A point has been reached where, in the opinion of the City Council /Agency on the
advice of its legal counsel, based on the below- described facts and circumstances,
there is a significant exposure to litigation against the City Council/Agency-
Concerning two threats of litigation made by Mr. Donald Trump to City Manager Carolyn
Lehr during telephone conversations that occurred on June 25, 2007 and June 26,
2007, regarding trees located on the golf course at Trump National and regarding
whether single family homes still can be developed on the portion of Tentative Tract
Map No. 50666 where the driving range is located. A copy of the memorandum from
the City Manager documenting the threat of litigation is on file in the City Clerk's Office.
