AN ORDINANCE OF THE CITY OF RANCHO PALOS
VERDES RELATING TO OFF ROAD VEHICLES AND
PENALTY PROVISIONS AND AMENDING THE RANCHO
PALOS VERDES MUNICIPAL CODE.
THE CITY COUNCIL OF THE CITY OF RANCHO
PALOS VERDES DOES HEREBY ORDAIN:
Section 1. Section 1.08.010 of Chapter
1.08, Title 1 , of the Rancho Palos Verdes Municipal
Code is amended to read:
1.08.010. Violations, a Misdemeanor.
(a) No person shall violate any provisions, or
fail to comply with any of the requirements of this Code.
Any person violating any of the provisions or failing to
comply with any of the requirements of this Code shall be
guilty of a misdemeanor unless such violation or failure to
comply is expressly stated by this Code to be an infraction.
Any person convicted of a misdemeanor under the provisions
of this Code shall be punishable by a fine of not more than
Five Hundred Dollars, or by imprisonment in the County Jail
for a period not exceeding six months, or by both such fine
and imprisonment. Each such person shall be guilty of a
separate offense for each and every day during any portion
of which any violation of any provision of this Code is
committed, continued, or permitted by such person and shall
be punishable accordingly.
(b) Infractions. Any person violating any
provision or failing to comply with any mandatory requirement
of this Code expressly stated by this Code to be an infraction
shall be guilty of an infraction. Any person convicted of
an infraction shall be punishable by:
(1 ) A fine of $25.00 for a first violation;
11/ (2 ) A fine of $50.00 for a second violation
of the same provision of this Code within one year;
(3 ) A fine of $75.00 for a third violation
of the same provision of this Code within one year;
(4 ) A fine of $100.00 for a fourth violation
of the same provision of this Code within one year;
(5) A fine of $250.00 for each additional
violation of the same provision of this Code within one
year.
Each person shall be guilty of a separate offense
for each and every day during any portion of which any
violation of any provision of this Code is committed,
continued or permitted by such person and shall be punishable
accordingly.
In addition to the penalties hereinabove provided,
any condition caused or permitted to exist in violation of
any of the provisions of this Code shall be deemed a public
nuisance and may ybe, by this City, summarily abated as such,
and every day such condition continues shall be regarded as
a new and separate offense.
Section 2. Chapter 10.04 of Title 10 of the
Rancho Palos Verdes Municipal Code is amended by adding
thereto Sections 10.04.030 and 10.04.040 to read:
10. 04.030. Repeal-Noisy Motor Vehicles. Notwith-
standing the provisions of Section 10.04.010 the Traffic
Ordinance is amended by repealing Section 7021 thereof.
10. 04.040. Off Road Vehicles. A person shall not
operate any motor vehicle ( including any motor cycle, trail
bike, dune buggy, motor scooter, or jeep) or the motor
thereof on any place other than a highway so as to disturb
the peace or quiet of any neighborhood or person by noise,
dust, smoke or fumes caused by such motor vehicle. Any
person, firm or corportion violating the provisions of this
section shall be guilty of an infraction and shall be
punishable as provided in Chapter 1.08 of Title 1 of the
Rancho Palos Verdes Municipal Code.
Section 3. Ordinance. If any section, subsection,
sentence, clause, phrase or other portion of this ordinance
is for any reason held to be invalid or unconstitutional,
such decision shall not affect the validity of the remaining
portions of this ordinance. The council hereby declares
that it would have passed this ordinance, and each section,
subsection, sentence, clause, phrase or other portion
thereof, irrespective of the fact that any one or more
sections, subsections, sentences, clauses, phrases or
portions had been declared invalid or unconstitutional.

Section 4. In certain areas of the City of Rancho
Palos Verdes off road vehicles are being operated on private
and public property in a manner so as to disturb the peace
and quiet of adjacent neighborhoods by causing noise, dust,
smoke or fumes, all in violation of the provisiosn of the
City's Traffic Ordinance. The City has been experienceing
difficulty in enforcing the applicable provisions of the
Traffic Ordinance and adoption of this ordinance will enable
the enforcement of those provisions. This ordinance is
therefore necessary for the preservation of the public
peace, health and safety, is an urgency ordinance and shall
take effect immediatley.
