ORD 231U ORDINANCE NO. 231U
AN INTERIM ORDINANCE OF THE CITY OF RANCHO PALOS
VERDES ESTABLISHING A SPECIFIC PLAN REQUIREMENT
FOR CERTAIN PROPERTIES WITHIN THE CITY AND
DECLARING THE URGENCY THEREOF.
The City Council of the City of Rancho Palos Verdes does
hereby ordain as follows :
Section 1 : Notwithstanding any provision of the Rancho
Palos Verdes Municipal Code , or other ordinance of the City
of Rancho Palos Verdes , no environmental assessment, building
permit, coastal permit or other permit or entitlement for
use , construction, development or establishment of any
structures or buildings (excluding additions to existing
structures or buildings , geologic investigations , and
environmental assessments related to the preparation of
specific plans ) , or for any grading which requires issuance
of a permit under the Building Code , shall be issued , and no
subdivision map shall be approved , nor shall applications for
such permits or subdivision maps be accepted for processing ,
nor shall any application that has been submitted to the City
but is incomplete on the adoption of this ordinance be
further processed , for the property within the portions of
Coastal Subregions 1 , 7 or 8, and the switchback area of
Palos Verdes Drive East ( individually or collectively) ,
designated on the maps attached as Exhibit A and hereinafter
referred to as the "Study Areas " , until detailed specific
plans have been adopted by the City Council and certified by
the California Coastal Commission covering the property
proposed to be developed pursuant to said application(s) .
Section 2 : On April 5, 1988 the City Council authorized
the preparation of specific plans for the Study Areas . It is
the intent of the City Council and its Environmental Services
Department, with the anticipated cooperation of affected
property owners and residents of the community, to examine
the Study Areas to determine the adequacy of the coastal
specific plan for such areas , whether the coastal specific
plan should be amended , and to prepare more detailed specific
plans addressing development in the Study Areas . However ,
pending preparation of such specific plans by the City, a
specific plan and an environmental assessment application to
accompany the specific plan, may be prepared by any property
owner within the Study Areas and may be submitted to the
City for processing in conformity with Article 8, Chapter 3,
Division I , Title 7 of the California Government Code
governing the preparation and processing of specific plans .
Any specific plan submitted by a property owner shall be a
detailed master plan addressing development in the entire
specific plan district within which the property is located,
unless the Director of Environmental Services determines that
such plan should be more limited in scope .
Section 3 : Major portions of the Study Areas are within
the City's coastal zone and comprise nearly all of the vacant
remaining land adjacent to the coastline in Rancho Palos
Verdes . There is at the present time no ordinance adequately
regulating the grading of property and the development of
structures and buildings on properties within the Study
Areas , particularly in light of proposed changes in permitted
land uses within and adjacent to portions of the Study Areas
which would significantly increase the amount of commercial
development within the City's coastal zone . Although the
coastal specific plan, adopted in 1978, generally addresses
development for those portions of the Study Areas in the
coastal zone , it does not adequately address the changes in
land use currently being proposed . Further , the coastal
specific plan is not sufficiently detailed , and must be
reexamined and studied to determine whether it contains
sufficient regulations to ensure that development in the
Study Areas occurs at an appropriate scale and density,
consistent with the size, topography, and circulation system
capacities of the area , with no unnecessary alterations to
existing land f orms . Further, through reexamination of the
coastal specific plan and preparation of detailed specific
plans , the City desires to ensure that any development that
occurs will preserve significant public and private views
over the area, provide for adequate public coastal access ,
open space , and recreation opportunities , and is evaluated in
terms of the fiscal and public service impact on the City and
its residents .
Section 4 : The Study Areas contain a large number of
vacant lots where inadequately regulated.development, and
hastily considered changes in land use, will potentially
create adverse and irreversible land use effects and hazards .
Applicable zoning presently lacks adequate land use control
to ensure the orderly development of structures and buildings
in said areas . The unregulated grading and proliferation of
buildings and structures would cause adverse impacts on the
use, enjoyment, and value of property within the City.
Section 5 : The unregulated establishment of any
buildings or structures that would conflict with future
regulations would be detrimental to the public health,
safety, or welfare of the community. Therefore , with the
absence of an approved specific plan which focuses in detail
on the Study Areas and provides sufficient development
regulations , this ordinance is necessary for the immediate
preservation of the public health safety and welfare .
Section 6: This ordinance shall expire and terminate

forty-five ( 45 ) days after the date of adoption hereof unless
extended by the City Council at a regularly noticed public
hearing.
II/ Section 7: This ordinance , being an interim ordinance
for the immediate protection of the public health, safety,
and welfare , and containing a declaration of the facts
constituting the urgency, and passed by a four-fifths
( 4/5ths ) vote of the Council , shall take effect immediately
upon its adoption.
