CC RES 2000-028 RESOLUTION NO.2000-28 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF RANCHO PALOS VERDES APPROVING A REVISION TO THE FINAL PUBLIC AMENITIES PLAN IN CONNECTION WITH REVISION "K" TO THE OCEAN TRAILS PROJECT, A 75 LOT RESIDENTIAL PLANNED DEVELOPMENT,18-HOLE GOLF COURSE WITH RELATED FACILITIES AND PUBLIC OPEN SPACE PROJECT LOCATED IN COASTAL SUBREGIONS 7 AND 8 WHEREAS, in 1992, the City Council of the City of Rancho Palos Verdes adopted resolutions approving Vesting Tentative Tract Map Nos. 50666 and 50667,Tentative Parcel Map Nos. 20970 and 23004, Conditional Use Permit Nos. 162 and 163, Coastal Permit No. 103 and Grading Permit No. 1541 for a 75 lot Residential Planned Development, an 18-hole golf course with related facilities and public open space located in Coastal Subregions 7 and 8 of the City; and, WHEREAS, the conditions of approval for the project require that the landowner submit a "detailed,final" Public Amenities Plan for review and approval by the City prior to the issuance of grading permit for the project or recordation of the Final Map,whichever occurs first. The Conditions further require that the final Public Amenities Plan be in substantial conformance with program approved by the City in August 1994 and stipulate that the landowner is responsible for the implementation and construction of all the amenities included in the final Public Amenities Plan; and, WHEREAS, on October 15, 1996, the City Council of the City of Rancho Palos Verdes approved of a Public Amenities Plan that was consistent with the program approved in August 1994. The Final Plan segmented the construction of various public amenities into separate phases; and, WHEREAS, the City Council has approved subsequent revisions to the Ocean Trails project as memorialized by the resolutions approving such revisions, the most recent of which occurred on July 20, 1999 for Revision "J"; and, WHEREAS, on February 23,2000, Ocean Trails, L.P., submitted a letter to the City of Rancho Palos Verdes requesting approval of Revision"K"to the Ocean Trails project, to allow a portion of the golf course to open for play before all of the required public amenities have been completed due to delays caused by the failure of Landslide C on June 2, 1999; and, WHEREAS, on May 11, 2000,copies of the Addendum No. 10 to Environmental Impact Report No. 36 were distributed to the City Council and prior to taking action on the proposed Revision"K"to the Ocean Trails project,the City Council independently reviewed and considered the information and findings contained in Addendum No. 10 to EIR No. 36; and, WHEREAS, on May 16, 2000, after notice issued pursuant to the provisions of the Development Code, the City Council held a public hearing to consider draft Addendum No. 10 to Environmental Impact Report No. 36 and the proposed Revision"K"to the Ocean Trails project, at which time all interested parties were given an opportunity to be heard and present evidence. NOW,THEREFORE,THE CITY COUNCIL OF THE CITY OF RANCHO PALOS VERDES DOES HEREBY FIND, DETERMINE AND RESOLVE AS FOLLOWS: Section 1: That the document titled the"Ocean Trails Conceptual Public Amenities and Coastal Access Program, Rancho Palos Verdes Subregion No. 7"dated as received by the City on October 7, 1996 was approved as the final Public Amenities Plan for the Ocean Trails project, subject to various conditions of approval. Section 2: That this application would permit Revision "K"to the conditions of approval found within the final Public Amenities Plan (adopted through Resolution No. 96-94 and amended through Resolution No. 99-60 for revision"J"),thereby allowing a delay in the construction of the following park and trails until the repair of Landslide C is completed; Halfway Point Park(Ocean Trails Park), Halfway Point Park Pedestrian Loop Trail, Sewer Easement Pedestrian Trail, the portion of the Bluff Top Activity Corridor Combined Bicycle Path and Pedestrian Trail that traverses through Landslide C, and Half Way Point Park Beach Access Pedestrian Trail. Section 3: In considering the proposed revisions to the project, the City Council has determined that the preparation of Addendum No. 10 to Environmental Impact Report No. 36 is appropriate, since the subsequent changes in the project will not result in any new significant environmental impacts which were not previously identified and analyzed in Environmental Impact Report No. 36, that the subsequent changes will not result in an increase in any previously identified significant environmental impacts, that the Addendum does not contain new information of substantial importance to the project and that only minor technical changes or additions are necessary to make Environmental Impact Report adequate under the provisions of the California Environmental Quality Act(CEQA). This is so, since the proposed change to delay the construction of the trails and park identified in Section 2 and attached Exhibit"A"would not result in any new or increased impacts to the environment that are not already analyzed within EIR No. 36, because it merely delays the construction of the trails to a time after the completion of the repair of Landslide C where these trails and park are located. Additionally, the repair of Landslide C is a separate project that currently is the subject of a Draft Supplemental Environmental Impact Report that has been prepared and is currently under circulation Therefore, based on the review of Draft Addendum No. 10 to Environmental Impact Report No. 36 prepared in association with the proposed Revision "K"to the Ocean Trails project, as conditioned,the City Council finds that the project still mitigates, or reduces to the extent feasible, significant adverse effects to adjacent properties or the permitted uses thereof. In approving the revised project,the City Council finds that social, recreational, and other benefits of the project continue to outweigh any unavoidable adverse environmental impacts that may occur and that due to overriding benefits and considerations, any unavoidable adverse environmental impacts of the project are acceptable. Accordingly, the City Council incorporate, by reference, the Final EIR No. 36, the Supplemental EIR, Addenda Nos. 1, 2, 3, 4, 5, 6, 7, 8 and 9, and Resolution No. 92-115(which includes,without limitation,the detailed statement of overriding considerations set forth therein). Section 4: The mitigation measures contained in the Mitigation Monitoring Program attached as Exhibit"B"to Resolution No. 96-72 are hereby incorporated by reference into the Conditions of Approval for the revisions to Final Public Amenities Plan. Section 5: The time within which the judicial review of the decision reflected in this Resolution, if available, must be sought is governed by Section 1094.6 of the California Code of Civil Procedure. Section 6: For the forgoing reasons, and based on information and findings contained in the public record, including staff reports, minutes, records of proceedings, and evidence presented at the public hearings, the City Council of the City of Rancho Palos Verdes hereby approves Revision "K" to the Public Amenities Plan, allowing the delay in completion of certain trails, as shown in Section 2 and the attached Exhibit"A",which is necessary to protect the public health, safety and general welfare. All other conditions of approval that have been imposed on this project shall remain in effect and are incorporated herein. A A& _ CITY CLERK Resolution No.2000-28 Page 3 of 5 RESOLUTION NO. 2000-28 EXHIBIT"A" PUBLIC AMENDITIES PLAN -REVISION "K" CONDITIONS OF APPROVAL The following phasing plans shall be revised to read as follows: First Stage The following trail improvements, interpretive signs and trail fencing shall be installed and open for use by the public prior to commencement of play on the golf course.The subject trails shall be confined with temporary fenced corridors installed to the satisfaction of the Director of Planning, Building and Code Enforcement to prevent individuals from damaging the habitat restoration areas. With the exception of the Half Way Pont Park Beach Access Pedestrian Trail and the portion of the Bluff Top Activity Corridor Pedestrian Trail that traverses Landslide C, which are addressed below, the trails shall be improved to the standards required in the project conditions of approval (contained in Resolution Nos. 96-73 and 96-74) and depicted on the approved Trail Plan of the final Public Amenities Plan, including the installation of permanent fencing and signage, prior to the commencement of play on the golf course. Trail Improvements West Bluff Preserve Pedestrian Trail Half Way Point Park Beach Access Pedestrian Trail Bluff Top Activity Corridor Pedestrian Trail Shoreline Park Access Pedestrian Trial In regards to the Half Way Point Park Beach Access Pedestrian Trail and the portion of the Bluff Top Activity Corridor Pedestrian Trail that traverses Landslide C,the developer may delay the completion of these trails until the repair of Landslide C has been completed. In the interim, the developer may open the golf course to the public on a temporary basis until the repair of Landslide C and these trails have been completed, provided that the developer obtains approval of a Special Use Permit from the Director of Planning, Building and Code Enforcement prior to the opening of the golf course. The Special Use Permit shall address issues such as, but not limited to,traffic,geology, public safety, and the status of trails. The Special Use Permit shall allow the developer to keep the golf course open to the public on a temporary basis for the time period set forth in the Special Use Permit, or when the repair of Landslide C and these trails have been completed, whichever occurs first. Second Stage With the exception of Halfway Point Park(Ocean Trails Park), the Halfway Point Park Pedestrian Loop Trail,the Sewer Easement Pedestrian Trail, and the portion of the Bluff Top Activity Corridor Combined Bicycle Path and Pedestrian Trail that traverses Landslide C, which are addressed below, the following park and trail improvements shall commence construction immediately following rough grading operations for the golf course and shall be completed to the satisfaction of the Director of Planning, Building and Code Enforcement and the Director of Public Works prior to the opening of the golf course for play.
