I/ AN ORDINANCE OF THE CITY OF RANCHO PALOS
VERDES REGARDING CHARGES FOR THE DISPOSAL OF
RESIDENTIAL SOLID WASTE AND AMENDING THE
RANCHO PALOS VERDES MUNICIPAL CODE
THE CITY COUNCIL OF THE RANCHO PALOS VERDES DOES HEREBY
ORDAIN AS FOLLOWS:
Section 1. Section 8.20.270 of the Chapter 8.20 of
Title 8 of the Rancho Palos Verdes Municipal Code is hereby
amended to read as follows:
8.20.270 Collection Charges; Bills; Delinquencies;
Penalties.
A. Establishment. Each occupant or owner of residen-
tial property in the City shall pay the fees established by
resolution of the City Council for the collection of solid waste
and recyclable materials from residential premises. Such fees
may be changed by the City Council from time to time by
resolution, and such fees shall be applicable for the periods

designated in, or covered by, such resolution. The occupant of
each residence, if different from the owner, shall be primarily
responsible for payment of all such fees and charges. Should the
occupant fail to pay all such fees and charges so that they
become delinquent, then the owner of such residence shall become
responsible for the payment of all such fees and charges,
including any delinquency.
B. Bills. Each occupant or owner of residential
property in the City shall be billed quarterly in advance by
Contractor for the fees charged for the collection of garbage,
rubbish, recyclable and waste materials. The Contractor shall
make all reasonable efforts to diligently pursue and collect all
fees and charges due the Contractor for rendering such services.
C. Delinquencies; Penalties. Should any residential
occupant or owner fail, refuse or neglect to pay any such bill
within ninety (90) days after the end of the billing quarter,
Contractor shall mail notice of the delinquency to the City, the
occupant and the owner, if the owner is different from the
I/ occupant. The failure to pay such bill shall not result in the
failure to collect garbage, rubbish, recyclable and waste
materials. It shall be the duty of the Contractor to provide to
the City all information necessary for the City to assume the
responsibility for billing delinquent accounts.
After receipt of such notice, the City will prepare a
report, once a year, of all delinquent fees and will mail notice
to the affected occupants and owners that the City has assumed

responsibility for billing the accounts. Such notice shall
further declare that the City Council at a regular meeting,
occurring at least ten (10) days after the date of the notice, I/
shall review as an assessment against the affected properties the
amount of all delinquent and unpaid fees or charges set forth in
the report, the amount of any penalty established by resolution
of the City Council, and the administrative costs incurred by the
City, including any charges from the County of Los Angeles, and
shall consider any objections or protests of landowners to be
assessed. The City Council may make such revisions or
corrections to the report as it deems just after which, by
resolution, the report and the amount of all penalties, fees and
costs shall be confirmed.
The delinquent fees and amounts confirmed by the City
Council shall constitute special assessments against the
respective parcels of land and are a lien on the property for
said amount. The City shall record in the office of the Los
Angeles County Recorder a certified statement of the total
balance due together with the legal description of the property
affected. From and after the date of such recordation, the
balance due shall be a special assessment against the real
property. The assessment shall be collected at the same time and
in the same manner as are county property taxes and shall be
subject to the same penalties and to the same procedure and sale
in case of delinquency as provided by ordinary county property
taxes. All laws applicable to the levy, collection and
enforcement of county property taxes shall be applicable to such
special assessment.
Section 2 . If any section, subsection, sentence,
clause, phrase, or portion of this ordinance is for any reason
held to be invalid or unconstitutional by a decision of any court
of competent jurisdiction, such decision shall not affect the
validity of the remaining portions of this ordinance. The City
Council hereby declares that it would have adopted this ordinance
and each section, subsection, sentence, clause, phrase or portion
irrespective rrespective of the fact that any one or more provisions
be declared invalid or unconstitutional.
