CC MINS 20090106 MINUTES REGULAR MEETING RANCHO PALOS VERDES CITY COUNCIL JANUARY 6, 2009 The meeting was called to order at 6:06 P.M. by Mayor Clark at Fred Hesse Community Park, 29301 Hawthorne Boulevard, at Fred Hesse Community Park, 29301 Hawthorne Boulevard. City Council roll call was answered as follows: PRESENT: Long, Stern, Wolowicz, and Mayor Clark ABSENT: Gardiner (excused) Also present were Carolyn Lehr, City Manager; Carol Lynch, City Attorney; Carolynn Petru, Deputy City Manager; Joel Rojas, Director of Planning, Building, and Code Enforcement; and, Greg Pfost, Deputy Planning Director. Council discussed Councilman Gardiner's recent absences from the Council meetings and his current health situation. Mayor Clark and Mayor Pro Tern Wolowicz reported on recent telephone calls they had both had with Councilman Gardiner regarding his health and current medical treatment. At Mayor Pro Tem Wolowicz's suggestion, Mayor Clark indicated that he would make a follow-up phone call to Councilman Gardiner to see how he is doing and convey the Council's best wishes. APPROVAL OF AGENDA: Councilman Stern moved, seconded by Mayor Pro Tern Wolowicz, to approve the Agenda. Without objection, Mayor Clark so ordered. PUBLIC COMMENTS: None. RECESS TO CLOSED SESSION: At 6:13 P.M., the City Council recessed to Closed Session to discuss existing litigation, potential litigation, and to hold a conference with Real Property Negotiators. RECESS AND RECONVENE: Mayor Clark called a brief recess from 7:24 P.M. to 7:29 P.M. PUBLIC COMMENTS: Tim Kelly, Rancho Palos Verdes, speaking as a resident and not as a member of the Portuguese Bend Community Association, thanked the current and past City Council members for their support of the Portuguese Bend neighborhood. He requested that the Council appoint a liaison to interface with the community on specific issues related to the Landslide Moratorium and the repercussions of the Monks litigation. Gordon Leon, Rancho Palos Verdes, indicated that the Portuguese Bend residents are concerned about the impact of development on their community. He stated that the presumption that the 1.5 factor of safety standard is no longer valid is of great conceen and residents are worried about renewed land movement and the impact new construction will have on existing infrastructure, and the sewer system in particular. Mr. Leon reported that a group of residents met recently and appointed him and another property owner to work with the City on these issues. He asked the Council for a poiht of contact with the staff to work with on the forthcoming changes to the Landslide Moratorium. Council discussion followed regarding the maintenance mechanisms in place for the private streets within the community; the fact that the discussions regarding any changes to the Landslide Moratorium will be public; the fact that development in Zone 2 will need to be addressed immediately, with the remaining zones to be considered at a later time and the suggestion that the Abalone Cove Landslide Abatement Board should be included in the discussions. RECESS TO CLOSED SESSION: At 7:45 P.M., the City Council recessed to Closed Session to continue discussion. RECESS AND RECONVENE: Mayor Clark called a brief recess from 8:40 P.M. to 8:43 P.M. RECONVENE TO OPEN SESSION: At 8:57 P.M., the City Council reconvened to Open Session. CLOSED SESSION REPORT: City Attorney Lynch reported that the Council gave unanimous direction to the City Attorney on all cases, with Councilman Gardiner absent. ADJOURNMENT: At 8:58 P.M., Mayor Clark declared the meeting adjourned.
