verdes with the appropriate department(s) of the United States of America.

Section 2. The City Manager is further authorized to take any additional
actions necessary to ensure that the Claim for Damage, Injury or Death filed on behalf
of the City of Rancho Palos Verdes with respect to the contamination to the Site is duly
processed.
PASSED, APPROVED and ADOPTED this 21st day of June, 2000.
