PC RES 1989-002 411 RESOLUTION P.C . NO . 89 - 2 A RESOLUTION OF THE PLANNING COMMISSION TO THE CITY OF RANCHO PALOS VERDES APPROVING A REVISION TO TENTATIVE PARCEL MAP NO. 19016 , AND GRADING APPLICATION NO. 1048 . WHEREAS , Benjamin and Dolores Molina, have requested approval to revise the approved grading plan for Tentative Parcel Map No . 19016 and Grading Application No. 1048 ; and WHEREAS , after notice issued pursuant to the provisions of the City 's Development Code a hearing was held on January 24 , 1989 , at which time all interested parties were given an opportunity to be heard and to present evidence . NOW, THEREFORE, THE PLANNING COMMISSION OF THE CITY OF RANCHO PALOS VERDES DOES HEREBY FIND, DETERMINE AND RESOLVE AS FOLLOWS : Section 1 : That the revised grading is not excessive beyond that necessary for the permitted primary use of the lot . Section 2 : The revised grading does not significantly adversely affect the visual relationships with, nor the views form, neighboring sites . Section 3 : That the nature of the revised grading minimizes disturbance to the natural contours ; finished contours are reasonable natural . Section 4 : For the foregoing reasons, the Planning Commission of the City of Rancho Palos Verdes does hereby approves a revision to the approved Grading Application No . 1048 and Tentative Parcel Map No . 19016 subject to the attached conditions marked Exhibit "A" , which are necessary to protect the public health, safety and general welfare in the area. Wike Chairperson Adr/ At A( ob - rt Bena d, Director of Environmental Services and Secretary to the Commission 411 EXHIBIT "A" Revision to the approved Grading Application No . 1048 and Tentative Parcel Map No . 19016 is approved subject to the following condition: 1 . Condition No . 16 , Exhibit "A" , Resolution 88-3 is amended to read as follows : "Grading slope tops shall be rounded, slope gradients shall be varied and no significant abrupt changes between natural and graded slopes will be permitted. All created slopes shall not be greater than 3 : 1 except for the buttress fill adjacent to Palos Verdes Drive East may be graded at 2 : 1 . This grading will only be permitted by the Director of Environmental Services if no other alternative is available to stabilize this slope . The existing California Peppers must be replaced with mature specimens and root guards will be required, subject to review and approval by the Director of Public Works and the Director of Environmental Services under the provisions requiring submittal of landscape and fencing plans . An encroachment permit shall also be approved by the Director of Public Works . 2 . Condition No . 27 , Exhibit "A" , Resolution 88-3 is amended to read as follows : "The developer shall submit an irrevocable standby letter of credit , with a bank approval by the City, that shall honor the cities request for payment when required by the Director of Public Works or cash payment of $32 ,000 towards future improvements to Palos Verdes Drive East adjacent to the proposed project . Improvements include road widening, bank removal , curb and gutter, bicycle path markings and signage . Traffic impact fee , the amount to be determined by Director of Public Works , shall also be required. The developer shall post a bond for an indefinite period for these fees ." 3 . Condition No . 28 , Exhibit "A" , Resolution 88-3 is amended to read as follows : "Should retaining walls along Palos Verdes Drive East be required at the time of improvements in item 27 or for other purposes , the owner shall be responsible for all costs associated with construction of such a retaining wall (s ) . A $25 ,000 bond or other acceptable security shall be secured for a period not to exceed 5 years from the date of the Final Map . " P.C . Resolution No . 89-2 Page 2
