CC RES 1993-025 RESOLUTION NO. 93 - 25 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF RANCHO PALOS VERDES AMENDING RESOLUTION NO. 91-47 ESTABLISHING THE COMPETITIVE SERVICE EMPLOYEE PERSONNEL RULES WHEREAS, on July 2, 1991, the City Council adopted Resolution No. 91-47 establishing the Competitive Service Employee Personnel Rules; and WHEREAS, the Competitive Service Employee Personnel Rules provide that nonexempt employees are eligible for overtime and compensatory time off in accordance with the federal Fair Labor Standards Act (FLSA) ; and WHEREAS, certain competitive service employees in the City, based on the guidelines established by the FLSA, would be classified as exempt employees, thus not eligible for overtime pay and compensatory time off; and WHEREAS, those competitive service employees who are considered exempt, could be granted up to seven (7) administrative leave days off per fiscal year, in lieu of overtime or compensatory time off; NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF RANCHO PALOS VERDES DOES HEREBY RESOLVE AS FOLLOWS: Section 1. RULE VI, of the Competitive Service Employee Personnel Rules adopted by Resolution 91-47 is hereby amended by adding the following section: SECTION 4 - ADMINISTRATIVE LEAVE: (a) Those competitive service employees considered exempt under the federal Fair Labor Standards Act (FLSA) , shall be granted up to seven (7) administrative leave days off per fiscal year at the sole discretion of the City Manager. This administrative leave is in lieu of overtime pay or compensatory time off. The administrative leave plan is not automatic, but is established in recognition that certain competitive service employees are often required to spend a significant amount of time participating in City meetings or events outside of the employee's normal work schedule throughout the fiscal year. (b) The scheduling of administrative leave must be approved by the City Manager or his/her designee. Employees shall submit a written request to schedule administrative leave to the City Manager or his/her designee within a reasonable amount of time prior to the desired date. In the exercise of the City Manager's discretion, s/he shall consider the work force needs of the City. (c) Administrative leave may not be accumulated to the next fiscal year. (d) Upon termination from employment, employees shall not be granted, and accordingly are not entitled to be paid for administrative leave. Section 2. Resolution No. 91-47 is hereby amended to reflect the above change in administrative leave for certain competitive service employees.
