ORDINANCE NO. 187
AN ORDINANCE OF THE CITY OF RANCHO PALOS VERDES
APPROVING CODE AMENDMENT NO. 18 AND AMENDING THE
RANCHO PALOS VERDES MUNICIPAL CODE TO ESTABLISH
STANDARDS FOR THE NEW ZONES IN THE EASTVIEW AREA
WHEREAS, the City Council has initiated Code Amendment No. 18; and
WHEREAS, the Planning Commission has held public hearings on this
matter on March 27, May 8, May 22, and June 12, 1984, and has recommended
approval in Resolution P.C. No. 84-17; and
WHEREAS, the City Council has held a public hearing on this matter
on August 7, and September 18, 1984„ at which time all interested parties were
given an opportunity to be heard and present evidence.
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF RANCHO PALOS VERDES
DOES ORDAIN AS FOLLOWS:
Section 1: The City Council has reviewed and considered the contents
of Environmental Assessment No. 450 Initial Study and Negative Declaration in
reaching its decision on Code Amendment No. 18.
Section 2: The City Council finds that the Code Amendment is
consistent with and will implement the adopted General Plan (Amendment No. 14).
Section .3: CHAPTER 17.02 of the Rancho Palos Verdes Municipal Code is
amended by amending the Chart following Section 17.02.030 Development Standards.

6. A garage with entrance perpendicular to the street shall not be less
than twenty feet from the street-side property line.
Section 4: CHAPTER 17.16 of the Rancho Palos Verdes Municipal Code
is amended by amending Section 17.16.010 to read:
17.16.010 PURPOSE. The commercial districts provide for the development and
uses involving the retail sale of goods, the provision of services to the
public, and office functions. Five districts have been created in order
that the site, intensity, type of use, and location can be controlled and
made consistent with the objectives and locations designated by the g eneral
plan of the city. (Ord. 75-78 (part), 1975).
Section 5: The Table following Section 17.16.040 is amended to read:

1. The remainder may be used for parking, provided effective buffering and
screening techniques are incorporated into the landscaped area between the
parking area and the street.
2. Buffering and screening techniques shall be utilized on the district
boundary line, in order to mitigate the adverse impacts caused by adjacent
incompatible uses.
3. No parking shall be allowed in this setback area.
4. The provisions of Chapter 17.42 shall also apply.
5. Within this setback no activity shall be permitted except as approved by
the Planning Commission.
6. Where street is a major state highway arterial.
Section 6: ARTICLE II of Title 17 of the Rancho Palos Verdes Municipal
Code is amended by adding Chapter 17.23 to read:
CHAPTER 17.23
COMMERCIAL GENERAL (CG) DISTRICT
SECTIONS:
17.23.010 PURPOSE.
17.23.020 USES PERMITTED.
17.23.030 USES ALLOWED BY CONDITIONAL USE PERMIT.
17.23.010 PURPOSE. The District permits retail, service, and
administrative uses which main purpose is to serve the surrounding
area and visitors to the area.
17.23.020 USES PERMITTED. Uses allowed in Sections 17.18.020 and
17.20.020 and a wider range of uses including such uses as major
department stores; major hardware, home improvement stores;
appliance stores; furniture stores; and any similar uses as determined
by the Director. Such determination may be appealed to the Planning
Commission.
17.23.030 USES ALLOWED BY CONDITIONAL USE PERMIT.
A. Automobile Service Stations; car wash accompanying
auto service station.
B. Plant nurseries;

C. Hotels
D. Movie theaters, billiard halls, bowling alleys,
skating rings, and other similar commercial
recreational uses.
E. Commercial antennas.
F. Fitness Studio, Dance School, Computer School, and
other similar activity and educational uses.
Section 7: ARTICLE II of the Rancho Palos Verdes Municipal Code is
amended by adding Chapter 17.29 to read:
CHAPTER 17.29
CEMETERY (C) DISTRICT
SECTIONS:
17.29.010 PURPOSE.
17.29.020 USES AND DEVELOPMENT PERMITTED.
17.29.030 GENERAL DEVELOPMENT STANDARDS.
17.29.010 PURPOSE. The Cemetery District provides for the permanent
interment of human remains.
17.29.020 USES AND DEVELOPMENT PERMITTED. The following uses are
permitted in the cemetery district, with all new uses being subject
to a conditional use permit:
A. Burial park for earth interments, mausoleums for vault
or crypt interments, and/or columbarium for cinerary
interments.
B. Mortuary
C. Associated sales and office uses as related directly
to the operation of the cemetery including flower
sales.
17.29.030 GENERAL DEVELOPMENT STANDARDS. The following standards
shall apply to cemetery districts:
A. SETBACKS
1. Front and street side. The front and street side
setbacks shall be 25' from the property line.
2. Interior side and rear. If abutting a residential
district, the interior side and rear setbacks shall
be 40' . If abutting a non-residential district, the
interior side and rear setbacks shall be 25' .

B. BUILDING HEIGHT. The maximum height of any building
is 16' unless approval is granted by the Planning
Commission as part of a conditional use permit, but
not to exceed 30' .
C. ACCESS. Access to all cemetery districts shall conform
to subsection B of Section 17.44.060.
D. SIGNS. The provisions of Chapter 17.52 shall apply.
E. PARKING AND LOADING. The provisions of Chapter 17.44
shall apply.
F. STORAGE. All maintenance and groundskeeping equipment
located upon the property shall be housed in permanent,
entirely enclosed structures, unless being transported,
except for those outdoor uses permitted by a conditional
use permit.
G. LIGHTING.
1. Before any development is approved,a lighting plan
showing all exterior lighting and specifications there-
to shall be submitted for review.
H. Where a cemetery district abuts a residential district,
buffering and screening techniques shall be utilized in
the setback areas abutting the residential district.
Section 8: CHAPTER 17.52.060 of the Rancho Palos Verdes Municipal
Code is amended to read:
17.52.060 COMMERCIAL DISTRICTS: CL, CN, CP, AND CR.
Section 9: CHAPTER 17.52 of the Rancho Palos Verdes Municipal Code
is amended by adding 17.52.065 to read:
17.52.065 COMMERCIAL GENERAL (CG) DISTRICT.
A. Those signs listed in Section 17.52.040 shall be
permitted without permit.
B. Permanent identification signing shall be permitted
with permits subject to the following provisions.

1 • One major identification sign shall be permitted
on each building frontage wherein a public entry is
located, except that a sign shall be permitted upon
any street side of the building. Such signs shall not
exceed an area of one square foot for each lineal
foot of building frontage, up to a maximum of 100
square feet.
2. All faces of said signs shall be parallel to the
face of the building upon which said sign is located,
except that:
a. The director may approve other placement if he
finds that special ,conditions exist due to poor
visibility.
b. One additional under-canopy or other pedestrian-
oriented sign, not to exceed an area of three
square feet. Under-canopy signs shall be hung at
least eight feet above the sidewalk.
3. Signs shall not extend above the eave line or
parapet of the building.
4. Permanent Freestanding Signs.
a. A freestanding sign not to exceed six feet in
overall height may be permitted with the approval
of the director if it is the major identification
sign.
b. Any higher freestanding sign may be approved
by the Planning Commission for shopping centers
containing four or more individual establishments
having a wide frontage (two hundred feet or more),
or for large individual developments having a wide
frontage (200' or more) and a deep setback (40' or
more). The sign shall not exceed 16' .
5. Minor, pedestrian-oriented window signs not
exceeding in total area of all such signs, five
percent of the total window area of the face of the
building upon which such signs are mounted.
C. One temporary construction "announcement" sign may be
permitted with permit, provided that:
1. It may be displayed from the time the building
permit is issued until final inspection, or one year,
whichever is less;
2. It shall not exceed twenty square feet in area;

3. It shall not exceed eight feet in overall height;
4. If freestanding, it shall be placed a minimum of
five feet inside the property line.
D. "For Sale" signs on undeveloped property (of one acre
or more), with permits, provided that:
1. One such sign shall be displayed per street
frontage:
2. It shall not exceed twenty square feet in area;
3. It shall not exceed twelve feet in overall height;
4. It shall be placed no closer than five feet to
the property line;
5. Permits for such signs shall be issued for no
longer than a one-year period, on a renewable basis;

6. Such signs shall be removed upon the sale of the
property, if this occurs prior to the expiration of
the permit.
E. Temporary signs, banners, flags or pennants, to
promote special sales may be permitted with permit,
provided that:
1. All such signs and banners shall be mounted only
on a building, on a substantial extension of a build-
ing, or inside a window.
2. Permits for such temporary signs, banners, flags
or pennants shall not be issued for longer than a
thirty-day period (renewable) nor for more than a
total of one hundred twenty days in any one calendar
year; no more than two such temporary signs or banners
shall be displayed at any one time.
3. The director may approve, on an annual basis,
location on the structure, supports, letter style
and other significant elements of temporary sign
programs similar to those commonly utilized by
supermarkets, the copy of which are replaced at
intervals of fourteen days or less.
4. The director shall approve the location and
design of semipermanent price signs for service
stations.

5. Temporary window signs shall be allowed without
permit provided that the total area of such signs
shall not exceed ten percent of the total window area
of the face of the building upon which such signs are
mounted and shall not be displayed for more than
thirty days. Such signs exceeding ten percent of the
window area shall meet the other provisions of this
section.
F. One temporary identification sign may be displayed
with a permit for sixty days while applicant awaits
approval of a permanent sign.
G. Parking lot signing subject to the following:
1. Entry, exit and directional signs may be permitted
as necessary, with permits, to facilitate the safe
movement of vehicles served by the parking area
provided that:
a. There shall be no more than two such signs
located on any one street frontage of the parking
area unless additional signs are approved by the
director.
b. Each sign shall not exceed eight feet in
overall height and six square feet in area.
2. Liability and information signs may be permitted
within the area, with permits, provided that:
a. There shall be no more than two such signs
for each fifteen parking spaces;
b. Each sign shall not exceed eight feet in over-
all height and two square feet in area.
H. Illuminated signs shall be lighted only during and
up to one hour beyond the hours of operation of the
establishment or until 12:00 midnight whichever is
later.
Section 10: CHAPTER 17.52.070 of CHAPTER 17.52 of the Rancho
Palos Verdes Municipal Code is amended to read:
17.52.070 INSTITUTIONAL AND CEMETERY DISTRICTS.
A. Those signs listed in Section 17.52.040, shall be
permitted without permit.

B. Identification signs, directional signs, nameplates, bulletin boards,
and short-term temporary promotional signs may be permitted with
permits; provided, that:
1. The area of the proposed sign shall not exceed one square foot
per lineal foot of building frontage, up to a maximum of fifty
square feet. Freestanding signs shall not exceed six feet in
overall height and twenty square feet in area.
2. The Planning Commission may approve a total signing program for
an institutional or cemetery use and the director thereafter may
approve individual signs and issue permits, provided they conform to
the approved program.
Section 11: CHAPTER 17.52.080 of CHAPTER 17.52 of the Rancho
Palos Verdes Municipal Code is amended to read:
17.52.080 ADMINISTRATION.
A. It shall be the duty of the Director of Planning to enforce this
Chapter.
B. Nonconforming Signs. Except as provided in Subdivision 1 of this Sub-
section, legal sign in existence on the effective date of this Chapter,
or Eastview, existing as of January 5, 1983; which does not conform
to the provisions of this Chapter and which was in conformance with
the provisions of the title in existence as of December 1, 1975, or
January 5, 1983 for Eastview, shall, unless approved under the pro-
visions of subdivision 2 of this subsection, be removed or altered
so as to conform to the provisions of this Chapter within five years
from the date of receiving written notice from the city that said sign
is nonconforming. Any appeal of this determination must be made to
the planning commission within thirty days of receipt of the notice,
in writing, together with a fee as established by resolution of the
city council. The decision of the planning commission is final. Any
nonconforming sign which is damaged may be restored to original con-
dition provided that the cost of such restoration does not exceed
fifty percent of the replacement value of the sign and that the
restoration must be completed within thirty days from the date when
the damage occurred.
1. Signs with no permit shall be removed or altered so as to
conform to this Chapter within one hundred eighty days after the
date of receiving written notice from the city that said sign is
nonconforming.
2. Application may be made for approval of any existing sign. If
the Director approves an existing sign as being in compliance with
this Chapter, such sign will no longer be considered nonconforming.

C. Removal of Illegal Signs.
1. Any sign now or hereafter existing which no longer identifies
a bona fide business conducted, or no longer advertises a product
available for purchase by the public, or any sign which has been
constructed or erected, or is being displayed or poorly maintained,
in violation of the provisions of this Chapter, shall be taken down,
removed, or altered so as to comply, by the owner, agent, or person
having the beneficial use of the building or structure or land upon
which such sign may be found, within ten days after written notice to
do so from the Director of Planning. Failure to comply with such
notice shall constitute a violation of the zoning ordinance.
2. Any sign erected upon public property in violation of the pro-
visions of this Chapter may be removed by the Director of Planning or
his designated representative. (Ord. 90 §5 (part), 1977:
Ord. 75-78(part), 1975).
Section 12: CHAPTER 17.68, SECTION 17.68.060 of the Rancho Palos
Verdes Municipal Code is amended by adding sebsection F to read:
F. Through December 31, 2009, commercial buildings in the commercial
general (CG) district may be restored to original condition in the
event of destruction due to an involuntary act. Said construction
shall not extend the amortization period for any such structure.
