A RESOLUTION OF THE PLANNING COMMISSION OF THE
CITY OF RANCHO PALOS VERDES ADOPTING A NEGATIVE
DECLARATION FOR ENVIRONMENTAL ASSESSMENT NO. 506,
APPROVING COASTAL PERMIT NO. 70 AND RECOMMENDING
APPROVAL OF ZONE CHANGE NO. 18 TO THE CITY COUNCIL
TO ADJUST THE COASTAL SETBACK LINE IN A PORTION OF
THE PORTUGUESE BEND CLUB.
WHEREAS, Transamerica Realty Service has requested a Coastal
Permit and Zone Change to adjust the Coastal Setback Line an
average of approximately 40 feet seaward of its present location
on the level plateau northwest of the gatehouse; and
WHEREAS, after notice issued pursuant to the provisions of
the Rancho Palos Verdes Development Code, a public hearing was
held on July 25, 1989, at which time all interested parties were
given an opportunity to be heard and present evidence;
NOW, THEREFORE, THE PLANNING COMMISSION OF THE CITY OF RANCHO
PALOS VERDES DOES HEREBY FIND DETERMINE AND RESOLVE AS FOLLOWS:
Section 1: That the proposed project will not have a
significant negative impact on the environment, since any future
development will be subject to mitigation measures required
through a tract map or conditional use permit application.
Section 2: That the proposed project is in conformance with
the coastal specific plan in that the project does not propose to
alter the use or residential density on the property.
Section 3: That the proposed project, which is located
between the sea and the first public road, is in conformance with
applicable public access and recreation policies of the Coastal
Act since the proposed project does not involve any physical
development and the issue of coastal access will be addressed
through a subsequent subdivision application.
Section 4: That the proposed adjustment to the Coastal
Setback Line will not create a geologic hazard since the City
Geologist and Geotechnical Review Committee have reviewed and
approved the applicant' s geology reports and have required
specific conditions of approval for any future development on the
site.
Section 5: For the foregoing reasons, the Planning
Commission of the City of Rancho Palos Verdes hereby adopts the
Negative Declaration, approves Coastal Permit No. 70 and
recommends approval of Zone Change No. 18 to the City Council for
the adjustment to the Coastal Setback Line on the upper plateau of
the Portuguese Bend Club.
