P.C . RESOLUTION NO. 89-66
A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF
RANCHO PALOS VERDES DENYING AN APPEAL OF SPECIAL USE PERMIT
NO . 76 AND ENVIRONMENTAL ASSESSMENT NO . 588 , THEREBY
ALLOWING APPROVAL OF THE USE OF ROCK CRUSHING EQUIPMENT
DURING GRADING OPERATIONS AT TRACT NO. 45667 .
WHEREAS , A&H Associates has requested approval of Special Use
Permit No . 76 and Environmental Assessment No . 588 to allow the
temporary use of rock crushing equipment during grading operations
at Tract No . 45667 on Palos Verdes Drive South; and
WHEREAS , on October 13 , 1989, the Director of Environmental
Services approved Special Use Permit No . 76 , with conditions , and
a Negative Declaration for Environmental Assessment No . 588 ; and
WHEREAS , on October 17 , 1989 , the Monaco Homeowners
Association appealed the Director's decision within 5 days
thereof ; and
WHEREAS , on November 14 , 1989 , the Planning Commission heard
the appeal , at which time all interested parties were given an
opportunity to be heard and present evidence .
NOW, THEREFORE, THE PLANNING COMMISSION OF THE CITY OF RANCHO
PALOS VERDES DOES HEREBY FIND, DETERMINE AND RESOLVE AS FOLLOWS :
Section 1 : That the site for the intended use is adequate
in size and shape to accommodate said use , since grading activity
will be ongoing and a graded pad will be created to support the
rock crushing equipment .
Section 2 : That the site for the proposed use relates to
streets properly designed to carry the type and quantity of
traffic generated, since the grading approval included
requirements for a traffic safety and circulation plan, which has
been approved by the Public Works Department .
Section 3 : That there will be no significant adverse effect
on adjacent property or the permitted use thereof , as the rock
crushing operation is incidental to the grading activity on the
tract , and conditions have been included to minimize noise and
dust impacts .
Section 4 : That the proposed use is not contrary to the
general plan, since impacts are restricted to levels prescribed by
the plan.

Section 5 : That the Planning Commission has reviewed and
considered the contents of the Initial Study (Environmental
Assessment No . 588) prior to acting on this project , and
determined that approval of the project will not result in a
significant effect upon the environment .
Section 6 : For the foregoing reasons , the Planning
Commission of the City of Rancho Palos Verdes does hereby deny the
appeal , thereby approving Special Use Permit No . 76 and a Final
Negative Declaration for Environmental Assessment No . 588 , subject
to the attached conditions marked Exhibit "A" which are necessary
to protect the public health, safety and general welfare .

EXHIBIT "A"
SPECIAL USE PERMIT NO . 76
ENVIRONMENTAL ASSESSMENT NO . 588
CONDITIONS OF APPROVAL
1 . The equipment may not operate or be placed on the site prior
to approval of a valid grading permit by the Director of
Environmental Services .
2 . All appropriate permits shall be obtained from the South
Coast Air Quality Management District .
3 . Dust shall be controlled by watering or other means , such
that it does not drift off-site onto adjacent properties .
4 . The applicant ' s geotechnical consultant shall inspect the
setup of the rock crusher and approve the location of the
operation as not posing a geotechnical hazard to graded
slopes or adjacent improvements .
5 . The noise level created by the crusher and its support
equipment may not exceed 60 dBA measured as an Equivalent
Noise Level reading over an 8 hour period, measured at the
property line along Palos Verdes Drive South. The noise
level may not exceed 45 dBA over the same period, measured at
the property lines of the Salvation Army and the residences
to the north.
6 . The dBA level will be monitored on the first day of operation
for an 8 hour period and the Equivalent Noise Level shall be
recorded. Sound muffling devices or reduction in operating
time will be required by the Director of Environmental
Services if the Equivalent Noise Level exceeds allowable
limits .
7 . Hours of operation for the rock crusher and support
equipment , including equipment warm-up , shall be limited to
8 :00 a.m. to 4 :00 p .m. Monday through Friday.
8 . The equipment shall not be operated on weekends or during the
periods of November 23-26 , 1989 , and December 16 , 1989 -
January 1 , 1990 .
9 . The equipment may be operated for a maximum 6 month period,
beginning on the date of City approval of the grading permit .
Written authorization from the Director of Environmental
Services is required for any operation exceeding that period.
10 . All rock crushing operations are to be located on Lots 44-47 .
