CC SR 20170516 R - RPVEA MOURANCHO PALOS VERDES CITY COUNCIL AGENDA REPORT AGENDA DESCRIPTION: MEETING DATE: 05/16/2017 AGENDA HEADING: Consent Calendar Consideration and possible action regarding a First Amendment to the Memorandum of Understanding (MOU) with the Rancho Palos Verdes Employee Association (RPVEA) RECOMMENDED COUNCIL ACTION: 1) Adopt Resolution No. 2017- A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF RANCHO PALOS VERDES, COUNTY OF LOS ANGELES, STATE OF CALIFORNIA, APPROVING AND ADOPTING THE FIRST AMENDMENT TO THE MEMORANDUM OF UNDERSTANDING BETWEEN THE CITY OF RANCHO PALOS VERDES AND THE RANCHO PALOS VERDES EMPLOYEE ASSOCIATION; 2) Adopt Resolution No. 2017- A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF RANCHO PALOS VERDES, COUNTY OF LOS ANGELES, STATE OF CALIFORNIA, APPROVING AND ADOPTING A REVISED THE SALARY AND HOURLY SCHEDULE FOR THE COMPETITIVE, CONFIDENTIAL, MANAGEMENT AND PART-TIME CLASSIFICATIONS; AND RESCINDING RESOLUTION NO. 2016-27; and, 3) Waive the provision in Administrative Instruction No. 2-20 related to placing items on two City Council meeting agendas. Administrative Instruction No. 2-20 (page C-1) BACKGROUND AND DISCUSSION: The City is completing the recruitment for an Executive Staff Assistant position in the City Manager's Office. Staff believes that it is necessary and appropriate for this to be a 1 Confidential Position in that the selected candidate will be expected to handle the preparation of documents and correspondence related to labor negotiations with RPVEA. The City is also preparing to add a Cable TV Station Manager position as a full-time City position (rather than a contract position). The City's labor relations representatives and RPVEA representatives have met and conferred and negotiated a First Amendment to the Memorandum of Understanding (MOU) between the City and RPVEA, which was adopted by Resolution No. 2015-110 on December 15, 2015. Staff is recommending the City Council adopt Resolution 2017- _ (Attachment A) to approve the First Amendment and its revised Exhibit "A", which expressly removes the Executive Staff Assistant classification from the bargaining unit represented by RPVEA and therefore from representation by RPVEA, and at the same time adds the new classification of Cable TV Station Manager to Exhibit "A" and to the bargaining unit represented by RPVEA. This First Amendment and its revised Exhibit "B" also removes the Executive Staff Assistant classification from the prior Competitive Positions category and places it within the Confidential Positions category, but at the same salary level. In addition, this First Amendment and the revised Exhibit "B" adds the new classification of Cable TV Station Manager to the Competitive Positions category with the defined salary range set forth in the attached Exhibit "B." Staff is also recommending the City Council adopt the Resolution No 2017 - (Attachment B) to revise the Salary Schedule to reflect the changes discussed above, and as required by the Personnel Rules. Lastly, while Administrative Instruction No. 2-20 (Attachment C) does not explicitly state that an amendment to an MOU is required to be placed on a City Council agenda twice, as it does with a Tentative Agreement, Staff is recommending that City Council affirmatively waive the provisions of the policy in relation to this First Amendment to the RPVEA MOU. ALTERNATIVES: In addition to the Staff recommendations, the following alternative action is available for the City Council's consideration: Discuss and provide additional direction to Staff. 2 RESOLUTION NO. 2017- A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF RANCHO PALOS VERDES, COUNTY OF LOS ANGELES, STATE OF CALIFORNIA, APPROVING AND ADOPTING THE FIRST AMENDMENT TO THE MEMORANDUM OF UNDERSTANDING BETWEEN THE CITY OF RANCHO PALOS VERDES AND THE RANCHO PALOS VERDES EMPLOYEE ASSOCIATION WHEREAS, the City of Rancho Palos Verdes (City) has and continues to recognize the Rancho Palos Verdes Employee Association (RPVEA) as the exclusive employee organization representing certain expressly delineated positions with the City's Competitive Unit; and, WHEREAS, the City labor relations representatives and RPVEA representatives have met and conferred and agreed to remove Executive Staff Assistant classification from the bargaining unit represented by RPVEA and therefore from representation by RPVEA, subject to City Council determination and approval, which is made a part hereof by this reference; and, WHEREAS, the City labor relations representatives and RPVEA representatives also met and conferred to negotiate adding the new classification of Cable TV Station Manager to the bargaining unit represented by RPVEA, subject to City Council determination and approval, which is made a part hereof by this reference; and, WHEREAS, the City Council now desires to amend the current MOU between the City and RPVEA to reflect the aforementioned changes. City Clerk 01203.0021/276084.1 A-2 FIRST AMENDMENT TO MEMORANDUM OF UNDERSTANDING City of Rancho Palos Verdes ,O Ml Rancho Palos Verdes Employees Association Expires on June 30, 2017 A-3 FIRST AMENDMENT TO MEMORANDUM OF UNDERSTANDING between the City of Rancho Palos Verdes and the Rancho Palos Verdes Employees Association Pursuant to the requirements of the Meyers-Milias-Brown Act ("MMBA," commencing at California Government Code § 3500 et seq.) the City of Rancho Palos Verdes ("CITY") has recognized the Rancho Palos Verdes Employees Association ("RPVEA") as the majority or exclusive representative, as those terms are interchangeably used under the MMBA, for those CITY employees in the bargaining unit defined as non -management, full-time employees in the classifications listed on Exhibit "A" to the Memorandum of Understanding between the CITY and RPVEA for the period through June 30, 2017 ("RPVEA MOU 2014-17"), adopted by Resolution No. 2015-110 on December 15, 2015. This First Amendment to the RPVEA MOU 2014-17 is entered into this 16th day of May, 2017, by and between the CITY and RPVEA. This First Amendment shall only become effective upon City Council adoption and makes only those changes reflected herein below, all other terms and conditions of the RPVEA MOU 2014-17 remaining the same. Background/Purpose This Policy shall apply when the City negotiates a Tentative Agreement, a Memorandum of Understanding, or an amendment to a Memorandum of Understanding with a recognized employee organization. II. Policy A. Negotiations Team. The City's lead negotiator may not be a City employee. The City Manager may select the members of the negotiations team and present them to the City Council for consent. B. Fiscal Analysis. The City's Department of Finance shall prepare a fiscal impact analysis of a Tentative Agreement, a proposed Memorandum of Understanding, or a proposed amendment to a Memorandum of Understanding unless the City Council directs that a fiscal impact analysis shall not be obtained. If the City Council so directs, the fiscal impact analysis may be reviewed by an independent certified accountant who is not a public employee. C. Publication of Accepted Meet & Confer Proposals. If a meet and confer proposal relating to a Tentative Agreement, Memorandum of Understanding, or an amendment to a Memorandum of Understanding is accepted by the party to which it is presented, the proposal and the fiscal impact analysis shall be posted on the City's website. D. Action on Tentative Agreement. The City Council may take action to accept or reject a Tentative Agreement only after the Tentative Agreement has been placed on the agenda at a minimum of two City Council meetings that are held at least two weeks apart. Government Code section 3505.1 requires a governing body to vote to accept or reject a tentative agreement within 30 days of the date it is first considered at a duly noticed public. If the implementation of this rule would result in the City Council failing to act on a Tentative Agreement within 30 days of the date the Tentative Agreement is first considered at a duly noticed public meeting, the City Council may waive this requirement or call the second meeting as a special meeting within the 30 days.
