I/ AN ORDINANCE OF THE CITY OF RANCHO PALOS
VERDES DESIGNATING THE VIEW RESTORATION
COMMITTEE AS A PLANNING COMMISSION FOR
LIMITED PURPOSES AND AMENDING THE RANCHO
PALOS VERDES MUNICIPAL CODE
THE CITY COUNCIL OF THE CITY OF RANCHO PALOS VERDES DOES ORDAIN
AS FOLLOWS:
Section 1. Chapter 2 .21 of Title 2 of the Rancho Palos
Verdes Municipal Code is hereby added to read as follows:
Chapter 2 .21
VIEW RESTORATION COMMITTEE
AS A PLANNING COMMISSION FOR LIMITED PURPOSES
2 .21.010 Created. The view restoration committee is
hereby created and established as a planning commission in
accordance with the Planning and Zoning Law of the state, Title
7, Chapter 3 of the Government Code, and in particular pursuant
to Section 65101(a) of the Government Code. This planning
commission may be known and referred to as the "Rancho Palos
Verdes View Restoration Committee" or "view restoration
committee. "
2 .21. 020 Duties. The view restoration committee
shall function as a planning commission for limited purposes and
shall have only the exclusive powers, duties, rights, privileges
and authority to:
A. Grant or deny view restoration permit applications
pursuant to Section 17. 02 . 040 (C) (2) of this Code for restoration
of views where foliage is a factor, which shall be binding and
are final.
B. Draft regulations and policies to guide the view
restoration committee's actions, which, pursuant to Section
17. 02 . 040 (A) (17) , shall be binding after approval by the city
council.
I/ C. Recommend to the city council amendments to Section
17. 02 . 040 (C) (2) of the Rancho Palos Verdes Municipal Code.
Section 2 . Section 2.20.070 of Chapter 2.20 of
Title 2 of the Rancho Palos Verdes Municipal Code is hereby added
to read as follows:
2 .20. 070 Relation to view restoration committee.
The planning commission shall have no jurisdiction with respect
to view restoration permit applications where foliage is a
factor filed pursuant to Section 17. 02.040 (C) (2) of this Code,

regulations and policies which guide the view restoration
committee and any amendments to Section 17. 02 . 040 (C) (2) , unless
the city council disbands the view restoration committee and
transfers its authority to the planning commission pursuant to
Section 17. 02 . 040 (A) (17) of the Code.
Section 3 . Pursuant to Section 5 of Proposition M, the
"Rancho Palos Verdes Council of Homeowners Associations and City
Council Cooperative View Preservation and Restoration Ordinance"
("Ordinance") adopted by the voters on November 7, 1989, the City
Council finds that an amendment to Section 17. 02 . 040 of Chapter
17. 02 of Title 17 is necessary in order to effectuate and enhance
the purposes of the Ordinance. This amendment is necessary
because it eliminates the need for both the Planning Commission
and the view restoration committee to review amendments to
Section 17. 02 . 040 (C) (2) of the Code. It also will eliminate the
need for the City Council to review the recommendations of both
the Planning Commission and the view restoration committee with
respect to such amendments.
Section 4. Section 17. 02 . 040 (A) (17) of Chapter 17. 02 of
Title 17 of the Rancho Palos Verdes Municipal Code is hereby
amended to read as follows:
17. The "view restoration committee" is a planning
commission for limited purposes, as defined by Chapter 2 .21 of
this Code, appointed by the city council to consider
applications for view restoration permits where foliage is a
factor. The terms and qualifications of office shall be as
established by the city council. The committee shall consist of
seven members and three alternates, representing as diverse a
geographical mix of members and alternates as is practical. The
view restoration committee shall draft regulations and policies
to guide the actions of the committee, which shall be binding
after approval by the city council. In the event the workload of
the view restoration committee declines to an extent deemed by
the city council to make the continuation of the view restoration

committee impractical, the city council shall disband the view
restoration committee and transfer its work to the planning
commission created and established by Chapter 2 .20.
