AN ORDINANCE OF THE CITY OF ,
RANCHO PALOS VERDES AMENDING
THE RANCHO PALOS VERDES MUNICIPAL
CODE BY PROVIDING FOR AN ANNUAL
INCREASE OF ENVIRONMENTAL EXCISE
TAXES AND DECLARING THE URGENCY
THEREOF
THE CITY COUNCIL OF THE CITY OF RANCHO PALOS VERDES DOES
HEREBY ORDAIN AS FOLLOWS:
Section 1. Article VI , Chapter 7 , Section
6703 of the Rancho Palos Verdes Municipal Code is hereby
amended to read as follows:
"6703 . Rates.
The rate of the environmental excise tax
hereby imposed is five hundred dollars ($500 ) per
bedroom, to a maximum of one thousand dollars
($1,000) per dwelling unit for residential build-
ings and thirty cents ($0 . 30 ) per square foot of
gross building area for new industr ial and commer-
cial buildings. The rates specified above shall be
changed on January 1 , 1979 , and on January 1st of
each year thereafter, as follows:
a) On January 1 , 1979 , such rates shall
be equal to an amount to be determined by adding
to the current rate the product obtained by
multiplying the average Gross National Product
deflator factor , for goods and services purchased
by state and local government, as published by the
United States Department of Commerce, for the four
(4 ) calendar quarters available prior to January 1 ,
1979, by such current rate.
b) On January 1st of each year thereafter,
all such rates shall be equal to an amount to be
determined by adding to the rate in the previous
calendar year the product obtained by multiplying
the average Gross National Product deflator
factor, for goods and services purchased by state
and local government, as published by the United
States Department of Commerce, for the four
(4 ) calendar quarters available prior thereto by
such rate in the previous calendar year. "
Section 2 . This Ordinance is necessary for
the immediate preservation of the public peace, health and
safety. The reasons for the urgency of this Ordinance are
as follows: On June 6 , 1978 , the voters of the State of
California approved an amendment to the California Constitu-
tion which seriously impairs the ability of the City to
raise tax revenues from the levy of an ad valorem tax on
property, and in turn provide adequate parks and recreation
services and facilities to the citizens, visitors, and
others in the City of Rancho Palos Verdes. The potential

loss of revenues due to the approval of such amendment would
occasion the curtailment of needed parks and recreation
services and facilities . The parks and recreation services
and facilities in the City of Rancho Palos Verdes provide a
municipal service which is particularly enjoyed by the youth
of the community, as well as senior citizens and charitable
organizations and societies. The very extistence of the
parks and recreation facilities assists in curtailing crime
and delinquency. Revenues derived from the environmental
excise tax are placed in a special fund for parks and
recreation services and facilities. Such amendment is to
take effect on July 1, 1978. It is therefore imprative that
the City immediately seek other methods of deriving revenues
so as to meet the needs of the City with respect to police
and fire protection, and other essential municipal services,
thereby preserving the public peace, health and safety.
This urgency Ordinance shall therefore take effect upon
adoption.
