RESOLUTION NO. 2004-36 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF RANCHO PALOS VERDES DENYING WITHOUT PREJUDICE A HEIGHT VARIATION ANO GRADING PERMIT FOR THE DEMOLITION OF AN EXISTING ONE-STORY RESIDENCE AND CONSTRUCTION OF A NEW 9,030 SQUARE FOOT TWO-STORY RESIDENCE, AND CONDUCT 924 CUBIC YARDS OF GRADING ON A PAD LOT LOCATED AT 3046 CROWNVIEW DRIVE (CASE NO. ZON2.004-00140). WHEREAS, on March 25, 2004, the applicant, Jerry Rodin, representing property owners Allen and Charlotte Ginsburg, submitted a Height Variation application and Grading Permit application (hereinafter referred to as ZON2004-00140), requesting approval for the construction of a new 9,030 square foot two-story residence with an overall height of 26 - feet, and 924 cubic yards of grading, for property located at 3046 Crownview Drive; and, WHEREAS, on April 22, 2004, the applications were deemed incomplete pending the submittal of additional information and construction of the temporary silhouette; and, WHEREAS, on July 8, 2004, upon submittal of the required information and the construction and certification of the temporary silhouette, Staff deemed the applications generally complete for processing; and, WHEREAS, pursuant to the provisions of the California Environmental Quality Act, Public Resources Code Sections 21000 et. seq ("CEQA"), the State's CEQA Guidelines, California Code of Regulation, Title 14, Section 15000 et seq , the City's Local CEQA Guidelines, and Government Code Section 65962.5(f) (Hazardous Waste and Substances Statement), Staff found no evidence that ZON2004-00140 would have a significant effect on the environment and, therefore, the proposed project has been found to be categorically exempt under Class 3 (Section 15303) since the project involves the construction of one new single-family residential structure; and, WHEREAS, after notice issued pursuant to the requirements of the Rancho Palos Verdes Development Code, the Planning Commission held a duly noticed public hearing on August 24, 2004, at which time all interested parties were given an opportunity to be heard and present evidence NOW, THEREFORE, THE PLANNING COMMISSION OF THE CITY OF RANCHO PALOS VERDES DOES HEREBY FIND, DETERMINE, AND RESOLVE AS FOLLOWS. Section 1: The proposed addition is not compatible with the immediate neighborhood character with regards to size and mass The resulting structure size deviates from the sizes evident in the immediate neighborhood, where the new 9,030 square foot residence will be 155% larger than the average structure size and 3,499 square feet larger than the largest structure in the immediate neighborhood, or 63% larger. Thus, the project is so much larger than the biggest structure and so much larger than the average structure size Further, the structure itself is massive and does not appear proportional to, and overwhelms the pad. Lastly, since the size of the residence deviates from the characteristics of the neighborhood, it translates into the mass of the structure Section 2: Any interested person may appeal this decision or any portion of this decision to the City Council. Pursuant to Section 17.02.040.0 1J of the Rancho Palos Verdes Municipal Code, any such appeal must be filed with the City, in writing, and with the appropriate appeal fee, no later than fifteen (15) days following the date of the Planning Commission's final action.
