ORDINANCE NO. 16U
AN ORDINANCE OF THE CITY OF RANCHO PALOS VERDES RELATING TO
THE ZONING AND CLASSIFYING OF PROPERTY WITHIN THE CITY OF
RANCHO PALOS VERDES ON AN INTERIM BASIS, DECLARING A MORATORIUM
ON THE ISSUANCE OF BUILDING AND GRADING PERMITS IN CERTAIN AREAS,
AND MAKING THIS ISSUANCE SUBJECT TO ENVIRONMENTAL IMPACT
REPORT PROCEDURES IN THE REMAINDER OF THE CITY, ADOPTING THE
LOS ANGELES COUNTY ZONING ORDINANCE, NO. 1494 BY REFERENCE
AND DECLARING THE URGENCY THEREOF
WHEREAS, the City of Rancho Palos Verdes was incorporated on the 7th day of
September, 1973. Among its first actions was the adoption on September 7, 1973
of Ordinance No. 3 captioned "AN ORDINANCE OF THE CITY OF RANCHO PALOS VERDES RELAT-
ING TO ZONING AND CLASSIFYING OF PROPERTY WITHIN THE CITY OF RANCHO PALOS VERDES
ON AN INTERIM BASIS AND DECLARING THE URGENCY THEREOF." Section 8 of that Ordin-
ance provides that, one of the purposes supporting the Council's action was a desire
to preserve the status quo and thus permit this City to conduct the necessary
studies in order to determine the appropriate zoning and development controls which
are to be applied to real property in this City.
In addition to that desire which still exists, it is both necessary to proper
planning in the City and required by state law that this City Council adopt a General
Plan to guide the future development of the City of Rancho Palos Verdes. Before a
General Plan and development controls can be adopted, this City Council intends to
invite and encourage the broadest community participation in the definition of
community goals so that the General Plan which is -adopted truly represents the long
range goals of this City. There will be many meetings with members of the community,
consultants and other advisors before any General Plan can be presented for formal
approval by this City Council. Because of the seriousness which this City Council
attaches to a General Plan, and its desire to involve the community in the preparation
of this document, it is likely that it will be many months before a General Plan
and development controls are adopted by this City.
The City Council therefore is adopting this Ordinance with the intent of" ma-in
taining the status quo, or alternatively phrased, maintaining its ability to properly
general plan the City without having development take place during the planning
process which preempts or otherwise limits the effectiveness of the City's General
Plan, while at the same time attempting to permit at least controlled development in
those portions of the City the character of which has already been established by
existing development.
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF RANCHO PALOS VERDES DOES
ORDAIN AS FOLLOWS:
Section 1. Los Angeles County Zoning Ordinance, as adopted and in effect on
September 7, 1973, being Ordinance No. 1494, is hereby adopted by reference as the
interim zoning ordinance of the City of Rancho Palos Verdes for a period of eight
,.-months from the date hereof.
Section 2. All properties within the City of Rancho Palos Verdes are hereby
zoned and classified to the RA-1 (1 acre) zone.
Section 3. Notwithstanding any other Ordinance or Code of the City of Rancho
Palos Verdes, no building permit or grading permit shall be issued as to any property
located in that portion of the City of Rancho Palos Verdes outlined in red upon that
map attached hereto as Exhibit "A" and incorporated herein by this reference. This
moratorium on building and grading shall expire eight months from the date of
adoption of this Ordinance unless otherwise specifically extended or terminated by
action of this City Council.
Section 4. Notwithstanding any other Ordinance or Code of the City of Rancho
Palos Verdes, no building permit or grading permit shall be issued unless there is,
and can be made, a finding that the construction or grading will not have a significant
effect on the environment. The City Manager shall be in charge of the administration
of the procedures necessary for the preparation and consideration of the environmental
impact reports necessitated by this section. Appeals from determinations regarding
the need for, or sufficiency of environmental impact reports made by either the City
Manager or his designated agent shall be heard and determined by the City Council.
The City Manager may recommend and the City Council may adopt by resolution procedures,
criteria and standards of evaluation to be utilized in the administration of this
section.
Section 5. Ordinance No. 9 of the City of Rancho Palos Verdes is hereby
repealed.
Section 6. Declaration of Urgency. The City of Rancho Palos Verdes has
just become incorporated as a general law city, on September 7, 1973. The City
Council intends to conduct studies forthwith, and further intends to consult with
its Planning Advisory Committee and Planning Commission when appointed, to conduct
studies within a reasonable time, as to the appropriate zoning and land use class-
ification with respect to all properties now within the City limits of the City, and
the adoption of a General Plan. It is necessary for the immediate preservation of
the public peace, health, safety and welfare that this Ordinance take effect immediately,
and permit certain highly regulated single family residential developments to proceed,
while otherwise prohibiting grading or building. By reason of the foregoing and
consistent with Section 65858 of the Government Code, this ordinance shall take
effect immediately.
