ORD 233U ORDINANCE NO. 233 U AN ORDINANCE OF THE CITY OF RANCHO PALOS VERDES EXTENDING ORDINANCE NO. 231U DECLARING THE URGENCY THEREOF. II/ THE CITY COUNCIL OF THE CITY OF RANCHO PALOS VERDES DOES HEREBY ORDAIN AS FOLLOWS: Section 1 : Pursuant to Section 65858 (d) of the California Government Code, the City Council hereby reports that subsequent to the adoption of Ordinance No. 231U, the City has commenced the preparation and review process to enact a detailed specific plan for Coastal Subregions 7, 8, and the Palos Verdes Drive switchbacks (the "Study Areas" ) . A tentative review schedule for the specific plan for this area has been prepared by staff. The City Council also reports that discussions have commenced between the owners of the property located in Coastal Subregion 1 and City staff, and that the owners' representative has written to the City indicating a willingness to initiate preparation of a specific plan for this area. Section 2 : Major portions of the Study Areas are within the City' s coastal zone and comprise nearly all of the vacant remaining land adjacent to the coastline in Rancho Palos Verdes . There is at the present time no ordinance adequately regulating the grading of property and the development of structures and buildings on properties within the Study Areas, particularly in light of proposed changes in permitted land uses within and adjacent to portions of the Study Areas which would significantly increase the amount of commercial development within the City' s coastal zone. Although- the coastal specific plan, adopted in 1978, generally addresses development for those portions of the Study Areas in the coastal zone, it does not adequately address the changes in land use currently being proposed. Further, the coastal specific plan is not sufficiently detailed, and must be reexamined and studied to determine whether it contains sufficient regulations to ensure that development in the Study Areas occurs at an appropriate scale and density, consistent with the size, topography, and circulation system capacities of the area, with no unnecessary alterations to existing landforms . Further, through reexamination of the coastal specific plan and preparation of detailed specific plans, the City desires to ensure that any development that occurs will preserve significant public and private views over the area, provide for adequate public coastal access , open space, and recreation opportunities, and is evaluated in terms of the fiscal and public service impact on the City and its residents . Section 3 : The Study Areas contain a large number of vacant lots where inadequately regulated development, and hastily considered changes in land use, will potentially create adverse and irreversible land use effects and hazards . Applicable zoning presently lacks adequate land use control to ensure the orderly development of structures and buildings in said areas . The unregulated grading and proliferation of buildings and structures would cause adverse impacts on the use, enjoyment, and value of property within the City. II/ Section 4 : The unregulated establishment of any buildings or structures that would conflict with future regulations would be detrimental to the public health, safety, or welfare of the community. Therefore, with the absence of an approved specific plan which focuses in detail on the Study Areas and provides sufficient development regulations, this ordinance is necessary for the immediate preservation of the public health safety and welfare. Section 5 : Ordinance No. 231U is hereby extended through April 19 , 1989 . Extension of Ordinance No. 231U is necessary to ensure that the planning process established by the City for the Study Areas, to alleviate the immediate threat to the public health, safety, and welfare described in Sections 2 through 5 of Ordinance No. 231U, can continue to conclusion. Section 6 : This ordinance will ensure that no buildings and structures or uses that would conflict with future regulations governing this area will be developed. This ordinance, therefore, is necessary for the public health, safety and welfare and shall take effect immediately upon its adoption. This ordinance shall be of no further force and effect after April 19, 1989, unless further extended following a noticed public hearing.
