PC RES 2004-053P.C. RESOLUTION NO. 2004-53 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF RANCHO PALOS VERDES CONDITIONALLY APPROVING CASE NO. ZON2004-00542, FOR A REVISION TO VARIANCE NO. 482 AND GRADING PERMIT 2239, ALLOWING THE CONVERSION OF 600 SQUARE FEET OF UNDERFLOOR AREA UNDER THE GARAGE TO HABITABLE/USABLE AREA, THEREBY RESULTING IN A 6,531 SQUARE FOOT RESIDENCE WITH ATTACHED GARAGE ON PROPERTY LOCATED AT 2967 CREST ROAD (APN 7566-001-023). WHEREAS, on April 24, 2001, the Planning Commission approved Variance No. 482 and Grading Permit No. 2239, allowing the construction of a new 5,931 square foot, split- level, two-story residence with a total of 919 cubic yards of associated grading on a vacant downward sloping lot located at 2967 Crest Road (APN 7566-001-023); and, WHEREAS, on December 9, 2003, the City issued a building permit for construction of the new residence, and, WHEREAS, during construction, the property owner identified an opportunity to expand the usable area of the residence by converting the crawispace into habitable space since the area was being excavated and enclosed, and, WHEREAS, on October 12, 2004, Variance and Grading Permit applications were submitted, requesting a revision to the previously approved entitlements to allow for an additional 600 square feet of habitable/usable space to the residence, resulting in a 6,531 square foot residence (garage included), and, WHEREAS, the City deemed the applications complete on November 10, 2004, and, WHEREAS, pursuant to the provisions of the California Environmental Quality Act, Public Resources Code Sections 21000 et. seq. ("CEQA"), the State's CEQA Guidelines, California Code of Regulation, Title 14, Section 15000 et. seq , the City's Local CEQA Guidelines, and Government Code Section 65962.5(f) (Hazardous Waste and Substances Statement), Staff found no evidence that Case No ZON2004-00542 would have a significant effect on the environment and, therefore, the proposed project has been found to be categorically exempt under Class 1 (Section 15301) since the project does not intensify the use of the lot since the property is currently approved for, and being developed with a single-family residence; and, WHEREAS, on December 14, 2004, the Planning Commission held a duly noticed public hearing, at which time all interested parties were given an opportunity to be heard and present evidence NOW, THEREFORE, THE PLANNING COMMISSION OF THE CITY OF RANCHO PALOS VERDES DOES HEREBY FIND, DETERMINE, AND RESOLVE AS FOLLOWS. Section 1: Although the habitable/usable area of the residence is increasing by 600 square feet, to a total structure size of 6,531 square feet (garage included), the conversion will not affect the physical aspects of the approved project and the residence will not appear to be greater in size since the conversion occurs under the building footprint. Section 2: The residence will continue to be compatible with the immediate neighborhood since the size is within the structure size range of the immediate neighborhood and since the conversion will not affect the visual characteristics of the approved residence Section 3: Any interested person may appeal this decision or any portion of this decision to the City Council Pursuant to Section 17 02 040.C.1.j of the Rancho Palos Verdes Municipal Code, any such appeal must be filed with the City, in writing, and with the appropriate appeal fee, no later than fifteen (15) days following the date of the Planning Commission's final action Section 4: For the foregoing reasons, and based on the information and findings included in the Staff Report, Minutes and other records of proceedings, the Planning Commission of the City of Rancho Palos Verdes hereby approves Case No ZON2004- 00542, for a revision to Variance No. 482 and Grading Permit No. 2239, subject to the conditions contained in Exhibit "A", attached hereto and made a part hereof, which are necessary to protect the public health, safety, and welfare. SUBJECT TO REVIEW AND APPROVAL BY THE BUILDING OFFICIAL, A STRUCTURE SIZE CERTIFICATION IS REQUIRED BY A LICENSED SURVEYOR, ENGINEER OR ARCHITECT PRIOR TO BUILDING PERMIT FINAL. 2. All other conditions associated with Variance No. 482 and Grading Permit No 2239, approved by the Planning Commission on April 24, 2001, shall remain in full force and effect. P.C.
