CC MINS 20080902 MINUTES RANCHO PALOS VERDES CITY COUNCIL ADJOURNED REGULAR MEETING SEPTEMBER 2, 2008 The meeting was called to order at 6:00 P.M. by Mayor Stern at Fred Hesse Community Park, 29301 Hawthorne Boulevard and was immediately recessed into Closed Session. Councilman Wolowicz was present via teleconference.* The meeting reconvened at 7:04 P.M. City Council roll call was answered as follows: PRESENT: Clark, Gardiner, Long, Wolowicz*, (via teleconference) and Mayor Stern ABSENT: None * Councilman Wolowicz was present via teleconference from the Sheraton Bloomington Minneapolis South, 7800 Normandale Road, Room No. 1513, Minneapolis, MN 55439. FLAG SALUTE: The Flag Salute was led by former Mayor and former Councilwoman Barbara Ferraro. PRESENTATION: Martin Gombert, Palos Verdes Transit Authority, provided a brief presentation regarding the transportation services offered by the Palos Verdes Peninsula Transit Authority for Peninsula residents and students. MAYOR'S ANNOUNCEMENTS: Mayor Stern reported on the Randy Simmons Bridge Dedication Event, shared pictures of the event, and recognized Recreation and Parks staff for their efforts in organizing the event. He also provided an update on the proposed Trader Joe's Market at the Golden Cove Shopping Center. RECYCLE DRAWING: City Council Minutes September 2, 2008 Page 1 of 14 Mayor Stern announced Recyclers of the Month from the August 19, 2008 City Council meeting: Joseph Mardesich, M.D. and Suzanne Gatlin. He indicated that all winners receive a check for $250 representing a year of free refuse service and urged everyone to participate in the City's recycling program. Grogan, USAF, Retired, USO Greater Los Angeles Area, provided a presentation regarding the upcoming USO golf tournament at Trump National Golf Course. Rayne Sherman, Palos Verdes Concours d'Elegance, Rancho Palos Verdes, provided a presentation regarding the upcoming Palos Verdes Concours D'Elegance to be held at the Trump National Golf Course. CITY MANAGER REPORT: None. NEW BUSINESS: APPROVAL OF CONSENT CALENDAR: City Clerk Morreale reported that late correspondence was distributed regarding Item No. 4 prior to the meeting. The motion passed on the following roll call vote: AYES: Clark, Gardiner, Long, Wolowicz, and Mayor Stern NOES: None PAUSE TO CONSIDER THE REMAINDER OF THE AGENDA: REGULAR NEW BUSINESS: Rancho Palos Verdes Coast Vision Plan (1201) Principal Planner Ara Mihranian provided a summary staff report on the Rancho Palos Verdes Coast Vision Plan and introduced Melendrez Consultant Melani Smith. Melani Smith, consultant, Melendrez, provided an overview of the Rancho Palos Verdes Coast Vision Plan and the components including the following topics: the purpose of the Vision Plan; the restatement of the values that the community was founded upon; the coexistence of preservation of open space and development along the coast; the opportunity for education, community gathering, learning; stewardship of the City's precious resources for future generations; the five key sites of the Vision Plan, including Upper Pt. Vicente (Civic Center portion), Lower Pt. Vicente, Abalone Cove, Gateway Park, and Del Cerro Park in the City; enhancements to the network of connections between the five key sites, including coastal access, trails, bikeways; improvement of medians, parking areas, and circulation patterns; capture of storm water and management and conservation of water; use of historic architectural designs; materials related to design palettes for hardscape and planting; a conceptual look at signage, trail head markers, and entry markers at key sites and entrances into the City; fence materials and fence types; and, the inclusion of an Appendix containing materials presented at earlier workshops, comments from the public that have been received, and additional information regarding appropriate plant materials used by the Palos Verdes Peninsula Land Conservancy (PVPLC), as well as invasive plant information. City Council Minutes September 2, 2008 Page 4 of 14 Council and staff discussed the following issues: the use of the Rancho Palos Coast Vision Plan as a supplemental informational document to the Coastal Specific Plan; coastal permits as addressed in the Coastal Specific Plan; clarification that the adoption of the Vision Plan this evening was not intended to be the initiation point of the Master Plan for the Upper Pt. Vicente site; a suggestion that the section relating to the Annenberg Foundation proposed Animal Education Facility be considered separately; clarification that the proposed project from the Annenberg Foundation includes a focus on both domestic and indigenous animals; the educational component of the facility as an addition to the Pt. Vicente Interpretive Center; animal adoption services as one component of the proposed facility; clarification that the facility would house up to 20 animals; three conceptual phases of development for the Upper Pt. Vicente site, including the village green envisioned as a central gathering space; the reuse of the infrastructure on the bluff; parking options; views; trail connections as a part of the Vision Plan; the proposed location of the Palos Verdes Art Center facility at the Upper Pt. Vicente site; beach access at Abalone Cove; an equestrian park at the Gateway Park; active recreational use; and, the PVPLC donor recognition site at Del Cerro Park. Betty Field Strauss, Rancho Palos Verdes, provided a brief history of efforts to preserve the coastline as public open space with unobstructed views, particularly the area between Palos Verdes Drive South and the cliffs. She stated that she did not want to see additional structures on the public open space along the coastline. Barbara Ferraro, Rancho Palos Verdes, stated that the Vision Plan was a wonderful guide for future projects and noted that she appreciated the fact that many stakeholders in the City were consulted regarding the proposed Plan. William Tolliffe, Rancho Palos Verdes, opined that a domestic Animal Education Facility did not relate to the coastal emphasis of the Vision Plan; that the proposed Annenberg Animal Care Facility was not an appropriate use for the site, suggested that the City consider beautifying the entrance to Gateway Park with landscaping rather than an Equestrian Center, noting that youth groups should be able to utilize Gateway Park. Jim Knight, Rancho Palos Verdes, defined the goal of the General Plan and noted that certain areas in the Vision Plan did not comply with the original vision of the City, such as the Annenberg Animal Care Facility, which he opined should be relocated on at another site in the City. He noted that it was important to focus on the original vision for the City and recommended against approval of the Vision Plan until the issue regarding the Annenberg Animal Care Facility is resolved. Derrick Wallentinsen, San Pedro, stated that he believed that Annenberg Animal Care Facility building was fundamentally incompatible with the area; expressed concern with added light pollution; and, cautioned that the Annenberg Foundation had its own agenda which he opined did not belong in the Vision Plan. City Council Minutes September 2, 2008 Page 5 of 14 Shera Dolmatz-Finkel, Girl Scout leader, Rancho Palos Verdes, reported a previous request and petition submittal for consideration of a primitive camping facility noting that camping was not included in the proposal because there are already two sites at Ladera Linda and Upper Pt. Vicente for this use. She outlined the limitations of the two available camping facility sites including security issues. Diane Hayden, Girl Scout Troops 696 and 919, Rancho Palos Verdes, inquired as to why an outdoor educational facility and service component had not been provided in the Vision Plan, noting the importance of camping in a remote facility and the lack of the service component in the present available campground locations. Barbara Dye,, Rancho Palos Verdes, expressed support for the Del Cerro Park recognition site and supported the Annenberg Animal Education Facility site as a compatible use for the site with the added educational component. She noted that connecting trails and restored habitat areas could be added to the Palos Verdes Nature Preserve, which provided the potential for permanent additions to the Preserve and additional open space while the educational component would add something important to the human bond with animals. Henry Jurgens, Rancho Palos Verdes, President of the Palos Verdes Peninsula Land Conservancy (PVPLC), speaking on behalf of the Board of Directors, expressed support for the Vision Plan and clarified that funding for the Del Cerro Park recognition site would be from the PVPLC. He added that the Vision Plan would provide easy access for the able bodied and disabled and would provide benches for the community to enjoy. Ann Shaw, Rancho Palos Verdes, stated that the Annenberg Animal Care Facility was an inappropriate use of the Lower Pt. Vicente area and encouraged the Council to only approve as few buildings in the area as possible, keeping in mind the City Founders' vision of protecting open space. RECESS AND RECONVENE: Mayor Stern called a brief recess from 9:01 P.M. to 9:10 P.M. Rancho Palos Verdes Coast Vision Plan (continued) Discussion between staff and the Council included the following issues: a suggestion to incorporate letters from Jim Knight into the Vision Plan; Lower Point Vicente as consistent with the Coastal Specific Plan including the educational component of indoor and outdoor exhibits; improvements which would make the area more accessible to the public; the importance of allowing the public the ability to enjoy the area preserved by the Founders; appreciation for the work put into the Vision Plan by the community and stakeholders over the last two years; support for proposed enhancements of the coastline and trails; funding sources; the importance of maintaining public appreciation for the space; appropriate uses of the land; expanding public access to the coast; clarification that the Vision Plan for Lower Pt. Vicente includes substantial native habitat City Council Minutes September 2, 2008 Page 6 of 14 and the outdoor museum; concerns regarding changes to the area as a result of the additions of buildings and exhibits; and, an assertion that the Annenberg Animal Care Facility should be located at another site in the City. Elizabeth Sax, Rancho Palos Verdes, suggested that the Annenberg Foundation consider the possibility of providing the community with a theatre facility/multipurpose room. She encouraged landscaping of the medians using less water and expressed concern with landscaping maintenance issues of medians on Palos Verdes Drive South near the Trump National Golf Club. Mayor Pro Tem Clark asked staff to investigate the maintenance issues of the median areas on Palos Verdes Drive South near Trump National Golf Club. Councilmember Wolowicz moved, seconded by Councilman Gardiner, to adopt the staff recommendation with the addition that Upper Pt. Vicente include dedication of active fields in the list of proposed site improvements and regarding Lower Pt. Vicente, that no decisions be made in Item 8 with regard to the proposed Annenberg Animal Care Facility that is to be discussed in Item 9. Discussion on the motion included the following topics: the potential inclusion of an active recreation component in the Vision Plan for Upper Pt. Vicente; clarification that action on the Vision Plan did not impact whether or not the entitlement process of specific components regarding the Annenberg Animal Care Facility moved forward under Item 9; an assertion that action on Item 9 would be premature since it had not been heard; an assertion that Upper Pt. Vicente concept did not lend itself well to an active recreation component; a suggestion to move the Annenberg portion to Item 9; and, an assertion that the Vision Plan provided a conceptual plan for the Lower Pt. Vicente site. Mayor Stern stated that the amendments to the staff recommendation should be considered separately. The motion with the first amendment to the staff recommendation that Upper Pt. Vicente include the potential dedication of active fields on the list of proposed site improvements identified in the Vision Plan document passed by the following roll call vote: AYES: Clark, Gardiner, Long, and Wolowicz NOES: Mayor Stern The motion with the second amendment to the staff recommendation that decisions be deferred with respect to Lower Pt. Vicente any indication of approval or disapproval of Item 9, the Annenberg portion, failed by the following roll call vote: AYES: Gardiner and Wolowicz NOES: Clark, Long, and Mayor Stern City Council Minutes September 2, 2008 Page 7 of 14 Councilman Wolowicz moved, seconded by Councilman Gardiner, to ADOPT RESOLUTION NO. 2008-80, AS AMENDED, A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF RANCHO PALOS VERDES, ADOPTING THE RANCHO PALOS VERDES COAST VISION PLAN THAT CREATES AN INFORMATIONAL PLANNING DOCUMENT PROVIDING GUIDELINES FOR FUTURE IMPROVEMENTS ALONG THE CITY'S COASTLINE IN TERMS OF PUBLIC ACCESS, INTERPRETIVE MATERIALS, AND RECREATIONAL AMENITIES, INCLUDING CONCEPTUAL DESIGN SCHEMES FOR THE FIVE KEY SITES. The Annenberg Foundation Public Education Facility and Site Improvements at Lower Pt. Vicente (1201) City Clerk Morreale reported that late correspondence was distributed prior to the meeting on this item. Principal Planner Mihranian provided a summary staff report. Council and staff discussion included the following issues: clarification that the area under discussion consists of approximately 20 acres, 8-10 acres of which is currently used for commercial farming; the location of the proposed Annenberg Facility which would remove the agricultural use from the site and revert it to open space, with plans for re-vegetation with natural habitat; the proposed two-story structure would have a 15,000 square foot footprint, consisting of a two-story structure containing a total of 30,000 square feet; and, the footprint of the two proposed structures would use 2.5% of the total lot coverage of the entire site. Leonard Aube, Annenberg Foundation, provided a brief history of the Annenberg Foundation and an overview and presentation of the proposed Annenberg Foundation Public Education Facility at Lower Pt. Vicente. Howard Litwak, Annenberg Foundation, provided information on the Conceptual Development Team used to develop the Vision Plan, provided an overview of the development plan for the proposed Annenberg Facility at Lower Pt. Vicente, and the financial support of the project site. Mayor Stern disclosed that he had previously heard the Annenberg presentation at a recent Council of Homeowners Association meeting, and he and Mayor Pro Tern Clark City Council Minutes September 2, 2008 Page 8 of 14 heard the presentation at a recent breakfast hosted by the Annenberg Foundation for former Mayors of the City. Discussion between the Council and Annenberg Foundation representatives included the following issues: the grading of the site so that the height of the building will be approximated eight feet above grade by tucking the structure into the slope; the placement of the Animal Care Facility Building on the site; concerns that the Animal Care Facility is an animal shelter vs. a multipurpose discovery educational center dealing with the bond between humans and animals from the indigenous to the domestic; the ability of the public for direct involvement and input in the process for the proposed project; clarification that 80% of the Animal Care Facility will be used for public activities, exhibits, programs, and the necessary staff support for that component; the number of domestic animals to be at the site conceptually anticipated to be no more than 20; alternate sites in the City for the Animal Care Facility and the assertion that relocating the Animal Care Facility would markedly change the integrated concept of the Vision Plan; the value of the integrated concept of the Facility to the Palos Verdes Peninsula School District; discussion of the possibility of amenities such as light food services at the site; and, the possibility of distance learning opportunities due to the Annenberg Foundation's previous experience in that arena. RECESS AND RECONVENE: Mayor Stern called a brief recess from 11:13 P.M. to 11:15 P.M. The Annenberg Foundation Public Education Facility and Site Improvements at Lower Pt. Vicente (continued) Barbara Walch, Rancho Palos Verdes, one of the City's Founders, stated that she would like to see the Animal Care Facility located elsewhere in the City as she believed the Lower Pt. Vicente site to be an inappropriate location for the proposed project. Barbara Ferraro, Rancho Palos Verdes, former Mayor and Councilmember, was impressed with the presentation and thoroughness of the approach; opined that there were misconceptions about the project; and, noted that she appreciated the educational center, archaeological dig area, and native plant aspect of the project, as well as the enhanced parking and landscaping. Barbara Dye, Rancho Palos Verdes (comments read by Barbara Ferraro), expressed support for the project due to the following reasons: educational enhancements including the outdoor exhibit area; habitat restoration and acreage that could be added to the Palos Verdes Nature Preserve, including new trails; high building standards and sensitivity to the site and surroundings; and the fact that maintenance is funded by the Annenberg Foundation in perpetuity. City Council Minutes September 2, 2008 Page 9 of 14 David Wagman, President of the Peninsula Education Foundation, Rancho Palos Verdes (letter read by Barbara Ferraro), Peninsula Education Foundation, expressed support for the project. Linda Retz, Rolling Hills Estates, expressed support for the project, noting that it affords opportunities for interaction between humans and animals in the community and that there were many letters of support for the Annenberg Care Facility on the City website. Karen Savich, Rancho Palos Verdes, expressed support for the project. Cassie Jones, veterinarian, Rancho Palos Verdes, expressed support for the project and discussed animal abuse and cruelty, noting the critical need to educate the public on issue related to animals. She opined that the overall vision of the project was bigger than the City's vision, effecting society and the way people are treated. Martin Dodell, Rancho Palos Verdes, expressed support for the Annenberg proposal, noting the educational opportunities for students. Dr. Patty Boge, owner of the Narbonne Animal Clinic, Lomita, expressed support for the project, noting that if a project enhances the quality of life for animals, it also enhances the quality of life for humans. Dr. Rolan Tripp, expressed support for the Annenberg proposal and the distance learning program as a way to educate people on the proper way to deal with animals. Pam Crane, Rolling Hills, expressed support for the project and the world class project that she believes it will be. Ken Dyda, Rancho Palos Verdes, stated that he believes the Annenberg proposal is consistent with the original goals and General Plan of the City and will be a source of pride when completed. Vic Quirarte, Rancho Palos Verdes, expressed support for the Annenberg Project noting that it was not accurate to call the Animal Care Facility a dog and cat hotel as it is an educational facility. Jim Knight, Rancho Palos Verdes, expressed support for the Annenberg Project with concerns on the proposed Animal Care Facility at this site. He opined that the domestic animal component of the proposal was not well matched with the Interpretive Center and supported the educational component. Dan Pinkham, Rancho Palos Verdes, was supportive of the Annenberg Project but suggested that the Animal Care Facility be relocated to the Civic Center site. Michael Hardisty, Terranea Resort/Lowe Enterprises, expressed support for the Annenberg proposal and the Animal Care Facility. He personally attested to the power City Council Minutes September 2, 2008 Page 10 of 14 of properly trained service animals for the blind and disabled through his involvement with Canine Companions for Independence and Guide Dogs of the Desert. Lenee Bilski, Rancho Palos Verdes, stated that she was opposed to the proposed Animal Care Facility, noting that it would be 2% times the size of the Interpretive Center and requested that the Council preserve the area as open space in the coastal zone. Don Eichhorn, Rancho Palos Verdes, President, Los Serenos de Pt. Vicente, expressed appreciation for the Annenberg Project and its purpose to share the history of the Peninsula with the community through the Project's educational components and exhibits. Ann Shaw, Rancho Palos Verdes, opined that the driving force behind the proposed Annenberg Project was to have an Animal Companion Center on the site, noting that the project would materially alter the tranquil character of Lower Pt. Vicente. She stated that the focus of the project should be on indigenous animals. Discussion by Council and staff included the following topics: the collection of fees for animal care and services was not part of the proposal; dealing with the tranquility and lighting of the site in the planning entitlement process; the evolution of the Annenberg Facility over the last eighteen months with the incorporation of concerns and input of the Council, staff, and public; appreciation for the Annenberg team's extensive outreach to the community; the enhancement of the Lower Pt. Vicente site regarding the public's access and vision of the coastal location with the proposed educational opportunities; the importance of keeping the related components together on one site; concerns with the animal hospital and adoption services of the Animal Care Facility; and, the initiation of lease negotiations between the Council and the Annenberg Foundation. Councilman Long moved, seconded by Mayor Pro Tem Clark, to adopt the staff recommendation and authorize the Annenberg Foundation to initiate the planning entitlement process for the proposed Lower Pt. Vicente improvements identified in the Vision Plan. Councilman Wolowicz proposed an amendment to the motion to exclude the animal hospital care facility and adoption services of the Animal Care Facility at this location. The motion died for lack of a second. Further Council discussion included the notion that change frightens people but can be beneficial, and the proposal as an enhancement and a benefit to the Lower Pt. Vicente site for the community. The motion to adopt the staff recommendation passed by the following roll call vote: AYES: Clark, Gardiner, Long, and Mayor Stern NOES: Wolowicz City Council Minutes September 2, 2008 Page 11 of 14 RECESS AND RECONVENE: Mayor Stern called a brief recess from 12:43 A.M. to 12:49 A.M. Traffic Engineering Services Contract City Clerk Morreale reported that late correspondence was distributed on this item prior to the meeting. Mayor Pro Tem Clark moved, seconded by Councilman Long, to waive the staff report. Without objection, Mayor Stern so ordered. Council and staff discussion included the following topics: clarification that the contract was for 2008-2009; no other companies were considered, as Willdan was the original service provider for the City; and, clarification that the item was an extension of a previously existing contract. Councilman Wolowicz moved, seconded by Councilman Long, to award and authorize the Mayor to execute the contract, as amended, in the amount not to exceed $174,000 for FY 08-09 with Willdan Engineering to provide Traffic Engineering services for the City of Rancho Palos Verdes. The motion to adopt the staff recommendation passed by the following roll call vote: AYES: Clark, Gardiner, Long, and Mayor Stern NOES: Wolowicz Special Joint Meeting of the City Council and Traffic Safety Commission (307) Councilman Wolowicz moved, seconded by Councilman Long, to waive the staff report. Without objection, Mayor Stern so ordered. Council and staff discussed the past difficulties in setting up a Joint Meeting and the likelihood of the Traffic Safety Commission (TSC) having a quorum present for a Joint Meeting of the Council and the TSC. Councilman Long moved, seconded by Councilman Gardiner, to cancel the proposed City Council/Traffic Safety Commission meeting for September 30, 2008 and direct staff to select another date for the Joint CC/TSC Meeting with the requirement for only a quorum (4) of the TSC members in attendance.
