AN ORDINANCE OF THE CITY OF RANCHO PALOS
VERDES CONCERNING THE MAINTENANCE, REMOVAL,
AND REPLACEMENT OF PARKWAY TREES, AMENDING
THE RANCHO PALOS VERDES MUNICIPAL CODE
THE CITY COUNCIL OF THE CITY OF RANCHO PALOS VERDES DOES ORDAIN AS FOLLOWS:
Section 1. Article VII of the Rancho Palos Verdes Municipal Code
is hereby amended by adding Chapter 2 thereto to read:
CHAPTER 2 - MAINTENANCE, REMOVAL AND REPLACEMENT
OF PARKWAY TREES
Section 7200. Definitions
The following words, as used in this Chapter, have the significance
attached to them in this Section, unless the context clearly requires a dif-
ferent meaning:
(a) The term, "Director of Public Works" or, "Director", as
used in this Chapter means the person having control and management of the Public
Works Department, or his designated representative.
(b) The term, "maintenance," or "maintain", as used in this
Chapter, means and includes pruning, topping, spraying, bracing, staking, treat-
ing for disease or injury, or other work performed to promote the life, growth,
health, or beauty of trees and shrubs, but shall not include the watering or •
fertilizing of such trees.
(c) The term "tree", as used in the Chapter, means and includes
any woody plant, normally having one stem or trunk bearing foliage or crown
well above the ground level to heights of sixteen feet or more upon maturity.
(d) The term "shrub", as used in this Chapter, means and includes
woody vegetation or a woody plant having multiple stems and bearing foliage
from the ground level up.
(e) The term "official tree", as used in this Chapter, means
and includes those trees designated and determined, or hereafter determined
by the Director of Public Works to be the best suited to plant along the City
streets because of their desirable characteristics of growth and beauty and
with reference to their crown, root structure, and adaptability to local climate
soil and street conditions. The Director shall keep a list of official trees
on file at his office available to the public during normal working hours.
III (f) The term "parkway" as used in this Chapter, means that
area between the curb or edge of roadway and the adjacent property line.
(g) The term "ground cover", as used in this Chapter, means
and includes grass, turf or perennial plants that normally grow in a prostrate
manner so as to conceal, or with the purpose of concealing, the ground surface,
and that do not exceed eight inches in height and that will tolerate light
pedestrian traffic.
Section 7201. Planting and Removal
The Director of Public Works shall regulate and control the planting
or removal of any and all trees planted along any City street. The Director
shall designate the species, kind, number, spacing and method of planting.
Provided, further, no tree shall be planted in a planting strip which
is less than thirty inches in width between the sidewalk and curb, except that

authority to provide for and enforce the removal of such v iolation by the
Department of Public Works. Such costs as are incurred by the Department of
Public Works in the removal or correction of such violation shall be billed
to the adjacent property owner.
Section 7208. Guards during Construction and Building Operations.
In the erection, alteration, construction, or repairing of any build-
ing or structure the owner thereof shall place, or cause to be placed, such
guards around all nearby trees located along the street, alley, court or other
public place as shall effectively prevent injury to them.
Section 7209. Certain Trees a Public Nuisance.
11/ Any tree, shrub or plant located on private property infested with a
disease or insect, which in the opinion of the Director of Public Works is
infectious and may spread such disease or insects to other trees or shrubs in
the City, shall constitute a public nuisance. The Director of Public Works
shall cause notice to be served upon such property owner directing that such
public nuisance be removed or abated within seven days. If such public nui-
sance is not abated or removed within seven days after notice is served, the
Director is hereby granted authority to direct Public Works Department employees
to enter said property and spray, trim, prune, treat or remove all or any part
of the tree or shrub determined to be infested or to otherwise abate or cause
to be abated such public nuisance. Any tree or shrub, growing or standing on
private property in such a manner that any portion thereof interfers with
electroliers lawfully erected, constructed or maintained along any public street,
sidewalk or restricts the flow of traffic or visibility of such streets, side-
walks or intersections thereof to any person or persons lawfully using the same
or any such tree which has become diseased or weakened in such a manner as to
be dangerous to persons lawfully using the streets or sidewalks, shall constitute
a public nuisance. The Director of Public Works shall cause notice to be
served upon such property owner directing that such public nuisance be abated
or removed within seven days. If such public nuisance is not abated or re-
moved within seven days after said notice is served, the Director is authorize;
to abate or cause to be abated such public nuisance by trimming, pruning, cut-
ting or removing all or such portion of such tree, shrub, or plant as may be
necessary to eliminate such interference, obstruction or condition.
Whenever it is necessary for the Director of Public Works to direct
the use of the City employees to abate, remove, or cause to be abated or
remove, public nuisances as contained in this Section, he shall determine the
cost of the work performed by City employees and bill the property owner the
cost of the work performed. Said costs if not paid within thirty (30) days
shall be a lien against the property.
Section 7210. Interference
No person shall prevent, delay or interfere with the Director of Public
Works, or any of his assistants, in the execution or enforcement of this Chapter;
provided, however, that nothing herein shall be construed as an attempt to pro-
hibit a public hearing before the City Council if an appeal is filed. Any per-
son aggrieved by any act of determination of the Director of Public Works, or
his assistants, in the exercise of the authority herein granted, shall have the
right of appeal to the City Council of the City of Rancho Palos Verdes whose
decisions, after public hearing of said matter, shall be final and conclusive.
