PC RES 2003-004A P.C. RESOLUTION NO. 2003-04 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF RANCHO PALOS VERDES APPROVING, WITH CONDITIONS, SITE PLAN REVIEW (CASE NO. ZON2002-00570), THEREBY ALLOWING THE PLACEMENT OF EIGHT (8) AIR CONDITIONING UNITS TO BE PLACED ON THE ROOF OF THE FUTURE SMART & FINAL WAREHOUSE GROCERY STORE IN THE WESTMONT PLAZA SHOPPING CENTER LOCATED AT 28500 WESTERN AVE., AND TO ALLOW THE ADDITION OF MINOR ARCHITECTURAL FEATURES TO THE FRONT FACADE AND IMMEDIATE SIDES OF THE EXISTING BUILDING. WHEREAS, on December 13, 2002, the applicant, Tarlos and Associates, submitted an application for a Site Plan Review for the Westmont Plaza Shopping Center (Case No ZON2002-00570), requesting approval for the placement of eight (8) air conditioning units on the roof of the future Smart & Final building and for minor physical architectural improvements to the front fagade and immediate sides of the commercial building, and, WHEREAS, on December 19, 2002, Staff deemed the applications generally complete for processing; and, WHEREAS, pursuant to the provisions of the California Environmental Quality Act, Public Resources Code Sections 21000 et seq ("CEQA"), the State's CEQA Guidelines, California Code of Regulations, Title 14, Section 15000 et seq , the City's Local CEQA Guidelines, and Government Code Section 65962.5(f) (Hazardous Waste and Substances Statement), Staff found the submitted Site Plan Review application (Case No 2002-004570) to be categorically exempt from the preparation of an environmental document since the proposed project does not intensify the use of the lot. (Section 15270), and, WHEREAS, after notice issued pursuant to the requirements of the Ranchos Palos Verdes Development Code, the Planning Commission held a duly noticed public hearing on February 11, 2003, at which time all interested parties were given an opportunity to be heard and present evidence NOW, THEREFORE, THE PLANNING COMMISSION OF THE CITY OF RANCHO PALOS VERDES DOES HEREBY FIND, DETERMINE AND RESOLVE AS FOLLOWS Section 1: That the approved project is a for eight (8) air conditioning units, which are to be placed on the roof of the future Smart & Final building in the Westmont Plaza Shopping Center located at 28500 Western Ave. and that the approved project is to allow the addition of minor architectural features to the front and immediate sides of the commercial building Section 2: That the equipment and/or features may be erected above the City's height limits pursuant to the requirements of the building code given that the only place to install air conditioning units safely, which are needed to cool food and guests to the store, is on the roof of the building of which are allowed when reviewing what is being proposed against the building code. That the new front fagade of the building will not structural interfere with the building and will comply with all uniform building codes given that the physical changes to the building are for cosmetic purposed only and not structural. P C Resolution No. 2003-04 Page 1 of 2 Ham: Section 3: That the equipment and/or features will not cause significant view impairment to adjacent properties given that none of the adjacent residential properties contain a significant view, according to the City's Development Code, towards the subject commercial building and related equipment. Section 4: Any interested person may appeal this decision or any portion of this decision to the City Council Pursuant to Section 17 02 040 C 1 j of the Rancho Palos Verdes Municipal Code, any such appeal must be filed with the City, in writing, and with the appropriate appeal fee, no later than fifteen (15) days following the date of the Planning Commission's final action Section 5: For the foregoing reasons, and based on the information and findings included in the Staff Report, Minutes and other records of proceedings, the Planning Commission of the City of Rancho Palos Verdes hereby approves, with conditions, Site Plan Review (Case No ZON2002-00570) for the placement of eight (8) air conditioning units on the roof of the future Smart & Final building and the addition of minor architectural improvements to the front facade and immediate sides of the existing building. PASSED, APPROVED AND ADOPTED this 11th day of February 2003, by the following vote - AYES Commissioner Cote, Tomblin, Mueller, Cartwright, Lyon, and Chairman Long NOES* ABSTENTIONS ABSENT.
