PC RES 1989-009 P.C. RESOLUTION NO. 89-9 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF RANCHO PALOS VERDES APPROVING VARIANCE NO. 228 FOR A ONE ( 1 ) FOOT INCREASE IN THE MAXIMUM 30 FOOT DOWNSLOPE HEIGHT OF A SINGLE FAMILY RESIDENCE LOCATED AT 3335 PALO VISTA DRIVE. WHEREAS, Mr. Darwin Ebinger has requested a Variance for a one (1 ) foot increase in the maximum 30 foot downslope height of a single family residence. WHEREAS, after notice issued pursuant to the provisions of the Rancho Palos Verdes Development Code, a public hearing was held on February 14, 1989, at which time all interested parties were given an opportunity to be heard and present evidence; NOW, THEREFORE, THE PLANNING COMMISSION OF THE CITY OF RANCHO PALOS VERDES DOES HEREBY FIND, DETERMINE AND RESOLVE AS FOLLOWS: Section 1: That there are exceptional or extraordinary circumstances and conditions applicable to the property involved which do not apply generally to other properties in the same zoning district, in that the subject property is constrained by unusual topography. Section 2: That there are special circumstances which unreasonably restrict the applicant' s ability to develop the property in conformance with City development regulations, in that the structure was not constructed in conformance with the approved plans resulting in a twelve inch increase in the approved height. Section 3: That the granting of the Variance will not be materially detrimental to the public welfare or injurious to property and improvements in the area in which the property is located, since the structure will cause no view blockage and will not encroach into the privacy of adjacent neighbors. Section 4: That approval of the Variance will not confer a special privilege on the applicant in relation to similarly situated property owners in the same zoning district, in that similar property owners in the same zoning district would be allowed to construct similar projects. Section 5: That approval of said Variance is not contrary to the General Plan. Section 6 : For the foregoing reasons , the Planning Commission of the City of Rancho Palos Verdes hereby approves Variance No . 228 , subject to conditions in Exhibit "A" , for a one ( 1 ) foot increase in the maximum 30 foot downslope height of a single family residence located at 3335 Palo Vista Dr. PASSED, APPROVED and ADOPTED this 14th day of February, 1989 . c7_"< k , e',./c4(4p Luella L .
