RESOLUTION P.C. 87- 61
A RESOLUTION OF THE PLANNING COMMISSION OF THE
CITY OF RANCHO PALOS VERDES UPHOLDING THE APPEAL OF
HEIGHT VARIATION NO. 496-APPEAL THEREBY APPROVING
THE REVISED PROJECT AT 4139 EXULTANT DRIVE.
WHEREAS, the Director of Environmental Services denied
Height Variation No . 496 on June 18 , 1987 for a second story
addition located at 4139 Exultant Drive; and
WHEREAS , on July 1 , 1987 , Frank Pol iteo , architect for
the landowner , filed an appeal with the Planning Commission
within 15 days of the decision of the Director of
Environmental Services; and
WHEREAS , on October 13 , 1987 , the Planning Commission
heard the appeal at which time all interested parties were
given an opportunity to be heard and present evidence .
NOW, THEREFORE, THE PLANNING COMMISSION OF THE CITY OF
RANCHO PALOS VERDES DOES HEREBY FIND , DETERMINE AND RESOLVE
AS FOLLOWS:
Section 1 : That the proposed addition is designed and
situated in such a manner as to minimize view obstruction
since the proposed ridgeline of the main house has a low
pitch and does not impair a primary view.
Section 2 : That the portion of the proposed addition
over the sixteen feet height does not significantly impair
the primary view from 4132 Stalwart Drive which was
identified as having a view over the subject parcel as set
forth in the City' s Development Code .
Section 3 : That there are no significant cumulative
impacts caused by granting the application.
Section 4 : That there are mature trees and shrubs on the
subject site that impair primary views over the property,
therefore , as a condition of approval , the staff shall work
with the applicant to identify vegetation to be removed or
trimmed to improve said primary views , with the Planning
Director to have final approval.

Section 5 : That after consideration of the appeal of
Height Variation No. 496 on September 22 , 1987 , the Planning
Commission approves the project at 4139 Exultant Drive .
PASSED, APPROVED and ADOPTED on this 13th day of
October , 1987 .
