Recommendation: 1) ADOPT RESOLUTION NO. 2009 -_, APPROVING
REVISION `K' TO CONDITIONAL USE PERMIT NO. 215, ET. AL. BY
AMENDING THE COUNCIL ADOPTED CONDITIONS OF APPROVAL TO
ALLOW: A) THE INSTALLATION OF ONE 35 -FOOT TALL FLAG POLE AND
TWO 30 -FOOT TALL FLAG POLES ADJACENT TO THE MAIN HOTEL
BUILDING NEAR THE MOTOR COURTYARD WITH A REVISION TO THE
EXISTING VARIANCE PERMIT TO ALLOW THE FLAG POLES TO EXCEED

THE 16 -FOOT HEIGHT LIMIT FOR FLAG POLES; B) THE DEFERMENT OF
THE CONSTRUCTION OF THE REQUIRED BUS SHELTER AT THE ENTRY
DRIVEWAY ON THE EASTBOUND LEG OF PALOS VERDES DRIVE SOUTH
TO JUNE 1, 2010; C) THE CLARIFICATION OF THE DEADLINE AND
DIRECTION ON WHETHER TO REQUIRE THE POSTING OF A SECURITY
FOR PERFORMING THE REQUIRED UNDERGROUNDING OF EXISTING
UTILITY POLES ON PALOS VERDES DRIVE SOUTH; AND, D) THE
MODIFICATION OF THE HOURS OF OPERATION FOR THE PUBLIC SNACK
SHOP AT THE LOWER POOL FACILITY; 2) Review and provide Staff with
direction on the Maintenance Agreement that requires the hotel operator to
maintain the public amenities associated with the project, including the items in
question between the City and Long Point Development LLC., and if deemed
acceptable, authorize the execution of the Maintenance Agreement; 3) Accept
the public amenities and the public easements for the related public amenities
including public trails, access areas, overlooks / vista areas, parking, park area,
and habitat areas; 4) Receive a status update on the public amenities bond; and,
5) Provide Staff with clarification as to whether the City Council intended for the
Council or the City Manager to make the three appointments to the nonprofit
Board of Directors.

REGULAR NEW BUSINESS:
(60 mins) 2. Terranea Resort — Request for Financial Assistance Using Future Transit
Occupancy Tax (TOT) Revenue
Recommendation: 1) Consider the request made by Lowe Enterprises to
provide financial assistance to the Terranea Resort; and, 2) If the Council is
inclined, direct Staff to undertake a more complete legal, economic and financial
review that may lead to a recommendation to develop a TOT loan agreement
and /or ordinance for consideration by the City Council at a future meeting.
(15 mins) 3. Establishment of a Written Policy for Use of City Owned Electronic Equipment
(McLean)
Recommendation: 1) Direct staff to develop a written policy for City -owned
electronic equipment assigned to employees and City Council members, as well
as equipment allowances paid to employees for employee -owned electronic
equipment; and, 2) If approved by the City Council, direct staff to prepare a
written user policy and a revision of the salary range Resolution to include
electronic equipment allowance to certain employees.
