Recommendation:
Adopt a motion to waive reading in full of all ordinances
presented at this meeting with consent of the waiver of reading deemed to be
given by all Council Members after the reading of the title.

2. Approval of the minutes. (Purcell)
Recommendation:
Approve the minutes of April 6, 2004.
3. Claim Against the City by Willdan Corporation. (Park)
Recommendation:
Reject the claim and direct staff to notify the claimant.
4. Award a Three-Year Professional Services Agreement for Source Reduction and
Recycling Element (SRRE) and Used Oil Block Grant Implementation, and
Support Services. (Ramezani)
Recommendation: (1)
Award a three year professional services agreement to
SCS Engineers, in the amount not to exceed $23,000 for FY 04-05, to provide
support services for the City’s implementation of the Source Reduction and
(2)
Recycling Element (SRRE) and Used Oil Block Grant programs, and
Authorize the Mayor and City Clerk to execute a three year agreement with SCS
Engineers, in the amount not to exceed $23,000 for FY 04-05, for
implementation of the SRRE and Used Oil Block Grant programs.
5. Commercial Refuse and Collection Agreement with Abel Roll-Off. (Ramezani)
Recommendation:
Authorize the Mayor and the City Clerk to execute a Non-
Exclusive Franchise Agreement for Commercial Refuse Collection and Disposal
Services with Abel Roll-Off to be effective through December 31, 2004.
6. Ridgecrest Rancho Recreation & Parks District: Appointment of Tom Carter.

Recommendation:
Confirm the appointment of Tom Carter to serve on the
Ridgecrest Rancho Recreation & Parks District for a term of office until
December 2, 2005.
7. Amendment to the City Manager’s Employment Agreement. (Lynch)
Recommendation:
Approve the Fifth Amendment to the City Manager’s
Employment Agreement.

ADOPT RESOL. NO. 2004- , A RESOLUTION OF THE

about the terms of an amendment to the City’s franchise agreement with Cox
Communications.

Based on the following existing facts and circumstances, the City Council is meeting to
discuss potential litigation, due to a letter dated May 5, 2004, to Mayor Gardiner from
Vincent Stellio, implying threatened litigation arising from geologic and geotechnical
review of the Ocean Trails Project and the costs arising from that review by the City's
geologic consultants.
