A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
RANCHO PALOS VERDES DECLARING CERTAIN REAL
PROPERTY NECESSARY FOR PUBLIC PURPOSES AND
AUTHORIZING THE ACQUISITION THEREOF
WHEREAS, the City of Rancho Palos Verdes is a public body, corporate
and politic, in the County of Los Angeles, State of California; and
WHEREAS, the property hereinafter described is to be taken for a public
use, namely, for development, construction and maintenance of sewer and storm
drainage facilities and all purposes convenient and necessary thereto, and pursuant to
the authority conferred upon the City of Rancho Palos Verdes to acquire property by
eminent domain by California Constitution article I, Section 19, Government Code
sections 37350.5 and 40404, Code of Civil Procedure sections 1230.010 et seq.
(Eminent Domain Law), including but not limited to sections 1240.010, 1240.020,
1240.110, 1240.120, and other provisions of the law; and
WHEREAS, the property to be taken is located in the City of Rancho
Palos Verdes and is more particularly described on Exhibit "A" attached hereto and
which is incorporated by this reference;
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF RANCHO
PALOS VERDES DOES HEREBY FIND, DETERMINE, ORDER AND RESOLVE AS
FOLLOWS:
Section 1. The City Council finds and determines as follows:
A. A panel of experts appointed to address the movement of the
Abalone Cove Landslide recommended, among other measures, the installation of
sewer and storm drainage facilities to control the amount of water entering the landslide
mass.
B. The proposed sewer and storm drain systems are required to
decrease the amount of water entering the Abalone Cove Landslide mass, which in
turn, will reduce the amount of earth movement.
C. The projects are consistent with the City's goal of preserving
property values, forestalling soil subsidence, and protecting the public health and safety.
Section 2. The City Council further finds and determines as follows:
A. The potential environmental impacts of the proposed Projects,
including the proposed acquisitions, were studied in connection with Environmental
Impact Report SCH # 95021037, the supplement thereto, and the Environmental Impact
Report for the Alta Mira Canyon Drainage Control Project, SCH # 94021003, and the
addendum thereto. The Board of the Redevelopment Agency of the City of Rancho
Palos Verdes certified the FEIRs on and Notices of Determination thereof were duly
filed with the County Recorder. A Supplement to the Final Supplemental EIR for the
Abalone Cove Combination Sewer System Project (SCH # 95021037) was prepared
and certified by the Redevelopment Agency Board on May 4, 1999. An Addendum to
the FEIR for the Alta Mira Canyon Drainage Control Project (SCH # 94021003) dated
October 1999, was certified by Resolution. No. RDA 99-18 on October 5, 1999 by the
Redevelopment Agency's Board.
B. Therefore, all of the findings required by the California
Environmental Quality Act have been made for the proposed Projects in connection with
the FEIRs. Those findings are also the appropriate environmental findings with regard
to the proposed acquisition of the property identified on Exhibit "A" hereto. No new
information has been obtained since the Redevelopment Agency Board's last action
regarding the sewer system on May 4, 1999, or since the Agency Board's last action
regarding the storm drain project on October 5, 1999, that would require further
environmental analysis of either project.
Section 3. The City Council hereby further finds and determines for the
reasons set forth in the staff reports dated February 1, 2000 and February 15,2000,
that:
A. The public interest and necessity require the proposed sewer and
storm drain projects;
B. The proposed projects are planned and located in the manner that
will be most compatible with the greatest public good and the least private injury;
C. The acquisition of the interests in property described on Exhibit "A"
attached hereto is necessary for the proposed sewer and storm drain projects; and
D. The offers required by Section 7267.2 of the Government Code
have been made to the owners of record.
Section 4. The findings and declarations contained in this resolution are
based upon the record before the City Council on February 1, 2000 and February 15,
2000, which includes the Department of Public Work's reports, the environmental
documents referenced above, and any testimony, records, and documents produced at
the hearing, all of which are incorporated herein by this reference.

Section 5. The City of Rancho Palos Verdes hereby authorizes and
directs the law firm of Richards, Watson & Gershon to take all steps necessary to
commence and prosecute legal proceedings in a court of competent jurisdiction to
acquire by eminent domain the property described on Exhibit "A" attached hereto.
