CC RES 2005-092RESOLUTION NO. 2005 -92 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF RANCHO PALOS VERDES AUTHORIZING THE CITY MANAGER TO ACCEPT A GRANT DEED DEDICATING TO THE CITY REAL PROPERTY KNOWN AS THE " PALOS VERDES BAY CLUB STORM DRAIN EASEMENT" UNDER AND UPON THAT PROPERTY WITHIN TRACT 28905 AND DESCRIBED IN EXHIBIT "A" ATTACHED HERETO, FOR STORM DRAIN PURPOSES. WHEREAS, during intense winter storms in January and February 2005, water flowing from a City storm drain facility ( "City Storm Drain "), located in MCCarrell Canyon, overflowed the City Storm Drain, ran across Palos Verdes Drive South, down Sea Cove Drive and onto the private streets, which are owned by Club, and into a storm drain ( "Club Storm Drain "), which also is owned by Club, that conveys drainage clown the face of the bluff to the ocean; WHEREAS, the storm water was a contributing factor in the damage that was sustained by the Club Storm Drain so that a portion of it was dislodged and fell from the bluff onto the beach; WHEREAS, on Augus4 16, 2005, the City entered into an Agreement with the Palos Verdes Bay Club concerning the repair to the Club Storm Drain (Interim Improvement), so that the bluff will not sustain additional damage as a result of the absence of the displaced portion of the Club Storm Drain during the lengthy process of designing and constructing the permanent storm drain improvements (Permanent I mprolw ements); WHEREAS, Section 9 of said Agreement, stated that Club shall grant an easement to City so that City will be able to construct and maintain the Interim Improvements and the Permanent Improvements; 1. WHEREAS, Government Code Section 27281 allows the City to authorize by resolution one or more of its officers or agents to accept such dedications or grants on behalf of the City and consent to the recording of these documents; NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF RANCHO PALOS VERDES DOES RESOLVE, DETERMINE AND ORDER AS FOLLOWS: Section 1. The City Manager, the Assistant City Manager or the Director of Public Works of the City of Rancho Palos Verdes are hereby duly authorized to accept the grant deed of easement for the "Palos Verdes Bay Club Storm Drain Easement" under and upon that property within Tract No. 28905 and described in Exhibit "A" attached hereto, on behalf of the City of Rancho Palos Verdes by executing the form which is attached hereto as Exhibit "B" and incorporated herein by this reference.
