PC RES 1989-039 P .C . RESOLUTION NO . 89- 39 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF RANCHO PALOS VERDES APPROVING VARIANCE NO . 238 AT 4222 EXULTANT DRIVE . WHEREAS , Tadaaki Fujima has requested a Variance to allow a garage addition that encroaches 12 feet into the 20 foot front setback at 4222 Exultant as required by the City Development Code ; and WHEREAS , after notice pursuant to the City ' s Development Code , a public hearing was held on July 11 , 1989 , at which time all interested parties were given an opportunity to be heard and present evidence . NOW, THEREFORE, THE PLANNING COMMISSION OF THE CITY OF RANCHO PALOS VERDES DOES HEREBY FIND, DETERMINE AND RESOLVE AS FOLLOWS : Section 1 : That an administrative error occurred in the issuance of building permits for the garage addition and said construction is not detrimental to the public welfare . Section 2 : The approved plans were inaccurate and a granting of a fee waiver is not justified. Section 3 : There shall be no eave projections on the garage addition. Section 4 : An automatic roll-up type garage door shall be installed. Section 5 : A city landscape covenant to maintain property to protect views shall be submitted and recorded prior to final building and safety inspection. Section 6 : For the foregoing reasons , the Planning Commission of the City of Rancho Palos Verdes hereby approves Variance No . 238 . APPROVED, and ADOPTED this 11th day of July , 1989 . Luella L.
