PC RES 1989-064 P.C . RESOLUTION NO . 89-64 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF RANCHO PALOS VERDES DENYING CONDITIONAL USE PERMIT NO. 150 , AND APPROVING SIGN PERMIT NO. 458 , REQUIRING THE REMOVAL OF THE EXISTING POLE SIGN AND ALLOWING THE REFACING OF OTHER EXISTING SIGNS AT 29019 S . WESTERN AVENUE. WHEREAS , DOT Investments and Sizzler Restaurants have requested approval of Conditional Use Permit No . 150 and Sign Permit No . 458 to allow the refacing of several existing non- conforming signs on the building, the existing pole sign and directional signage at 29019 S . Western Avenue . WHEREAS , after notice pursuant to the Development Code , a public hearing was held on October 24, 1989 at which time all interested parties were given the opportunity to give testimony and present evidence . NOW, THEREFORE, THE PLANNING COMMISSION OF THE CITY OF RANCHO PALOS VERDES DOES HEREBY FIND, DETERMINE AND RESOLVE AS FOLLOWS : Section 1 : The existing pole sign is not necessary for the applicant ' s enjoyment of substantial trade , since the existing building signs are highly visible to traffic on Western Avenue . Section 2 : The existing pole sign constitutes needless repetition, redundancy and proliferation of signage since the signage on the building adequately identifies the site . Section 3 : The size and height of the existing pole sign is not compatible and harmonious with the building and site , since the excessive size and height are out of scale with the site . Section 4 : The design and size of the existing pole sign detracts from the adjacent developed properties since all of the adjacent commercial establishments on the west side of Western Avenue have removed their pole signs and the existing pole sign is not compatible with the visual characteristics of the surrounding area. Section 5 : The height and size of the existing pole sign has a significant adverse effect on the character of the adjacent residential district since the residences are at a higher elevation and the sign is highly visible from these residences . Section 6 : That the granting of the Conditional Use Permit for the existing pole sign would be contrary to the Specific Plan since the additional size is not necessary to identify the site and the sign design is not compatible with the total site design. Section 7 : That the refacing of existing signage is consistent with the requirements of Section 17 . 52 .020 (C) 1-8 of the Development Code and Specific Plan IV. Section 8 : For the foregoing reasons , the Planning Commission of the City of Rancho Palos Verdes does hereby deny Conditional Use Permit No . 150 and approve Sign Permit No . 458 subject to the conditions contained in Exhibit "A" , attached hereto and made a part hereof , which are necessary to preserve the public health, safety and general welfare in the area. Resolution No . 89-64 Page 2 EXHIBIT "A" CONDITIONAL USE PERMIT NO. 150 SIGN PERMIT NO. 458 1. The three existing roof parapet canister and channel letter signs which are 3' 9" high by 12' wide each may be refaced with a "Delaware" blue background. 2. The existing "collage" sign, approximately 15 square feet in area may be replaced with a new sign of equal size, with the only revision being a "Delaware" blue background. 3. The two existing directional signs, 4' wide by 2' high on a 2' post (4' total height) may be refaced with new signs of equal size with the only revision being a "Delaware" blue background. 4. The existing pole sign shall be removed by January 30, 1990. 5. A penalty fee of $175 shall be paid by November 30, 1989, since the existing signage has already been refaced prior to approval. 6.
