A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
RANCHO PALOS VERDES ACCEPTING RIGHT-OF-WAY
DEEDS, AMENDING EASEMENT AGREEMENTS AND
CONVEYING REVERSIONARY DEEDS TO IMPROVE THE
TERMINUS OF COOLHEIGHTS DRIVE IN CONNECTION WITH
HEIGHT VARIATION 899 (3787 COOLHEIGHTS DRIVE)
WHEREAS, on August 27, 2002 the Planning Commission unanimously
approved, with conditions, Height Variation No. 899, et. al., to allow the construction of a
new 5,407 square foot single-family residence on the Property commonly known as
3787 Coolheights Drive (the "Property"); and
WHEREAS, the conditions of approval imposed by the Planning Commission
required, among other things, that portions of the Property be conveyed to the City in
the form of Grant Deeds and Easements prior to the issuance of building or grading
permits to improve the terminus of Coolheights Drive with a cul-de-sac turn-around
(which was requested by neighbors of the project at 3787 Coolheights Drive); and
WHEREAS, deeds and easement agreements were entered into around
November and December 2003, in which certain interests in portions of property along
Coolheights Drive were conveyed to the City by various property owners, provided that
the cul-de-sac was constructed on or before August 27, 2005; and
WHEREAS, the cul-de-sac was not completed by August 27, 2005 and various
property interests have reverted to the original owners under the terms of those
conveyances, and documents need to be executed to memorialize those reversions;
and
WHEREAS, in order to complete the construction of the cul-de-sac, new
conveyances and amended easement agreements need to be executed and recorded
to re-convey to property owners and City various property interests.
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF RANCHO PALOS
VERDES DOES RESOLVE, DETERMINE AND ORDER AS FOLLOWS:
Section 1. The City Council does hereby find that the above recitals are
accurate and are hereby incorporated and made part of this Resolution by reference.
Section 2. The City Council hereby authorizes the Mayor to execute the
following reversionary deeds (the "Reversionary Deeds") memorializing the property
reversions that took place as of August 27, 2005:
a. A Quit Claim Deed (Reversion - Cul-De-Sac) granting to Mr. and Mrs.
Nassiri at 3787 Coolheights Drive the property that had been conveyed by
that certain grant deed dated as of November 25, 2003, dedicating to the

City approximately 1,650 square feet for the construction of the cul-de-sac
turn-around at the terminus of Coolheights Drive.
b. A Quit Claim Deed (Reversion - Access To Adjacent Parcel) granting to
Mr. and Mrs. Nassiri at 3787 Coolheights Drive the property that had been
conveyed by that certain grant deed dated as of November 25, 2003,
dedicating to the City approximately 102.58 square feet for access to the
adjacent parcel.
c. A Quitclaim Deed (Reversion) granting to Dr. and Mrs. Farooq at 3777
Coolheights Drive the property that had been conveyed by that certain
grant deed dated as of November 25, 2003, dedicating to the City of
Rancho Palos Verdes approximately 4.05 square feet of land for the
construction of the cul-de-sac turnaround at the terminus of Coolheights
Drive.
d. A Quitclaim Deed (Reversion) granting to The Ortolano 1996 Revocable
Trust, Mr. and Mrs. Ortolano, Sr. trustees, at 3776 Coolheights Drive the
property that had been conveyed by that certain grant deed dated as of
November 26, 2003, dedicating to the City of Rancho Palos Verdes
approximately 12.79 square feet of property for the construction of the cul-
de-sac turn-around at the terminus of Coolheights Drive.
e. A Quitclaim Deed (Reversion) granting to Ralph J. Ortolano, Jr. at 3778
Coolheights Drive the property that had been conveyed by that certain
grant deed dated as of December 2, 2003, dedicating to the City of
Rancho Palos Verdes approximately 83.80 square feet of property for the
construction of the cul-de-sac turn-around at the terminus of Coolheights
Drive.
Section 3. The City Council hereby authorizes the Mayor to execute a
quitclaim deed re-conveying to Mr. Ralph J. Ortolano, Jr. at 3778 Coolheights Drive
approximately 348.75 square feet of property vacating a portion of a trail easement that
had reverted to the City as of August 27, 2005.
Section 4. The City Council hereby authorizes the Mayor to execute the
following amended and restated easement agreements (Amended and Restated
Easements) to reinstate those agreements that terminated due to the property
reversions that took place as of August 27, 2005:
a. An amended and restated easement agreement between the City and Mr.
Ralph J. Ortolano, Jr. granting him an easement over a portion of
Coolheights Drive cul-de-sac property for pedestrian and vehicular access
and other purposes.
b. An amended and restated easement agreement between Mr. and Mrs.
Nassiri and the City granting the City an easement over a turnaround area

at 3787 Coolheights Drive for use by large vehicles, public and private, to
accommodate their turns within the Coolheights Drive cul-de-sac.
Section 5. The City Council hereby accepts the interests in real property
conveyed by the following (collectively, "Reconveyance Deeds and Easement
Amendments"):
a. A right-of-way deed executed by Mr. and Mrs. Nassiri at 3787 Coolheights
Drive dedicating to the City of Rancho Palos Verdes approximately 1,650
square feet for the construction of the cul-de-sac turn-around at the
terminus of Coolheights Drive.
b. A right-of-way deed executed by Mr. and Mrs. Nassiri at 3787 Coolheights
Drive dedicating to the City of Rancho Palos Verdes dedicating to the city
approximately 102.58 square feet for access to the adjacent parcel.
c. A right-of-way deed executed by Dr. and Mrs. Farooq at 3777 Coolheights
Drive dedicating to the City of Rancho Palos Verdes approximately 4.05
square feet of land for the construction of the cul-de-sac turnaround at the
terminus of Coolheights Drive.
d. A right-of-way deed executed by The Ortolano 1996 Revocable Trust, Mr.
and Mrs. Ortolano, Sr. trustees, at 3776 Coolheights Drive dedicating to
the City of Rancho Palos Verdes approximately 12.79 square feet of
property for the construction of the cul-de-sac turn-around at the terminus
of Coolheights Drive.
e. A right-of-way deed executed by Mr. Ralph J. Ortolano, Jr. at 3778
Coolheights Drive dedicating to the City of Rancho Palos Verdes
approximately 83.80 square feet of property for the construction of the cul-
de-sac turn-around at the terminus of Coolheights Drive.
f. A quitclaim deed (reversion) executed by Mr. Ralph J. Ortolano, Jr. at
3778 Coolheights Drive memorializing the reversion of the City's grant to
Mr. Ortolano, Jr. of approximately 348.75 square feet of property vacating
a portion of a trail easement.
g. An amended and restated easement agreement between the City as
grantor and Mr. Ralph J. Ortolano, Jr. granting him an easement over a
portion of Coolheights Drive cul-de-sac property for pedestrian and
vehicular access and other purposes.
h. An amended and restated easement agreement between Mr. and Mrs.
Nassiri and the City granting the City an easement over a turnaround area
at 3787 Coolheights Drive for use by large vehicles, public and private, to
accommodate their turns within the Coolheights Drive cul-de-sac.

Section 6. The City Council hereby authorizes the City Manager to execute
the Certificates of Acceptance attached to the Reconveyance Deeds and Easement
Amendments, and the Amended and Restated Easements.
Section 5. The City Council hereby consents to the recordation of the
Reversionary Deeds, the Reconveyance Deeds and Easement Amendments, and the
Amended and Restated Easements.
Section 6. The City Clerk shall certify to the adoption of the Resolution and
shall cause the Resolution and her certification to be entered in the Book of Resolutions
of the Council of the City.
