ORD 351U ORDINANCE NO. 351U AN ORDINANCE OF THE CITY OF RANCHO PALOS VERDES ESTABLISHING A MORATORIUM ON THE APPROVAL OF SUBDIVISIONS OF PROPERTY WITHIN THAT PORTION OF THE RS-2 ZONING DISTRICT OF I/ THE CITY WHICH IS LOCATED SOUTH OF VIA CAMPESINA, NORTH OF ROLLING RIDGE ROAD AND EAST OF GRANDVIEW PARK AND DECLARING THE URGENCY THEREOF THE CITY COUNCIL OF THE CITY OF RANCHO PALOS VERDES ORDAINS AS FOLLOWS: Section 1. The area of the City of Rancho Palos Verdes which is located South of Via Campesina, North of Rolling Ridge Road and East of Grandview Park currently is within the RS- 2 zoning district. However, it has come to the City's attention during the review of at least two applications to subdivide property within that area of the City, that this zoning designation does not accurately reflect the size and density of the majority of the lots that actually are located in that area of the City. Section 2. Furthermore, a significant portion of this area of the City is served by a small private street, Rolling Ridge Road, which is substandard in width and is not large enough to accommodate the traffic that would be generated if all of the existing large lots were subdivided into smaller parcels and developed with single family residences. Accordingly, the City Council wishes the Planning Commission and the Staff to study whether the existing RS-2 zoning designation is appropriate or whether this area, instead, should be included within the RS-1 zone. Section 3 . Under the existing RS-2 zone, applications could be approved which would allow development on smaller lots of at least 20, 000 square feet in size which would be inconsistent with an RS-1 zoning classification, and would have an adverse impact on the public health, safety and welfare because the roads in that area would not be adequate to handle the increased traffic that would be generated by that level of development and density of housing. Section 4. Applications have recently been received by the City to subdivide several of the large parcels that are located in this area of the City into smaller parcels which would be inconsistent with a RS-1 zoning designation and which would cause additional traffic in this area. Also, additional inquiries have been made to City Staff about subdivisions and development applications which have not yet been submitted. 990831 R6876-00001 pjn 0692303(2) Section 5. Due to the possibility that new development and uses could occur under the current RS-2 zoning designation, which would conflict with potential forthcoming revisions to the zoning designation of this area of the City, the City Council hereby finds that there is a current and immediate threat to the public health, safety and welfare if additional subdivisions of lots or parcels within this area of the City are approved while potential new zoning regulations for this area of the City are being studied. Section 6. Therefore, the City Council hereby prohibits the approval of applications to subdivide property including, without limitation, approvals of tentative or final tract or parcel maps, in the RS-2 zoning district of the City which is located South of Via Campesina, North of Rolling Ridge Road and East of Grandview Park. During this moratorium, the City shall study and consider the amendment or replacement of zoning regulations for this area of the City and, if appropriate, shall enact new provisions regulating development and uses in this area. Section 7 . For the reasons set forth above, this interim ordinance is necessary for the immediate preservation of the public health, safety and welfare. This is an urgency ordinance adopted in accordance with Section 65858 of the California Government Code and will take effect immediately upon adoption. Section 8 . The City Council directs Staff and the Planning Commission to commence immediately such studies and hearings as may be required to analyze whether new zoning standards should be adopted for this area of the City and to issue a written report to the City Council so as to enable the City Council to issue a written report not less than ten days prior to the expiration of this interim ordinance as required by Government Code Section 65858 (d) . Section 9. This ordinance is an urgency ordinance that was adopted by a unanimous vote of the City Council and became immediately upon adoption. This ordinance shall be of no further force and effect forty-five days from its date of adoption unless the City Council, following notice pursuant to Government Code Section 65090 and a public hearing, extends such ordinance. Section 10 .
