Adoption of Ordinance No. 460: Code Amendment (Case No. ZON2006- 00082) `Q' District Code Amendment (Fox) Recommendation: ADOPT ORDINANCE NO. 460, AN ORDINANCE OF THE CITY OF RANCHO PALOS VERDES, AMENDING CHAPTER 17.46 OF TITLE 17 OF THE CITY'S MUNICIPAL CODE (CASE NO. ZON2006- 00082) TO ESTABLISH REGULATIONS FOR THE PRESERVATION OF FUTURE HORSEKEEPING OPPORTUNITIES IN THE CITY'S EQUESTRIAN OVERLAY (Q) DISTRICTS. 5. City Manager Moving Allowance (Lehr) Recommendation: The City Manager requests that her temporary living allowance and moving allowance be considered as a lump sum allowance of $10,000 so that savings in one category can be used to make up shortfalls in another category. 6. May 2007 Treasurer's Report (McLean) Recommendation: Receive and file the May 2007 Treasurer's Report for the City of Rancho Palos Verdes. 7. Annual Appropriation Limit for FY07 -08 (McLean) Recommendation: ADOPT RESOLUTION NO. 2007 -, A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF RANCHO PALOS VERDES, ESTABLISHING THE CITY'S APPROPRIATION LIMIT FOR FY07 -08. 8. Register of Demands (McLean) Recommendation: ADOPT RESOLUTION NO. 2007- , A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF RANCHO PALOS VERDES, ALLOWING CERTAIN CLAIMS AND DEMANDS AND SPECIFYING FUNDS FROM WHICH THE SAME ARE TO BE PAID. Upper Point Vicente Civic Center Site Analysis (Lehr) Recommendation: Council to direct the City Manager to engage professional services to evaluate baseline conditions at Upper Point Vicente as a tool for master planning of the Civic Center site. The City Manager is authorized to enter into agreements that do not exceed $80,000 total, plus a $10,000 contingency. 10. Ordinance Amending the Storm Drain User Fee to Shorten the Duration of the Fee from Thirty Years to Ten Years and to Establish a Resident Oversight Committee to be Placed on the Ballot for the November 6, 2007 General Municipal Election (Lynch) Recommendation: Review the attached Ordinance and direct staff to place it on the ballot for the November 6, 2007 Election. 11. CLOSED SESSION AGENDA CHECKLIST Based on Government Code Section 54954.5 (All Statutory References are to California Government Code Sections) Conference with Legal Counsel The City Council /Agency finds, based on advice from legal counsel, that discussion in open session will prejudice the position of the local agency in the litigation: Potential Litigation: G.C. 54956.9(b) A point has been reached where, in the opinion of the City Council /Agency on the advice of its legal counsel, based on the below- described facts and circumstances, there is a significant exposure to litigation against the City Council/Agency- Concerning two threats of litigation made by Mr. Donald Trump to City Manager Carolyn Lehr during telephone conversations that occurred on June 25, 2007 and June 26, 2007, City Council Agenda July 3, 2007 Page 4 of 5 regarding trees located on the golf course at Trump National and regarding whether single family homes still can be developed on the portion of Tentative Tract Map No. 50666 where the driving range is located. A copy of the memorandum from the City Manager documenting the threat of litigation is on file in the City Clerk's Office.
