AN ORDINANCE OF THE CITY OF RANCHO PALOS
VERDES AMENDING ORDINANCE NO. 108U AS
AMENDED BY ORDINANCE NOS. 118U, 120U,
123U, AND 128U, AND DECLARING-THE
URGENCY THEREOF
THE CITY COUNCIL OF THE CITY OF RANCHO PALOS VERDES DOES HEREBY ORDAIN AS
FOLLOWS:
Section 1. Section 4 (b), (f) and (g) of Ordinance No. 108U as
amended by Ordinances No. 118U, 120U, 123U, and 128U, is amended to read as
follows:
(b) Replacement of a building or structure which has been
damaged or destroyed, providing said restoration will not aggravate the pres-
ent condition.
(f) Remedial grading to correct problems caused by
landslide.
Grading permits may be approved without the submission
of a geology study, under the following limitations and any other appropriate
conditions:
(1) Remedial grading involving redistribution of earth
materials within a local and contiguous area providing that the maximum verti-
cal height of cut or fill not exceed five (5) feet, except that fissures of
any depth may be filled to the level of the adjacent ground surface. Such
grading should be designed to reduce the local topographic relief and in no
case should fill be placed on a slope steeper than 20 degrees such that it
might cause a soil slip or mudflow.
(2) Where remedial grading on a residential lot in-
volves importation of fill material from a source outside of the lot, no more
than 100 cubic yards (150 tons) of fill material shall be imported within a
one year period.
(3) Remedial grading along roads should be restricted
to maintaining the roads in a safe and useable condition and to improving sur-
face drainage so that runoff water does not flow into closed depressions or
fissures. In areas adjacent to scarps the crests of the scarps should be
periodically lowered so as to reduce the volume of imported fill needed to
maintain the proper road grade on the downthrown sides of the scarps. In no
event shall remedial grading bring the road surface higher than the original
11/ grade.
(4) Except for the local redistribution of earth
material, there should be no exporting of materials from any part of the
Active Abalone Cove landslide.
(5) Stockpiling will be allowed for road repair and
remedial grading providing the stockpiles in any given area do not exceed
200 cubic yards and are not in graben areas.
(6) Earth materials suitable for fills could be ob-
tained from within the head of the Portuguese Bend landslide to the east of
Portuguese Canyon as shown on Plate 1 on file with the Environmental Services
Department.
(7) Where feasible, remedial grading should be de-
signed to improve surface drainage and in no case cause ponding or surface
runoff so as to increase the likelihood of surface water infiltrating into
the interior of the slide mass.
(8) Stockpiling of asphalt and road fill along
Palos Verdes Drive South will be allowed to continue providing stockpiles
are kept at locations shown on Plates 1 and 2 on file with the Environ-
mental Services Department.
(g) The City Council may also approve exemption of minor
projects (projects not involving new buildings) providing a geology study
is approved by the City geologist indicating that the project will not
aggravate the existing situation.
Exempted is the exchange of surface materials,
such as is undertaken at stables, where there is no net change in total
mass or the general distribution of mass.
Nothing contained in this section shall exempt or ex-
cept the proposed construction or use from any requirement or regulation
of the Building Code, Zoning Ordinance or other ordinance of the Rancho
Palos Verdes Municipal Code. Conditions may be attached to such permits,
such as non-suit covenants and sewer assessment agreements.
Section 2. In order to protect the public health, safety
and welfare it was necessary for the City of Rancho Palos Verdes to adopt
an urgency ordinance establishing a moratorium on certain permits in that
area of the City identified as the "Landslide Moratorium" area. Further
geology studies have now been completed and it is appropriate to make
certain modifications to the ordinance. This ordinance effecting said
modifications is necessary for the public peace, health, safety and wel-
fare and shall take effect immediately upon adoption as an urgency ordi-
nance.
