ABSENT: None
Also present was City Manager Les Evans, Deputy Planning Director Greg Pfost and
City Attorney Lynch via teleconferencing.
RECESS TO CLOSED SESSION:
The meeting was immediately adjourned to a closed session.
RECONVENE: At 8:20 A.M. the meeting reconvened.
REPORT ON CLOSED SESSION:
City Attorney Lynch reported that in closed session the Council unanimously approved
an amended agreement between the City and the Trump organization.
Representing the Trump organization was Jeff Kaplinsky who commented that the
Trump organization would have to review the amendments that Council had made to
the agreement and that he was unable to make a commitment until their attorneys had
completed their review.
Councilman Stern noted that the amended agreement is much improved over previous
versions of the agreement considered by the City Council.
Mayor Pro Tern Clark stated that the City Council's willingness to take up the issue of
the Agreement with Ocean Trails at a Special meeting on a Friday morning indicated
the Council's concern with moving ahead to complete the project.
Councilman Long stated that he had misgivings about entering into agreements with
"Potimkin" entities such as the corporation Mr. Trump had formed to own Ocean Trails.
Councilman Wolowicz felt that it was most significant that the City wanted to move
forward expeditiously, which they demonstrated through the Special Meeting and
approval of the agreement.
Councilman Stern moved seconded by Mayor Pro Tern Clark to approve as amended
the agreement between the City and Ocean Trails pertaining to the Peer Review Board.
The motion carried unanimously.
Councilman Stern asked Mr. Pfost the status of the Converse response to the Landslide
A issues raised by Cotton, Shires & Associates. Mr. Pfost stated that the City had not
yet received the response document. Mr. Kaplinski added that their engineering
company is making some minor mapping changes that will be completed by
Wednesday.
Mayor Pro Tern Clark mentioned that the City had responded to the concerns raised by
Mr. Vinnie Stellio in his May 5, 2004 letter to the City.
The meeting adjourned at 8:32 A.M. on motion of Councilman stern.
