AN ORDINANCE OF THE CITY OF RANCHO PALOS VERDES MAKING
MISCELLANEOUS REVISIONS TO THE TEXT OF THE DEVELOPMENT
CODE, 'AS CODE AMENDMENT NO. 13 AND AMENDING THE RANCHO
PALOS VERDES MUNICIPAL CODE
THE CITY COUNCIL OF THE CITY OF RANCHO PALOS VERDES DOES ORDAIN AS FOLLOWS:
Section 1: 17.02.020.A. of the Rancho Palos Verdes Municipal Code is hereby
amended to read:
Single family residential and associated accessory buildings for the residential
11/ use and occupancy of not more than one family and not more than one dwelling
unit per lot;
Section 2: 17.06.030.A. of the Rancho Palos Verdes Municipal Code is hereby
amended to read:
Single-family and multiple-family residential developments containing any type
of housing units, including cluster developments and other variations from the
standard tract pattern and development standards (except hotels, motels, boarding
houses or similar transient residential facilities) .
Section 3: 17.50.020 of the Rancho Palos Verdes Municipal Code is amended by
adding E. to read:
E. Any geological investigation which requires trenching and/or boring and/or
grading for access to the site.
Section 4: 17.50.070 of the Rancho Palos Verdes Municipal Code is amended
to read:
Criteria For Evaluation of Grading Application or Geology Permit:
Section 5: 17.50.070 is amended by adding F. to read:
F. Initial preparation of geologic reports: Prior to field research of
geologic reports, the City shall be contacted for issuance of an
engineering geologic exploration permit. Prior to issuance of an
exploratory permit the following shall be required:
1. A complete site plan showing all lot line boundaries.
2. Indicate ingress and egress routes to be used.
3. Indicate all grading to be undertaken for access routes
and trenching.
4. Indicate the location of all trenching and boring sites.
5. Indicate all equipment types to be used.
6. Indicate time frame in which the site will be restored to
natural and reseeding schedule.
7. A fee established by Resolution of the City Council shall be
collected at the time of application.
8. A review of the application and associated information shall
be reviewed by the City Geologist prior to the issuance of
the permit.
Section 6: 17.16.060 of the Rancho Palos Verdes Municipal Code is amended
to read:
Commercial and Commercial Condominium Development or Stock Cooperatives
or similar Development:
All new commerical development shall be a part of an integrated totally
planned development. The developer of a proposed new development shall
apply for a conditional use permit, pursuant to Chapter 17.14 of this
Code and such developer's proposal shall be reviewed on the basis of its
own merits, conformity with the development standards in Section 17.16.030,
the standards in its respective District and other Chapter of this Code,
and the following criteria shall include, but not be limited to:
Section '7: 17„16.060.E. of the Rancho Palos Verdes Municipal-Code is amended
to read:
E. Compatability of architectural design with the character of the community,
such-design shall be subject to review by the Planning Commission.
Section 8: 17.16, of the Rancho Palos Verdes Municipal Code is amended
by adding 070 to read:
Development Plan and Supplemental Material
The following criteria shall apply but not be limited to:
A. A detailed development plan of the project which shall include:
1. Site Plan.
2. A preliminary floor plan, showing the estimated number of units.
3. Elevation drawings, showing exterior treatments.
4. Parking plan, showing vehicular access and circulation and
loading areas, the amount of parking shall conform to Title 17,
Chapter 44.
5. Plan showing land uses of adjacent property.
6. Calculations of area of common open space.
B. Detailed landscape plan indicating types and sizes of materials to be
used and enclosed trash areas.
C. Detailed plan (if applicable) indicating location of exterior lighting
fixtures, type of fixture and maximum wattage of fixtures.
D. Copy of CC&R's or other reciprocal agreement setting forth the occupancy
and management policies for the project to be reviewed by the Director
of Planning and the City Attorney. Said CC&R's shall comply with
Section 17.14.
E. Grading plan.
F. Calculations indicating the land area devoted to each proposed use in
the planned commercial condominium development and its percentage of
total area.
G. A map indicating any proposed division of land within the commercial
condominium development.
H. A time shcedule for information purposes, indicating when construction
is to begin, the anticipated rate of development and the approximate
completion date, including the phase construction.

D. A history of occupancy report including:
1. Rental rate history for the past five (5) years.
2. Nature of existing tenant business and length of
tenancy.
3. Proposed owner's association fees.
4. Names and addresses of all tenants.
5. Any other information as required by the Planning
Commission to assist in the review of the project.
E. A copy of the CC&R's for the property.
Section 12: 17.14 of the Rancho Palos Verdes Municipal Code is amended
to read:
Homeowners Association or Similar Organization.
Section 13: 17.14.020 of the Rancho Palos Verdes Municipal Code is
amended to read:
Standards:
The following standards shall be supplemental requirements necessary to
establish and maintain any new Homeowners Association, or similar
organization, in addition to standards and provisions set by other
applicable codes, ordinances and laws.
Section 14: 17.40.050.C. of the Rancho Palos Verdes Municipal Code is
amended to read:
C. Building Height. Unless determined to be a part of the main building,
decks, play houses, detached garages, pool or bathhouses, dressing
rooms, saunas, jacuzzi and pool enclosures, gazebos or any structures
or buildings which are incidental to the use of the main building are
considered accessory structures and have a maximum height limitation
of twelve feet measured from existing grade adjacent to the lowest
foundation wall to the ridge. Upon a finding by the Director of
Planning that a detached garage will have no significant view impact,
it can be exempted from this height limitation.
Section 15: 17.42.030.A.3 of the Rancho Palos Verdes Municipal Code is
amended to read:
Prohibit chain link, chicken wire and other similar types of fences and
fiberglass in front setback area. The area between the street and any
such fence described above shall be landscaped, per an approved plan,
in conjunction with the minor exception permit application.
Section 16: 17.42.030.C. of the Rancho Palos Verdes Municipal Code is
amended to read:
C. Fences for Recreational Facilities:
Fences over six feet in height, but not to exceed ten feet in height
(not within the required setback areas) or a combination of three and
one-half (3-1/2') foot retaining wall and recreational fencing of
ten (10) feet shall not exceed thirteen and one-half (13-1/2') feet
for downslope and sideyard fencing for tennis courts or similar
recreational facilities. The preceding may be permitted with a minor
exception permit provided that all of the structure above the six foot
height shall be constructed of wire mesh, or similar material, capable

of admitting at least ninety percent light as measured on a reputable
light meter. Upslope wall/fence combination shall not exceed Section
17.42.030.B.3.
Windscreens exceeding six feet in height may only be permitted with a
minor exception permit when the Director of Planning finds that views
from affected property will not be significantly adversely affected.
Section 17: 17.62.020 of the Rancho Palos Verdes Municipal Code is amended
to read:
The Director of Planning may grant minor exception permits authorizing up
to a twenty percent reduction in lot dimension, setback, and open space
requirements, upon the finding that such reduction is consistent with the
intents of this chapter, and the construction of fences exceeding forty-two
inches in height within the required front or street-side setback areas,
or walls or hedges exceeding six feet in height at any other location, and
other special case fences purusant to Chapter 17.42.In the Coastal Specific Plan
District any minor exception permit shall be in conformity with the policies and
requirements of the Coastal Specific Plan.
Section 18: 17.62.060.B. of the Rancho Palos Verdes Municipal Code is amended
to read:
B. The applicant or any other interested party may appeal the decision
of the Planning Commission to the City Council by filing a written
appeal together with the appeal fee established by Resolution of the
City Council.
Section 19: 17.62.060 of the Rancho Palos Verdes Municipal Code is amended
by adding C. -to read:
C. The City Council may do one of the following:
1. If the findings of the Commission do not, in the opinion of
the Council warrant further hearing, the Council may affirm
the decision of the Commission and dismiss the appeal.
2. If, in the opinion of the Council, said findings warrant
further hearing, the Council shall consider the appeal and
may reverse, affirm or modify any decision. If the Council
so desires, it may conduct a public hearing subject to the
same procedures and notification as required for Commission
hearings.
3. If significant new evidence, which may include substantial
changes to the original proposal, is presented in conjunction
with the appeal, the Council shall refer the matter back to
the Commission for further consideration and decision.
Section 20: 16.04 of the Rancho `Palos Verdes Municipal Code under definitions
is amended by adding 769 to read:
Mobile home shall mean a prefabricated structure relocated on a site and
placed on a permanent foundation.
