PC RES 1989-065 110 111 P.0 RESOLUTION NO. 89 - 65 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF RANCHO PALOS VERDES APPROVING A NEGATIVE DECLARATION, COASTAL PERMIT NO. 77, AND GRADING APPLICATION NO. 1315 FOR REMEDIAL GRADING AT THE WESTERN BOUNDARY OF THE PORTUGUESE BEND CLUB. WHEREAS, the Portuguese Bend Club Homeowner Association has requested City approval for remedial grading, at the western portion of the Portuguese Bend Club along the exposed part of the toe of the Portuguese Bend landslide, to protect several residences threatened by earth movement and ensure continuing access to the area via Yacht Harbor Drive; and WHEREAS, a public hearing on this request was held before the Planning Commission on November 14, 1989, at which time all interested parties were given the opportunity to attend and present testimony. NOW, THEREFORE, THE PLANNING COMMISSION OF THE CITY OF RANCHO PALOS VERDES DOES HEREBY FIND, DETERMINE, AND RESOLVE AS FOLLOWS: Section 1: That the proposed project is consistent with the Coastal Specific Plan since: a) the project is necessary to prevent earth movement from causing the deterioration and destruction of the coastal zone and coastal environment. b) the project is necessary to prevent earth movement from causing damage or destruction to at least four single family residences within the Portuguese Bend Club along Yacht Harbor Drive. Section 2: That the proposed project is in conformance with applicable public access and recreation policies of the Coastal Act since the project involves excavation of earth at the exposed portion of the toe of an active landslide where general public access is not appropriate until the area is stabilized. Furthermore, the project preserves shoreline access for residents of the Portuguese Bend Club by ensuring the continuing accessibility of Yacht Harbor Drive. Section 3: That the Planning Commission has reviewed and considered the contents of Environmental Assessment No. 586 prior to taking action on these applications and determined that a Negative Declaration should be issued. Section 4: For the foregoing reasons, the Planning Commission of the City of Rancho Palos Verdes hereby approves the issuance of a Negative Declaration and approves Coastal Permit No. 77 and 411 Grading Application No. 1315 pursuant to the conditions in Exhibit "A" attached hereto and necessary for the protection of the public health, safety, and welfare. Resolution No. 89 - 65 Page 2 111 EXHIBIT "A" Conditions of approval for Coastal Permit No. 77 and Grading Application No. 1315 : 1) Any grading and stockpiling shall be subject to the review and approval of the City Geotechnical Consultant and the City Engineer. 2) A grading permit must be obtained from the Building and Safety Division prior to commencement of work. 3 ) A liability waiver shall be submitted and recorded prior to grading permit issuance. 4) A written statement from the applicant acknowledging review and acceptance of all conditions of approval shall be submitted prior to issuance of a grading permit. 5) Erosion control measures, as specified by the Building Official , shall be required for any grading occurring between October 15 and April 15 . 6 ) All abutting property owners shall be notified by the Portuguese Bend Club Homeowner Association prior to commencement of any grading. 7 ) Excavation shall not exceed 10 , 000 cubic yards during a two year period starting from the date of this approval except under emergency circumstances and with the specific approval of the City Geotechnical Consultant and the Director of Environmental Services. If such emergency grading occurs, the Planning Commission shall be notified of the grading at the earliest opportunity. 8 ) This approval shall expire November 14, 1991. P.C.
