AN ORDINANCE OF THE CITY OF RANCHO PALOS
I/ VERDES AMENDING SECTION 17 . 28 . 020 OF THE
DEVELOPMENT CODE AS CODE AMENDMENT NO. 36 TO
EXPAND THE USES ALLOWED IN AN INSTITUTIONAL
(I) ZONING DISTRICT.
WHEREAS, on June 1, 1993 , the City Council initiated Code
Amendment No. 36, at the request of the Palos Verdes Peninsula
Unified School District, to modify Development Code Section
17 . 28 . 020 to expand the allowable uses in an Institutional (I)
zoning district to include certain limited commercial uses; and,
WHEREAS, pursuant to the provisions of the California
Environmental Quality Act, Public Resource Code Sections 21000 et
se q ("CEQA") , the States Ceqa Guidelines, California Code of
Regulation, Title 14 , Section 15000 et seq. , the City's Local CEQA
Guidelines, and Government Code Section 65952 . 5 (e) (Hazardous Waste
and Substances Statement) there was no substantial evidence that
Code Amendment No. 36 would have any effect on the environment,
Accordingly, the proposed Code Amendment has been found to be
exempt, pursuant to Government Code Section 150613 ; and,
WHEREAS, on August 10, 1993 , the Planning Commission held a
public hearing to consider the merits of the proposed Code
Amendment and on August 24 , 19 9 3 , adopted P.C. Resolution No. 93-20
recommendin g approval of the proposed Code Amendment to City
Council; and,
WHEREAS, after notice issued pursuant to the provisions of the
Rancho Palos Verdes Development Code, the City Council conducted a
public hearing on September 21, 1993 , at which time all interested
parties were given an opportunity to be heard and present evidence
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF RANCHO PALOS VERDES
DOES HEREBY FIND, DETERMINE AND RESOLVE AS FOLLOWS:
Section 1 : That the proposed Code Amendment would not result
in an y adverse environmental impacts, since minor commercial uses
would not significantly increase that traffic, noise, demand for
parking arkin and signage on site or in the general vicinity of the
I/ Institutional (I) property.
Section 2 : That the proposed Code Amendment would allow uses
which are compatible with, yet are clearly ancillary to, the
governmental, educational, religious and community activities
currentl y permitted in the Institutional (I) zoning district.
Section 3 : That the expansion of permitted uses would allow
for full utilization of the existing Institutional (I) parcels in
the Cit y, which would make the sites more economically viable,
ensure continued occupation and maintenance of these sites and
would supplement the provision of valuable products and services
for the community.
Section 4 : Section 17 . 28 . 020, Uses and development permitted,
of Chapter 17 . 28 of the Rancho Palos Verdes Municipal Code is
amended to include:
F. Minor professional and retail commercial uses (such as,
small offices for bookkeeping, consulting, management and

mail order or small businesses that create or assemble a
product for sale off-site) which are clearly secondary to
the major use, may be permitted by the director, if the
applicant can demonstrate to the director' s satisfaction
that the proposed use would not result in adverse impacts
to on-site or surrounding land uses, such as additional
traffic, noise, parking and signage. No use shall
involve the sale of any goods on-site. The manufacturing
of goods may be permitted, if the manufacturing is
primarily non-mechanical (such as assembling earthquake
kits, gift baskets and floral arrangements) and is minor
and clearly secondary to the site' s major use. Written
notice of the director's decision shall be mailed to the
abutting property owners and any adjacent homeowners
associations. The director' s decision shall be
appealable to the planning commission.
section 5 : The City Clerk shall certify to the passage of the
Ordinance and shall cause this Ordinance to be published or posted
as required by law.
