ORD 117 ORDINANCE NO. 117 AN ORDINANCE OF THE CITY OF RANCHO PALOS VERDES APPROVING ZONE CHANGE NO. 4 AND CODE AMENDMENT NO. 7 AND AMENDING THE RANCHO PALOS VERDES MUNICIPAL CODE WHEREAS, the City has initiated Zone Change No. 4 and Code Amendment No. 7; and WHEREAS, the City Council has held a public hearing on this matter on March 6 and March 20, 1979, at which time all interested parties were given an opportunity to be heard and present evidence; and WHEREAS, the Planning Commission has held a public hearing on this matter on February 13, February 27, and March 13, 1979, and has recommended approval in Resolution No. 79-5 (P.C.) ; NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF RANCHO PALOS VERDES DOES HEREBY ORDAIN AS FOLLOWS: Section 1: The City Council has reviewed and considered the final Environmental Impact Report and Environmental Assessment No. 336 in reaching its decision. Further, the City Council finds that the approval of this zone change and code amendment will not result in significant adverse environmental impact to the area. Section 2: The City Council finds that the zone change and code amend- ment are consistent with and implements the adopted Coastal Specific Plan and the General Plan. Section 3: The City Council of the City of Rancho Palos Verdes hereby approves Zone Change No. 4 pursuant to Exhibit "A" attached, amending the Official Zoning Map, and directs the City Clerk to cause said changes to be made to the Official Zoning Map. Section 4: The Rancho Palos Verdes Municipal Code, Article IX, is amended by adding Chapter 5, Part 3, subsection 9530, 9531, 9532, 9533 to read: Chapter 5, Part 3 -- Agricultural District - A 9530 PURPOSE The purpose of the Agricultural District is to provide for the preservation and restoration of agricultural uses. 9531 USES AND DEVELOPMENT PERMITTED Land in an Agricultural District may be used for the following: A. Agriculture and horticulture including the growing and raising of trees, vines, shrubs, berries, vegetables, nursery stock, flowers, hay grains and similar food and fiber crops. 9532 USES SUBJECT TO A CONDITIONAL USE PERMIT A. Temporary and permanent stands for the sale of agricul- tural products produced on the premises. B. Wholesale plant nurseries. C. Storage structures for equipment and supplies necessary for a permitted agricultural use. 9533 DEVELOPMENT STANDARDS The following standards apply to Agricultural Districts: A. Minimum lot size shall be five (5) acres. Smaller lot sizes may be permitted subject to a conditional use permit. B. Setbacks Twenty-five (25) feet from all property lines. C. Building height is limited to sixteen (16) feet. D. Where an Agricultural District abuts a residential dis- trict, buffering and screening techniques shall be utilized around any structures. Section 5: The Rancho Palos Verdes Municipal Code, Article IX, is amended by amending Chapter 5, Part 2, subsections 9524. B. 1, 2, 4, and 5, 9525. B. 1 and 4, 9526. A. 1, 2, 3, B. 1, 3, and C. 1 to read: Chapter 5, Part 2 -- Overlay Control Districts 9524, B. 1. All lands identified in the Natural Environment Element of the General Plan under category RM-5, Old Landslide Area, and of the Coastal Specific Plan under categories CRM-3, Hazard, CRM-4, Marginally Stable, and CRM-5, Insufficient Information. 2. All lands identified in the Natural Environment Element of the General Plan under category RM-6, Hydrologic Factors, and of the Coastal Specific Plan under categories CRM-7, Flood/Inundation Hazard, and CRM-8, Hydrologic Factors, including all identified major and minor natural drainage flows, existing storm channels and storm drains, proposed storm chan- nels and drains (at the time of effect of the Development Code) , and outfall areas. 4. All lands identified in the Natural Environment Element of the General Plan under category RM-8, Wildlife Habitat, and of the Coastal Specific Plan under category CRM-9, Wildlife Habitat. 5. All lands identified in the Natural Environment Element of the General Plan under category RM-9, Natural Vegetation, and of the Coastal Specific Plan under category CRM--10, Natural Vegetation, also including such areas as are within category RM-8 described above. 9525, B. 1. All land areas, structures and improvements described in the Historical Resourses Section of the General Plan and Coastal Specific Plan, and sites designated in specific information on file with the City Environmental Ser- vices Department, as well as any additional land areas, structures and improve- ments which may be designated by the City as being of historical significance. 4. General areas designated as archaeologically sensitive in the General Plan and Coastal Specific Plan, including all land and water areas within the City's jurisdiction to seaward of Palos Verdes Drive West and South; all undeveloped land areas south of Crest Road between Crenshaw Boulevard right-of-way and Hawthorne Boulevard. 9526, A. 1. Preserve, protect, and maintain land and water areas, structures, and other improvements which are of significant value to the public because of their recreational, aesthetic, and scenic qualities, as defined in the Visual Aspects portion of the General Plan and the Corridors Element of the Coastal Specific Plan. 2. Preserve, protect, and maintain significant views and vistas from major public view corridors and public lands and waters within the City which characterize the City's appearance as defined in the Visual Aspects portion of the General Plan and the Corridors Element of the Coastal Specific Plan. 3. Insure that site planning, grading, and landscape techniques, as well as improvement planning, design, and construction will preserve, pro- tect, and enhance the visual character of the City's predominant land forms, urban form, vegetation, and other distinctive features, as identified in the General Plan and the Coastal Specific Plan. Page 2 Ordinance No. 117 B. 1. All Visual Accents, View Corridors, Adjacent Lands, Impacting Corridors, and Viewing Areas, as generally defined by the General Plan and the Coastal. Specific Plan. 3. Delete C. 1. Result in the change in elevation of the land or con- struction of any improvement which would block, alter, or impair major views, vistas, or viewsheds in existence from designated view corridors, view sites, or view points at the dates of adoption of the General Plan and the Coastal Specific Plan in such a way as to materially and irrevocably alter the quality of the view as to arc (horizontal and vertical), primary orientation, or other characteristics. Section 6: The Rancho Palos Verdes Municipal Code, Article IX, is amended by amending Chapter 1, Part 1, subsection 9112 to read: Chapter 1, Part 1 -- Single Family Residential Districts - RS 9112 DEVELOPMENT STANDARDS The property development standards contained in the following chart shall apply to all land and structures in the RS Districts. For ex- ceptions and explanatory description of these standards; for standards of fences, walls and signs; and for off-site improvement and dedication re- quirements, see Chapter 6. A zoning designation followed by -(RPD) indi- cates that a Residential Planned Development is required, see Chapter 1, Part 3. Section 7: The Rancho Palos Verdes Municipal Code, Article IX, is amended by adding Chapter 1, Part 3, subsection 9131 to read: Chapter 1, Part 3 -- Residential Planned Development - RPD 9131 APPLICABILITY Add paragraph: The Residential Planned Development designation may be combined with any single family residential district, thereby requiring application for a Residential Planned Development, when the Council finds that such zoning is necessary to promote the policies of the General Plan and/or Coastal Specific Plan. The zoning designation on the Official Zoning Map is RS- (RPD) . Section 8: The Rancho Palos Verdes Municipal Code, Article IX, is amended by adding Chapter 5, Part 1, subsection 9515 to read: Chapter 5, Part 1 -- Specific Plan Districts New Section: 9515 COASTAL SPECIFIC PLAN DISTRICT In addition to the other provisions of this Code, the following special provisions shall apply in the Coastal Specific Plan District: A. Conditional Uses The following uses may be permitted, subject to a conditional use permit, in addition to those listed in the districts and in Chapter 7, Part 1: 1. Commercial center in Subregion 7, pursuant to the poli- cies of the Coastal Specific Plan. 2. Coastal-dependent development, pursuant to the Coastal Specific Plan and the Coastal Act of 1976. Page 3 Ordinance No. 117 B. Coastal Setback Zone The Coastal Setback Zone comprises an area in which new development is prohibited. Residential density credit will be granted only for areas proven to the City's satisfaction to be stable. No new permanent structures shall be allowed closer than twenty-five (25) feet to the Coastal Setback Zone. C.
